CASE 58-2020: Turkey

ETHICAL JUDGMENT

Dear Prosecutor, Peace Ambassador and Human Rights Defenders of the International Buddhist Ethics Committee (IBEC) and Buddhist Tribunal on Human Rights (BTHR), regarding Case 58-2020 against “Turkey”, on December 7, 2020, it is hereby recorded that the trial has been concluded to analyze the violations of Human Rights and Buddhist Ethics carried out by the accused. This case has been carried out as a result of an investigation by the Presidency of the Buddhist Tribunal presented before the University of Buenos Aires (UBA).

After the analysis of the presentation of the Case and the validation of proofs, the Tribunal has proceeded with the voting of 4 Human Rights Defenders, all of whom confirmed that the accusation against Turkey for the serious crimes of Complicity with the Genocide is Fair.

The Buddhist Tribunal on Human Rights has been able to compile evidence proving that “Turkey” has committed Complicity and Denialism of the Armenian Genocide carried out by the Ottoman Empire.

Here is the Reflections on the Armenian Genocide by the Presidency of the Buddhist Tribunal submitted before the University of Buenos Aires (UBA) on June 15, 2020:

I. After 100 years of its occurrence, the historical existence of the Armenian Genocide is recognized by 29 States. These are Argentina, Austria, Belgium, Bolivia, Brazil, Canada, Chile, Cyprus, Czech Republic, Denmark, France, Germany, Greece, Italy, Lebanon, Lithuania, Luxembourg, Holland, Paraguay, Poland, Portugal, Russia, Slovakia, Sweden, Switzerland, Vatican City, Venezuela, United States of America, and Uruguay. There are also hundreds of international organizations that are experts in genocide recognizing these historical facts.

II. However, the Armenian Genocide is systematically denied by its author, the State of Turkey, which has openly supported a massive campaign of genocidal denial,[1] which constitutes a re-victimization of the Armenian people and nullifies any possibility of a historical and reconciling Cure. Indeed, the Armenian People deserves an appropriate and sensitive understanding for having suffered a terrible Genocide and Ethnic Cleansing,[2] that is why the entire international community should criticize the despotic political power of Turkey.

III. In the eyes of International Human Rights Law, the criminal aberrations of Nazism were preceded by other genocidal episodes, such as the German massacre of Hereros in 1904, the Turkish massacre of Armenians between 1915-1923, and the Ukrainian anti-Jews pogrom in 1919, among others.[3] In the case of the Armenian Genocide, more than 1 million civilians were killed through a state plan, which has been corroborated by hundreds of reports from the USA, Germany and the UK. In fact, the German ambassador Wangenheim confirmed in July 1915 the realization of an extermination plan of the Armenian race within the Ottoman Empire.[4] Despite the fact that after the World War I some of those responsible for the massacres against the Armenian people were prosecuted, the nascent Turkish Republic decided to ignore justice, gave impunity to the guilty and initiated a centennial process of denial about the existence of Genocide.[5]

IV. Either way, the history of International Law recognizes that the 1948 Convention on the Prevention and Punishment of Genocide is the result of the inhuman and barbaric practices of some countries that exterminated religious, ethnic, racial and national groups, as was the case of the Roman persecution of Christians, the Turkish extermination of Armenians, and the massacres of Jews by the Nazis.[6] Furthermore, the very creator of the concept of genocide, Raphael Lemkin, quoted the massacres against Armenians as a prototypical example of genocide.

V. In May 1915, the governments of Russia, the United Kingdom, and France declared that the massacres committed by Turkey against the Armenian people constitute crimes against humanity and the civilization, reason by which all members of the Turkish government are responsible. In this sense, when the Sèvres Peace Treaty was signed, Turkey made an international commitment to hand over the individuals responsible for these massacres before a special court, which constituted not only an acceptance of the genocidal events that occurred but also set the historical precedent for the Nuremberg and Tokyo trials after World War II where Germany and Japan were judged for crimes against humanity.[7]

VI. The Turkish State committed Genocide against the Armenian Christian People in a systematic and widespread way through a completely premeditated plan of extermination and racist supremacy. Thus, more than 1 million Armenians were killed, subjecting them to an evil process of deportation, famine, torture, sexual abuse and kidnapping of children. This meant that an ancient civilization was separated from its homeland. Obviously, there are plenty of documents of Turkish courts martial that recorded the same events already described by diplomats, missionaries, scholars and survivors.[8] Nonetheless, Turkey’s denial rhetoric persists, even erasing the word Armenian from its official history, all of which shows that Turkey succeeded with the Armenians in what Hitler later attempted to do with the Jews: what Ellie Weisel called the double murder, since it implies a physical destruction of the victims and then their demonization and denial, murdering their dignity and honor. Therefore, in order to respect the victims and to prevent injustice from happening again in the future,[9] the practice of historical memory is fundamental, denouncing the immorality and manipulation of the denial government of Turkey that has tried to corrupt the academic studies on genocide throughout the world. Thus, since the Universities are genuine reservoirs of knowledge and history, they have the duty to denounce the Turkish massacres of Armenians as genocidal episodes, requiring the international community to recognize these historical facts and that there is no global silence, including by pressuring the government of Turkey in order to put an end to this dark stage of history by acknowledging the Armenian genocide.[10] In short, recalling and educating the new generations about the tragedies of the past, such as the Armenian Genocide, is a duty and a tool to prevent future tragedies,[11] and so that one can say Never Again.[12]

