Judgment on Yoga Beer

 

Case 23-2017: Yoga Beer

 

ETHICAL JUDGEMENT

Dear Prosecutor, Public Defender, Ambassador and Jury Members of the International Buddhist Ethics Committee (IBEC) and Buddhist Tribunal on Human Rights (BTHR), regarding the case 23-2017 Yoga Beer, hereby, on March 2017, it is recorded that the trial of the Ethics Committee has been concluded to analyze the violation of Buddhist Spirituality carried out by the accused party, after voting of 6 members of the Jury, 1 of them issuing the vote of “Insanity” and the other 5 issuing the verdict of “Responsible” for the crimes of SPIRITUAL FRAUD and INTERNATIONAL CRIME AGAINST CULTURAL HERITAGE OF HUMANITY.

The actions of the Yoga Beer movement have broken the Buddhist ethical precepts and the essential spiritual guidelines of True Yoga, by introducing the consumption of a drug into a sacred millennial practice. In addition, as has been demonstrated during the trial, alcohol consumption causes serious damage to physical and mental health, often leading to disease and even death. This has shown that the Yoga Beer movement violates the spiritual ethical precepts of Buddhism and True Yoga because it is basically a Fraud or a Scam jeopardizing bodily well-being, mental health and spiritual integrity. However, the fact that Yoga Beer damages mental health does not necessarily imply that the accused party is “Insane”, which would make it to go unpunished and irresponsible facing the charges. In this sense, as has happened with the Cases Ocampo and Spencer, previously judged by the International Buddhist Ethics Committee, this kind of  SPIRITUAL FRAUD is not associated with the psychic structure of Psychosis but rather with that of Perversion, by developing a False system of Yoga that reduces a sacred practice to a mere amusement or consumer good. This mechanism of desecration, which had previously happened in the West by reducing Yoga to a mere gymnastics or sport, in Yoga Beer movement is also accompanied by a mechanism of perversion, which consists in corrupting, depraving, vitiating, contaminating and vilifying the very essence of Yoga.

On the other hand, this case presents the peculiarity that Yoga has recently been declared by UNESCO as Cultural Heritage of Humanity, so that the perversion made by the Yoga Beer movement is undoubtedly a violation of Cultural Human Rights. Faced with this manipulation or attempting to destroy a spiritual cultural heritage, the International Buddhist Ethics Committee has decided to respond immediately with all the resources of Buddhist Law and International Law, sending the message to the world that spiritual disciplines must be purified of all kinds of perversion, distortion or contamination.

Although it could be argued that Yoga is not under the jurisdiction of Buddhism, this is not true, since both traditions are deeply interrelated. Beyond the fact that Master Gautama trained with the main yogic gurus of his time, having learned the best of their ascetic techniques in the study of the jhanas, certainly the Buddhist Ethics of the five precepts has profoundly influenced True Yoga. Therefore, while Buddhism prescribes not to harm living beings, not to steal, not lying, not to sexually abuse and not to take drugs, True Yoga in turn prescribes not to be violent, saying the Truth, not to steal, to moderate impulses and not to covet. In addition, the Sage Patanjali, who in the third century B.C. laid the foundation of contemporary Yoga, was clearly and profoundly influenced by the Noble Eightfold Path created by Gautama. The Gautama’s Noble Eightfold Path is an ethical pathway that rectifies the inner and outer world of the human being by means of eight main factors of Righteousness which are simultaneous and non-hierarchical virtues: righteous understanding (samyak drsti), righteous thinking (samyak samkalpa) , righteous speech (samyak vaca), righteous conduct (samyak karmanta), righteous means of subsistence (samyak ajiva), righteous effort (samyak vyayama), righteous attention (samyak samriti) and righteous concentration (samyak samadhi). Accordingly, the Sage Patanjali also developed an Eightfold Path in Yoga composed of: Yama (moral control), Niyama (self control), Asana (posture control), Pranayama (vital control), Pratyahara (control of perception), Dharana (control of thought), Dhyana (meditation) and Samadhi (concentration). Both in Gautama and in Patanjali, the two Eightfold Paths lead to Awakening or Liberation. This demonstrates that the Sage Patanjali was deeply influenced by the Noble Eightfold Path of Master Gautama, so according to this analysis the tradition of True Yoga would undoubtedly have a Buddhist foundation, entering absolutely within the jurisdiction of the Spiritual Commune (Sangha), in the same way as during the framework of “Case 16-2016 Iran” the International Buddhist Ethics Committee has recognized the Bahai tradition.

In the Mahaparinibbanasutta there is an ancient spiritual story that would revalidate this revolutionary analysis carried out by the International Buddhist Ethics Committee. The story tells that the ascetic wanderer Subhadda was the last apprentice of Master Gautama, who few hours before dying taught that if in a Spirituality there is no Noble Eightfold Path then there will not be Free and Enlightened Beings, yet if in a Spirituality there is Noble Eightfold Path then there will be Free and Enlightened Beings. Therefore, this compassionate wisdom in action allows the Spiritual Commune (Sangha) to decipher the supposed ethical legitimacy of any tradition or the supposed enlightenment of any spiritual master, simply by analyzing whether there is the presence of the Noble Eightfold Path in his/her teachings.