VII. The Genocide committed against the Armenian People was carried out because it was a community with a deep Christian religiosity and with a distinctive ethnic identity with respect to the rest of Turkish society. Thus, over the Turkish political power lies all the shame and responsibility for these genocidal massacres of Armenians, as it sought to create a uniform nationalist society through violent and exterminating means. Denial is then a perpetuation of these crimes. Therefore, the international community must request the State of Turkey to carry out a process of recognition of the genocide, apologies, economic and even cultural compensation, and even possible territorial restitution. In fact, this same type of requirement toward Turkey could be requested by other communities that were also massacred during the same time of the Armenian Genocide, as was the case of the Assyrians and Greeks. Indeed, the number of Assyrians murdered during deportations and massacres would be 300,000 people, while in the case of the Pontic Greeks the genocide would be 350,000 people. This shows that the State of Turkey was built on the blood of Christian peoples who were purged by genocidal governmental forces. The denial of this history is the perpetuation of tyranny.[13]

VIII. Faced with the atrocious history of unspeakable crimes against humanity carried out by Turkey, the international community must show solidarity toward the Armenian people who are victims of ethnic cleansing and genocidal massacres.[14]

IX. Although some countries do not consider Denialism as a crime, nevertheless, it is a violation of human rights that constitutes the last stage of the Genocide, being a continuation of it. This kind of criminal action impedes the right of descendants to mourn and honor their ancestors,[15] causing the ethnic cleansing of the Armenian people to be a physical, cultural and historical annihilation that hinders any progress of coexistence through a culture of impunity, militarism, authoritarianism and violation of human rights.

X. When analyzing the 1948 Genocide Convention it can be concluded that the perpetrator of the Armenian Genocide was the Ottoman-Turkish State, that a large number of people belonging to an ethnic and religious group were murdered, and that the perpetrator tried to totally destroy the Armenian group by means of a systematic and widespread plan. It can be established that all the elements of the crime established in the Genocide Convention are present in the events of the Armenian Genocide.[16]

XI. Although the Turkish State was assisted by Kurdish tribes in the perpetration of the Armenian Genocide of 1915, where hundreds of thousands of Assyrians were also massacred, a century later Turkey has initiated genocidal procedures against the Kurdish People.[17]

XII. The extrajudicial killings carried out by the Turkish Empire against women and children were carried out with total impunity because the social leaders of the Armenian People who were able to present some kind of resistance to extermination had been initially and quickly massacred. In any case, the Armenian people in exile have courageously confronted Turkey’s Denialism that tries to rewrite history and to hide the genocide. Therefore, the international community has an ethical duty to recognize the Truth and remember these barbaric acts of ethnic cleansing that constitute a dark stage in the history of the world. To honor the memory of the victims of genocide, violence, hatred, discrimination and fundamentalism must be confronted, building a future of peace for all humanity.[18]

XIII. The Armenian Genocide was one of the most terrible tragedies in human history, as more than 1 million peaceful people were cruelly murdered and hundreds of thousands more were violently expelled from their homes by means of a state plan of massive repression that also looted and destroyed the cultural legacy of an ancient civilization, disappearing monuments and sacred books that are invaluable, for which in addition to being crimes against humanity, ethnic cleansing and genocide, it was also a crime against the cultural heritage of humanity. Therefore, the international community must ensure these terrifying events of nationalism and xenophobia will never happen again, so that all the peoples can live in peace, harmony, friendship, solidarity, goodness and respect, which is the only way for civilization to be a better and safer place.[19]

XIV. Although history usually recalls that the Armenian Genocide was in 1915, there were certainly another two previous episodes of persecution and mass annihilation in 1894-1896 and 1909. Thus, it would be more accurate for history to remember that the Armenian Genocide occurred between 1894 and 1923 and that in the period of three decades there were three distinctive episodes of organized massacres: 1894-1896, 1909 and 1915-1923.

XV. The Armenian Genocide occurred in the context of mass deportations of men, women, children and the elderly, all of whom were expelled from their homes and forced to walk to another territory. On their way they found only violence, murder, sexual abuse, torture, famine and death. They were hunted as the Turkish Empire had previously dehumanized this large ethnic and religious community, considering it as an enemy pathogen that infected the national body and then subjecting it to forced relocations, mass annihilation, ethnic cleansing and genocide. This fate of Genocide was not only for the Armenian People, but also the Assyrian, Aramaic and Pontic Greek peoples.[20] They all share the same terrible history of violation of their intrinsic dignity as well as the same Denialism on the part of the State of Turkey, which has not only tried to eliminate their physical presence but also to vanish them from history. Clearly, the underlying motivation behind these massacres and mass killings was nationalist racism and religious fanaticism, seeking an ethnically homogeneous nation rather than following the ancient Islamic tradition of peaceful and just coexistence among different religious peoples.

XVI. Being an ally of the Ottoman Empire, the German State also bears responsibility for the Armenian Genocide, since there were even German military officers who participated in the planning and realization of mass deportations. Thus, the warnings from German diplomats that alerted the exterminating intention of the deportations were ignored, since maintaining the military alliance with Turkey during the First World War was the only thing it was attempted, even though this implies the death of hundreds of thousands of Armenian Christians, Assyrians and Greeks, who suffered the worst crimes against human dignity.[21] Without self-criticism, justice and recognition of this Truth there will never be reconciliation, peace and global union.[22]

XVII. The Armenian People, along with other Christian communities, experienced a true Hell on Earth, confronting the Great Evil (Metz Yeghern). Decades later, this same hell was experienced by Jewish and Romani Peoples. Humanity must spiritually unite with these communities that have suffered genocidal persecutions because of their religion and culture, but who have precisely survived and moved on because of their faith or hope in Salvation, preserving their identity as a people. The history of suffering and martyrdom is a precious aspect for Christianity, which is proud to have shown such courage on the Path of life for being something as admirable as the attitude of Jesus on the Cross.[23] In any case, Christianity requires the entire international community to firmly oppose these kinds of violent crimes, rejecting them with a sense of duty and without ambiguities, so that the horror does not repeat again.[24] Ultimately, what will save humanity is peaceful coexistence, mutual support and universal solidarity, since Love and Justice have a redemptive power in the world.

As Saint Gregory of Narek, Armenian Theologian, Poet and Philosopher said: “Grant forgiveness and mercy to enemies, (…) Do not exterminate those who persecute me but rather reform them, extirpating the bad ways of being in order to root good in one and in them”.[25]

In conclusion, Master Gautama Samyaksambuddha assumed the Purpose to Cure (Nirvana) suffering of humanity, which is why the Buddhist Spirituality does not allow peoples to be erased from history with impunity. In this way, the Buddhist Law judges and sentences “Turkey” as Responsible for Complicity with Genocide.

The Updating of the Four Noble Truths

The Updating of the Four Noble Truths

Master Gautama Buddha taught 4 Noble Truths that have been preserved by the Theravada tradition for 2600 years, making an extraordinary diagnosis of existence. In the First Noble Truth, Gautama Buddha taught that life is unsatisfaction (dukkha), often misunderstood as suffering. In the Second Noble Truth, Gautama Buddha taught that the cause of this dissatisfaction is attachment (tanha), often misunderstood as desire. Therefore, in the Third Noble Truth, Gautama Buddha prescribes Detachment in order to achieve Evanescence (Nirvana) from unsatisfaction (dukkha).

Thus, in the Fourth Noble Truth, Gautama Buddha shows how is the correct means to achieve Detachment, which is to follow the Noble Eightfold Path composed of the right understanding, the right thought, the right word, the right conduct, the right work, the right effort, the right attention and the right concentration.

This is the classical model of Theravada Buddhist teaching. However, Master Gautama Buddha continued to perfect this model throughout his 50 years of dharmic teaching which are the basis of the Mahayana. In the Sutras there are records that Gautama Buddha taught a variation to his First Noble Truth, showing that there is no single mark but rather that existence has 3 characteristics (tri laksana): unsatisfaction (dukkha), impermanence (anitya) and insubstantiality (anatman).

In the Sutras also Gautama Buddha taught that the mind has not only attachment, but also aversion and unconsciousness, considering that these forces constitute the three poisons. At the same time, within Theravada itself there is a variant for the Fourth Noble Truth, which is the Tenth Noble Path, in which adequate liberation and adequate knowledge are added.[1] And finally, Master Gautama Buddha also taught that there is a mission superior to Enlightenment, which would be the state of the Bodhisattva as that human being who seeks Enlightenment for all sentient beings and not just for himself, which is a teaching essential within the Mahayana.

On the other hand, in September 2020, Maitriyana Buddhism has held a Council in which leaders of the Theravada and Mahayana approved a model composed of the Five Noble Truths and the Noble Twentieth Path of Buddhist Evolution. The First Noble Truth of Maitriyana is that “everything in the Universe is inherently unsatisfactory, impermanent, insubstantial and interdependent”. The Second Noble Truth of Maitriyana is that “the ordinary human being lives with attachment to suffering, repetition (karma) in the face of change, unconsciousness of Emptiness, and aversion to others”. The Third Noble Truth of Maitriyana is that “the Evolution of the human being is through Detachment, Serenity, Awakening and Mutual Support”. The Fourth Noble Truth of Maitriyana is that “Detachment, Serenity, Awakening and Mutual Support must be practiced through the Noble Twentyfold Path comprised of adequate attention, adequate peace, adequate health, adequate liberation, adequate concentration, adequate thought, adequate knowledge, adequate comprehension, adequate truthfulness, adequate harmony, adequate speech, adequate work, adequate conduct, adequate justice, adequate effort, adequate responsibility, adequate love, adequate intuition, adequate unity and adequate salvation”. And the Fifth Noble Truth teaches that “Individual Evolution is not the ultimate goal, but is only the righteous means for the True Purpose (Dharma) which is the Cosmic Evolution of all sentient beings in the Multiverse”.[2]

In conclusion, the original Buddhist Diagnosis is not perfect, but has been historically updated by the great Buddhas. This is because the Buddhist Dharma continually evolves for the good of the Universe. However, it is essential that the apprentices who follow the Buddhist Path do not adhere to any type of ideology or closed vision, because the enlightened life is change and learning. In short, Emptiness is nothing more than having an open mind to this Sense of existence.

Proclamation on Crimes Against Humanity by the Catholic Church

The International Buddhist Ethics Committee & Buddhist Tribunal on Human Rights,

Recalling that the National Ecclesiastical Tribunal of Argentina led by Jorge Bergoglio (Pope Francis) was previously sentenced as Responsible for Violation of the Human Right to Justice, Spiritual Fraud and False Christianity, Corruption, Covering up of Sexual Abuses and Pedophilia, Crimes against Childhood and Unethical Leadership;

Considering that Julián Maradeo has demonstrated the existence of a systematic cover-up mechanism by the Ecclesiastical Power, especially by analyzing cases of sexual abuse of Catholic priests in Argentina;[1]

Aware that the perverse mechanism of the Catholic Church in the systematic realization and cover-up of sexual abuse and pedophilia consists in requiring their concealment under penalty of excommunication,[2] providing impunity to those denounced criminal priests by not investigating them neither bringing them to criminal justice and ecclesiastical justice, and even providing them with new victims by transferring the accused to other institutions, which is a procedure designed by the Vatican and that has been applied regularly to most of dioceses in the world;

Deploring this criminal cover-up manual practiced in a systematic and widespread way by the Catholic Church, which consists of the following steps in the face of allegations of sexual abuse: minimally distancing the priest from the victim, silencing the victims, pressuring the critics, transferring the priest to another diocese, publicly simulate support for the victims in their suffering, and finally begin a never-ending internal investigation which will hardly ever find justice;

Enormously concerned about the role that Jorge Bergoglio (Pope Francis) has had in multiple cases of cover-up of sexual abuse and pedophilia, as evidenced by his actions during the Provolo Institute Case in which he received information about massive sexual abuse of deaf children but only decided to intervene when the case has gone public in the media;

Analyzing that Pope Francis has only changed the communicational approach on the cover-up of sexual abuse although he has not evanesced its criminal system, since he criticizes those priests and bishops who practice it while himself simultaneously continues with these criminal practices in many cases, such and as has happened with the Priest Grassi Case, the Provolo Institute Case, the Cardinal McCarrick Case, the Bishop Barros Case and the Priest Decuyper Case, which implies hypocrisy and structural criminality on the part of the highest spheres of the Vatican Power;

Taking into consideration that Jorge Bergoglio (Pope Francis) not only stated that the accusations against the pedophile Priest Grassi were an invention of the media, but also hired the jurist Sancinetti to write a legal defense in which the victims were accused of being lying in a process similar to a witch hunt, presenting these 2000 pages of legal defense to the Argentine Supreme Court of Justice in order to pressure for the release of Priest Grassi, which did not happen due to the large number of evidence against him;

Warning that the pedophile Julio Cesar Grassi continues to be a priest despite being imprisoned with a final sentence of 15 years in prison for abuse of minors and for corruption as well, which is something that explicitly demonstrates a current direct endorsement of Pope Francis and the Vatican Power to this powerful and corrupt pedophile who betrays the entire Christian spiritual legacy of love and solidarity toward the neighbor;

Recognizing that Pope Francis has not only systematically defended Bishop Juan Barros who covered up the sexual abuse of Priest Karadima, but has even discredited the victims by accusing them of spreading slander;

Showing consternation at the fact that Pope Francis contacted Sergio Decuyper, who is the victim of sexual abuse by his own uncle the Priest José Decuyper, demanding the victim to remain silent, not to tell his parents and not to denounce his uncle, which shows a total criminal cover-up by Pope Francis, who also stated that victims have a lot of hatred and that this happens in the whole society but they want to blame only the priests, all of which led Sergio Decuyper to spiritually doubt Pope Francis and to affirm that he is possibly very intelligent and bad;

Examining the fact that there is evidence suggesting that Pope Francis knew about the sexual abuse committed by Cardinal McCarrick and nevertheless he decided to cover up such crimes, as confirmed by the ex-nuncio Monsignor Carlo María Viganó, who publicly accused Pope Francis of covering-up and of lying openly and blatantly to the whole world by saying that he does not remember talking to him about McCarrick’s abuses, which is why Monsignor Viganó has publicly demanded the resignation of the Catholic Supreme Pontiff;

Agreeing with Monsignor Viganó that silence or covering-up is to be an accomplice of the abusers and is to cause new victims, being a criminal pattern of Pope Francis, who also covers up other cases of abusers as has done with Cardinal McCarrick, which constitutes a truly dark moment for the Universal Church, because this means that Pope Francis should be tried and expelled for covering up of sexual abuse;

Confirming the fact that Monsignor Nicola Bux stated that there are legal difficulties in Catholic doctrine in order to be able to judge Pope Francis, since it is believed that the Pope can only be judged by God, which is a belief that violates the human right to justice and positions him in absolute impunity beyond the rule of Law, being then more necessary than ever this Proclamation judging his behavior as criminal, unethical and anti-Christian;

Bearing in mind that Pope Francis prohibited the United States Episcopal Conference from voting on measures against sexual abuse, which was characterized as disappointing by its President, Cardinal Daniel DiNardo, especially when analyzing the magnitude of the problem of cases of sexual abuse carried out by priests against children, because since the year 2000 more than 6,700 cases of pedophile priests and around 18,000 child victims have been counted in the USA;

Reaffirming that Pope Francis has publicly confessed that the Catholic Church covered up and underestimated sexual abuse due to incredulity, inexperience, spiritual superficiality or lack of seriousness, treating the cases without seriousness and rapidity, so the Vatican has then promised never to do so again and never to get tired of bringing abusers to justice, all of which is a very good speech but contradicts the very actions that Pope Francis has systematically committed both before and after, in addition to legally constituting an act of confession for crimes that have gone unpunished and that must be brought before criminal justice and spiritual justice;

In agreement with the speech of Pope Francis that behind the angelic face of the abusive Catholic priests hides a ferocious wolf ready to devour innocent souls, since they commit abominations and abuse the weak by using their moral power and persuasion, which rips apart the body of the Church causing scandal and discrediting the salvific mission and the sacrifices of many brothers, for which the Catholic Church is required not to be silent in the face of sexual abuse because the greatest scandal is to cover up the Truth, all of which is a proof that Pope Francis has not carried out all that he preaches in his own words;

Claiming to Pope Francis that he should open the classified archives of the Vatican on the systematic and widespread sexual abuse that the Catholic Church carried out for decades against 100,000 children around the world, which constitutes Crimes against humanity in the eyes of the International Law, so the plot of crimes and complicities must be clarified once and for all, especially judging the criminal Vatican Power and its perverse cover-up that is evident in the Priest Grassi Case and the Próvolo Institute Case;

Impugning the ecclesiastical summit against pedophilia led by Pope Francis in which the Catholic Church pointed out that sexual abuse committed by priests is only part of the abuse as a wide and transversal problem at the social level, which means that the hierarchs of the Vatican Power do not assume the whole responsibility in the perverse performance and in the immoral cover-up of the rape of children, denigrating and revictimizing the victims through a miserable and cowardly position that is contrary to International Human Rights Law and also contrary to Spiritual Justice;

In solidarity with the Survivors Network of those Abused by Priests, who have criticized Pope Francis for his false fight against pedophilia and sexual abuse committed by Catholic priests, characterizing this as an act of simulation and hypocrisy on the part of the Vatican State, which is a serial violator of international Human Rights Conventions and also it is a State where systemic corruption reigns;

Condemning the fact that the Vatican Power fails to comply with the exhortations made in 2014 by the UN and its Committee for the Protection of Children’s Rights, which criticized the Vatican for systematically putting the reputation of the Catholic Church and pedophile priests above the children’s interests, being evident the fact that the Vatican has not recognized the seriousness of the crimes committed, has not taken the necessary measures to confront cases of child sexual abuse and has not protected children, since it has adopted policies and practices that continue with the abusive exploitation and impunity of priests that are guilty of abuse or cover-up;

Affirming that the maximum proof of the complicity of Pope Francis and the Vatican Power with sexual abuse is their ongoing support for Priest Grassi, who despite having been sentenced to prison for child abuse and also for embezzlement of funds from an orphanage he still continues to hold the rank of Catholic priest and even continues to threaten and intimidate his victims by suing them for damages;

  • It is established that the Buddhist Law was and will always be on the side of the poor and oppressed, especially on the side of children.
  • The supreme teachings of Master Jesus are recalled, for being the maximum protector of the intrinsic sacredness of childhood life.
  • This ethical Proclamation is invoked as an act of spiritual justice in the face of Crimes against Humanity carried out by the Vatican and its canonical tribunals that provide impunity to abusers and those who cover up, such as Priest Grassi and Pope Francis respectively.
  • It is declared that the Vatican is a Genocidal State that has intentionally destroyed the childhood of a religious group protected by the 1948 International Convention on the Prevention and Punishment of Genocide, generating massive physical and psychological damage, and even carrying out and maintaining a system of protection and cover-up of pedophile Catholic priests in clear systematic and widespread violation of the human rights of hundreds of thousands of Catholic children worldwide.

This was written 2,600 years after the foundation and independence of the Great Buddhist Nation.

The Buddhist Tribunal on Human Rights confirms that a few days after being sentenced as Responsible for Negligence, Malpractice and Complicity with Crimes against Humanity, the WHO made a public confession in which it endorsed the position taken by Trump, Bolsonaro, the Buddhist Tribunal and thousands of other scientists, calling on governments to stop using quarantines as the main control method against the Coronavirus. Indeed, Dr. David Nabarro, who is in charge of the WHO in Europe, confessed that quarantine only makes people poorer, and that it can double world poverty and child malnutrition. Even Dr. David Nabarro showed concordance with the Great Barrington Declaration signed by the presidency of the Buddhist Tribunal.

On the other hand, the WHO Secretary-General Tedros Ghebreyesus, whose leadership has been unethical by being biased in favor of China, has immorally asserted that seeking herd immunity is not an option because it is contrary to ethics, and that the only option will be to continue with confinements. The Buddhist Tribunal on Human Rights & International Buddhist Ethics Committee affirms that the only thing that is scientifically and ethically problematic has been the criminal leadership of the WHO and its Director who was in favor of the massive arbitrary arrests of millions of people, which constitute Crimes against Humanity.

Finally, in accordance with the position of the Buddhist Tribunal, the Argentine judge Alejandra Mauricio has ruled that the detentions of people violating quarantine is unconstitutional, since the deprivation of liberty is an attack against human rights guaranteed by the National Constitution and the International Treaties. At the same time, this Argentine judge has confirmed the Buddhist Tribunal’s thesis that in Argentina the course of the rule of law has been lost, which happened under the auspices of the WHO.

Legal Warning to Zen Master Thich Nhat Hanh

On October 20, 2020, a Legal Warning is made to Zen Master Thich Nhat Hanh due to the sad news that this great spiritual leader has become a Patron of the International Buddhist Confederation (IBC). Since Master Hanh was a beacon of peace in the world for decades, it is the duty of the Buddhist Tribunal on Human Rights to advise him that he is spiritually supporting an unethical, corrupt and genocidal organization that provides shelter and impunity to sexual abusers and murderers, destroying all the spiritual legitimacy that Buddhism accumulated over 2,600 years.

First, the International Buddhist Confederation (IBC) was sentenced Responsible for Violation of International Buddhist Law and Violation of International Human Rights Law, Complicity with Violations of women’s rights, and Complicity with Genocide and Crimes against humanity. This judgment is due to the fact that the IBC has failed to comply with all the ethical resolutions and legal requirements of the Buddhist Tribunal regarding the expulsion of senior IBC executives who were engaging in criminal conduct, such as sexual abuse and even complicity with genocidal acts, which is why this organization decided to ignore the duty to behave righteously in the world and preferred to continue harboring criminals, who surely provided a lot of money to the organization.

Second, the International Buddhist Confederation (IBC) was found Responsible for Corruption and Unethical Leadership, because the IBC has been funded for years by the Government of India and not through economic funds that come from ethical activities. The Buddhist Tribunal on Human Rights has sentenced the Indian Army as Responsible for Crimes against Humanity, Genocide, Crimes against Peace, Ethnic Cleansing, Violation of women’s rights, Violation of Constitutional Law, Violation of International Human Rights Law, Violation of International Humanitarian Law, State Terrorism, Crimes against Democracy, Violation of Buddhist Law, Crimes against the Buddhist Nation and High Crimes against Dharma. For this reason, any Buddhist Community that is solved with funds from the Hindu government will be using dirty money that comes from criminal activities, all of which is prohibited by the Buddhist Law.

Third, the International Buddhist Confederation (IBC) has a Spiritual Patron who has received money from the US government for decades, even using that money to support military activities, which constitutes an unprecedented act of Corruption and a clear Violation of Buddhist Law.

Fourth, the International Buddhist Confederation (IBC) has a Spiritual Patron named Bhaddanta Kumarabhivamsa (Chairman of the State Sangha Maha Nayaka Committee of the government of Myanmar) who has been sentenced as Responsible for False Buddhism and Violation of the Buddhist Legal Code, Oppression and Illegal Detentions against the Buddhist Sangha, Complicity with Discrimination, Violation of the rights of women and children, Violation of freedom of expression, Violation of the rights of indigenous and tribal peoples, Crimes against humanity and peace, Complicity with the Genocide and Ethnic Cleansing, Violation of International Human Rights Law, Violation of International Buddhist Law, Complicity with Violations of International Humanitarian Law and War Crimes, Violations of Civil and Political Rights, Violations of Economic Social and Cultural Rights, Attack Against Democracy, Complicity with Extermination and State Terrorism, and Supreme Offense against International Morality and the Sanctity of life.

Fifth, during the crisis of the Rohingya People in 2017 thousands of Buddhist leaders from all traditions (among whom are dozens of disciples of Master Thich Nhat Hanh) have signed a public letter against the State Sangha Maha Nayaka Committee (member body of the genocidal government of Myanmar), denouncing the complicity of this organization with the crimes carried out by Myanmar against the Rohingya People,[1] so it represents an absolute immorality that Master Thich Nhat Hanh is spiritually endorsing the IBC and sharing the position of Patron together with the genocidal Bhaddanta Kumarabhivamsa (President of the State Sangha Maha Nayaka Committee).

Sixth, Ashin Wirathu was sentenced as Responsible for Discrimination, Social Segregation, Apology for Violence, False Buddhism, Violation of Buddhist Law and Human Rights, Complicity with Genocide, Ethnic Cleansing, and Crimes against Humanity. However, Bhaddanta Kumarabhivamsa (Chairman of the State Sangha Maha Nayaka Committee and IBC Patron) has for many years given total impunity to the false Bhikkhu Ashin Wirathu, allowing him to be a Buddhist monk despite the fact that he is actually a genocidal military man in disguise who has consistently devoted itself to destroying the spiritual image of Buddhism in the world.

Seventh, Lama Lobzang (President of the IBC) has been sentenced as Responsible for Violation of Buddhist Law for covering up the genocidal Bhaddanta Kumarabhivamsa and refusing to expel him.

In eighth place, Sogyal Rinpoche of the Rigpa Cult was sentenced Responsible for Torture and Slavery, Fraud and Organized Crime, Violation of Women’s Rights, Violation of Buddhist Law, and Crimes Against Humanity. However, the IBC kept him as a member and refused to expel him.

In ninth place, Dzongsar Khyentse Rinpoche (IBC Board member) was sentenced Responsible for Violation of Buddhist Law and Complicity with Crimes Against Humanity. However, the IBC kept him as a member and refused to expel him.

In tenth place, Dhamachari Lokamitra (IBC Board member and leader of the Nagarjuna Training Institute) was sentenced Responsible for Corruption, Fraud and Misappropriation, Illicit Association or Organized Crime, Defamation and Violation of Buddhist Ethics. However, the IBC kept him as a member and refused to expel him.

In eleventh place, Dalai Lama Tenzin Gyatso (IBC Patron) has refused to attempt to expel criminals Bhaddanta Kumarabhivamsa, Lama Lobzang, Sogyal Rinpoche and Dzongsar Khyentse Rinpoche as members of the IBC, in addition to also not resigning as Patron despite the fact that the IBC has been condemned of serious violations of Buddhist Ethics and Human Rights.

Twelfth, the Dalai Lama Tenzin Gyatso (Patron of the IBC) has refused to intervene in Tibetan Buddhism to sanction Lama Ole Nydahl despite the fact that this individual was sentenced Responsible for Discrimination, False Buddhism and False Spirituality, Violation of Buddhist ethical precepts, Political Persecution and Attack on the Human Right to Freedom of Expression.

In thirteenth place, the Dalai Lama Tenzin Gyatso (Patron of the IBC) has refused to return the US Congressional Gold Medal he received from President Bush, despite the fact that this government was sentenced responsible for war crimes by the Kuala Lumpur War Crimes Tribunal.

In the fourteenth place, the Dalai Lama Tenzin Gyatso (Patron of the IBC) has refused to provide evidence on international violations and crimes committed against the Tibetan People, which represents an absolute breach of his duty as protector of the Tibetan Buddhist Nation, thus allowing that the crimes suffered go unpunished and are not investigated or tried.

The Buddhist Tribunal on Human Rights confirms that Zen Master Thich Nhat Hanh still has time to follow the Righteous Path and resign from this position of Patron that he is occupying within a criminal organization that violates Buddhist Ethics. The fact that this great Zen Master decides to support the IBC despite all the violations of Buddhist Law that this organization carries out represents the destruction of his 94 years in the service of the Dharma, being the worst way to spend his last moments in the world. Indeed, great sages must practice active contemplation, compassionate wisdom and humanitarian ethics until the last second of their lives, reason why being an elder is not any kind of reason to violate the mission of Buddhist Law and betray the Dharma. In fact, the IBC is using the figure of Master Thich Nhat Hanh solely to spiritually validate itself in the face of the ethical judgments that this immoral organization has received. For this reason, it is requested Zen Master Thich Nhat Hanh to follow the teachings of all the Awakened Beings (Buddhas), requesting him to do good, get away from evil and purify himself spiritually, and requesting him to resigning from the position of Patron of the IBC in the next 5 days. In case of breaching this legal ethical requirement from the International Buddhist Law, this will have terrible karmic consequences.

Legal Act on Corruption and Unethical Leadership of the IBC

On October 19, 2020, it is recorded that Secretary General Ven. Dhammapiya of the IBC runs an unethical organization because he has chosen to systematically ignore the active participation of Bhaddanta Kumarabhivamsa (Patron of the IBC) in the Rohingya Genocide. The IBC has carried out this complicit silence with the Genocide and Crimes against Humanity for 5 years, systematically ignoring all the ethical judgments issued by International Buddhist Law.

Even the IBC has given impunity to another member who has carried out systematic sexual abuse, as was the Case with Sogyal Rinpoche, therefore, Ven. Dhammapiya and the IBC are accomplice in violations of women’s rights.

At the same time, there is public evidence that the IBC is financed by the State of India through the Ministry of Culture, which shows that this organization is totally corrupted by politics. In this way, the economic funds that control the IBC do not come from Buddhists, but rather from a genocidal Hindu regime that seeks to control Buddhism or buy its silence. This ethical conclusion is due to the fact that the Indian Army has been sentenced by the Buddhist Tribunal on Human Rights as Responsible for committing Crimes against Humanity, Genocide, Crimes against Peace, Ethnic Cleansing, Violation of women’s rights, Violation of Constitutional Law, Violation of International Human Rights Law, Violation of International Humanitarian Law, State Terrorism, Crimes against Democracy, Violation of Buddhist Law, Crimes against the Buddhist Nation and High Crimes against Dharma. In this sense, the money underlying the IBC is stained with genocidal blood.

On the other hand, the Buddhist Tribunal on Human Rights also has evidence that another IBC Patron has received government funding from the US government for decades. The evidence even suggests that this IBC Patron used such government funds in order to undertake military activities. This enormously compromises his integrity as it implies that his silence in the face of international crimes has been bought, being probably the greatest act of Corruption in the history of Buddhism.

Although the IBC was previously sentenced for Violation of International Buddhist Law and Violation of International Human Rights Law, for all the previous points it is concluded that the IBC has greatly aggravated its behavior, being Responsible for Corruption, Unethical Leadership, Complicity with Violations of women’s rights, and Complicity with Genocide and Crimes against humanity.

In conclusion, the Maitriyana will never allow the rich and powerful to destroy the spiritual integrity of Buddhism, that is why those who are corrupt and accomplices of murderers will always be denounced.

ETHICAL JUDGMENT

Dear Prosecutor, Ambassador and Human Rights Defenders of the International Buddhist Ethics Committee & Buddhist Tribunal on Human Rights, regarding Case 55-2020 on “Buddhist Pali Education and Research Trust”, on October 9 of 2020, it is hereby recorded that the trial to analyze the violation of Buddhist Ethics carried out by the accused has been concluded. This Case has been carried out as a consequence of the bad behavior of Ravi Bevinagidad (Pabbajjoravitipalivijjamuniyo), individual representative of “Buddhist Pali Education and Research Trust” which is an institutional member of the United Buddhist Nations Organization.

After the analysis of the presentation of the Case and the validation of evidence, the voting of four Jury members has taken place, confirming that all of them have affirmed that the accusation for the serious crime of Misbehavior against the Dharma by the “Buddhist Pali Education and Research Trust & Ravi Bevinagidad” is “Just”.

The International Buddhist Ethics Committee has been able to verify that “Buddhist Pali Education and Research Trust & Ravi Bevinagidad” have violated the Buddhist Ethics by expressing insane and insulting comments against the Buddhist Dharma. This illegal action was carried out as a result of a clear psychotic outbreak of the accused. Furthermore, during the Ethical Trial, the accused presented as his Defense an attack on the Maha Sangha of the UBNO, claiming that it is not composed of true Buddhists because it uses Sanskrit words. This not only shows an absolute irrationality on the part of the accused, but also a clear act of Language Discrimination.

Obviously speaking in Pali, Sanskrit, Tibetan, Chinese, Japanese or Vietnamese does not make someone a Buddhist person. It is confirmed that Being a Buddhist is to follow the path of Enlightened Life through the Union with Truth (Dharma).

The International Buddhist Ethics Committee has the Purpose (Dharma) to protect the integrity of the International Spiritual Commune (Maha-Sangha), developing an advanced ethics that teaches to behave according to the highest spiritual standards, both for individuals and for Buddhist institutions. Thus, the Maitriyana movement will never endorse the fact that a Buddhist institution violates the integrity of the Dharma or performs discriminatory acts. The International Buddhist Ethics Committee oversees that the members of the World Sangha do not violate ethics, human rights and Buddhist teachings, reason why the “Buddhist Pali Education and Research Trust & Ravi Bevinagidad” has been sentenced as Responsible for Discrimination and Misconduct against the Dharma. Therefore, its expulsion as an institutional member of the United Buddhist Nations Organization and the World Association of Theravada is immediately ordered.

The Great Barrington Declaration

As infectious disease epidemiologists and public health scientists we have grave concerns about the damaging physical and mental health impacts of the prevailing COVID-19 policies, and recommend an approach we call Focused Protection. 

Coming from both the left and right, and around the world, we have devoted our careers to protecting people. Current lockdown policies are producing devastating effects on short and long-term public health. The results (to name a few) include lower childhood vaccination rates, worsening cardiovascular disease outcomes, fewer cancer screenings and deteriorating mental health – leading to greater excess mortality in years to come, with the working class and younger members of society carrying the heaviest burden. Keeping students out of school is a grave injustice. 

Keeping these measures in place until a vaccine is available will cause irreparable damage, with the underprivileged disproportionately harmed.

Fortunately, our understanding of the virus is growing. We know that vulnerability to death from COVID-19 is more than a thousand-fold higher in the old and infirm than the young. Indeed, for children, COVID-19 is less dangerous than many other harms, including influenza. 

As immunity builds in the population, the risk of infection to all – including the vulnerable – falls. We know that all populations will eventually reach herd immunity – i.e.  the point at which the rate of new infections is stable – and that this can be assisted by (but is not dependent upon) a vaccine. Our goal should therefore be to minimize mortality and social harm until we reach herd immunity. 

The most compassionate approach that balances the risks and benefits of reaching herd immunity, is to allow those who are at minimal risk of death to live their lives normally to build up immunity to the virus through natural infection, while better protecting those who are at highest risk. We call this Focused Protection. 

Adopting measures to protect the vulnerable should be the central aim of public health responses to COVID-19. By way of example, nursing homes should use staff with acquired immunity and perform frequent PCR testing of other staff and all visitors. Staff rotation should be minimized. Retired people living at home should have groceries and other essentials delivered to their home. When possible, they should meet family members outside rather than inside. A comprehensive and detailed list of measures, including approaches to multi-generational households, can be implemented, and is well within the scope and capability of public health professionals. 

Those who are not vulnerable should immediately be allowed to resume life as normal. Simple hygiene measures, such as hand washing and staying home when sick should be practiced by everyone to reduce the herd immunity threshold. Schools and universities should be open for in-person teaching. Extracurricular activities, such as sports, should be resumed. Young low-risk adults should work normally, rather than from home. Restaurants and other businesses should open. Arts, music, sport and other cultural activities should resume. People who are more at risk may participate if they wish, while society as a whole enjoys the protection conferred upon the vulnerable by those who have built up herd immunity.