According to the International Buddhist Ethics Committee, all Yoga teachers in the world should study and follow the Yoga Sutras of Patanjali, as this would prevent Yoga from being reduced to mere sport or to be perverted as a form of entertainment, having the duty to prevent damaging the sacredness of this Cultural Heritage of humanity. Even the International Buddhist Ethics Committee prescribes that Buddhists could also learn something from these Sutras, for it is always nourishing to learn the visions of different spiritual masters on the basis of the same perennial ethical foundation. In the Dhammapada, Master Gautama endorses this integrative and reconciling position by affirming that the teaching of all the Awakened Ones (Buddhas) is to abandon evil, do good and purify the mind. This implies that if that essential foundation to abandon evil, do good and purify mind would be taught and practiced by Yoga, then Yoga would definitely follow the Buddhist Path, which is not only the pathway of those who follow Gautama but rather is the Pathway of the followers of all the Awakened Ones (Buddhas) of history.

Buddhism and True Yoga point to the Evanescence of the Ego, sublimating the passions and understanding the illusoriness of the object of Desire. This death of selfish and mundane life is the rebirth of detached and spiritual life in the here and now. In the practices of Buddhism and True Yoga the individual can understand that health is both internal and external, fostering an attitude based on the ethical principles of non-violence (ahimsa), veracity (satya), non-steal (asteya), Sublimation (brahmacharya) and non-greed (aparigraha). In transcending Ego, the mind is freed from the chains of pathological and self-contradictory life, adopting an attitude of serenity toward the whole existence, which allows responding to adversities by means of benevolence and friendship, never clinging to the past and without longing for the future. Buddhism and True Yoga seek the liberation of suffering caused by the evils of attachment, aversion and unconsciousness, by practicing at all times and places a lifestyle based on purity (saucha), humility (santosha), self-discipline (tapas), self-knowledge (svadhyaya) and self-surrender to a higher Purpose (Ishvara-pranidha). Buddhism and True Yoga resort to physical postures and breathing exercises designed to reach the Awakening of consciousness, going much deeper into this aspect as a source of physical health and psychical self-regulation. Buddhism and True Yoga teach complex methods of concentration and meditation, showing the apprentices how to pay full attention (Mindfulness) to their existence, which produces not only a therapeutic effect on the body and mind but also a free and enlightened state of consciousness, since the apprentice can be fully united with his Supreme Purpose (Dharma). Buddhism and True Yoga are lifestyles that make it possible to achieve Health or Cure of suffering, so they have no relation to religious beliefs, but with a thousand-year-old set of spiritual experiences. Buddhism and True Yoga are not ascetical or ritualistic practices, but are a system of daily life open to all human beings, without any discrimination of color, gender, language, economic status, social class, age, political opinion, ethnicity, nationality or any other condition. Buddhism and True Yoga teach the human being to evolve and become a superhuman through the development of Ethics, Health and Awakening.

However, besides the fact of considering concentration (samadhi) as a daily practice and not considering it as a final goal, there is a feature that turns Buddhism into a Supreme Spirituality without any comparison with Yoga, and is precisely the indispensable function of the Spiritual Commune (Sangha), without which Buddhism could be reduced to a philosophy or a psychology. The Spiritual Commune (Sangha) created by Gautama was born as a tribal republic and centuries later it spread throughout Southeast Asia in the form of a Civilization. These social characteristics of Buddhism are based on Buddhist Law, not being a coincidence the fact that Master Gautama very much appreciated his Legal Code (Vinaya). This is because, as Gautama taught, communities pervert themselves and disappear when they do not follow advanced ethical precepts, abandoning the guidance of solidarity and compassionate wisdom (karuna-prajna). In this sense, the International Buddhist Ethics Committee continues with the universal ethical development founded by Gautama, this rectifying function being something indispensable for the discipline of Yoga, since this tradition lacks the righteous guidance of the Legal Code (Vinaya) of the Spiritual Commune (Sangha).

Finally, the wrong ethical behavior of Yoga Beer is part of an international context of superficialization and banalization of the spiritual traditions, which are being manipulated, distorted and perverted by unscrupulous individuals and groups. Yoga Beer is an immoral, perverse and illegal aberration, as if someone trying to create “Buddhism with Marihuana”. As an organization dedicated to ethical and humanitarian teaching, the International Buddhist Ethics Committee offers free advanced training in True Yoga to any subject or group that forms part of the Yoga Beer movement who decides to renounce this perverse and illegal practice.

Following the Path of Master Siddharta Gautama, who has influenced multiple spiritual traditions through his incorruptible Ethic, it is established that the Yoga Beer movement has violated the Buddhist Ethics and Human Rights, having been ruled its “Responsibility” for the charges of SPIRITUAL FRAUDE and INTERNATIONAL CRIME AGAINST CULTURAL HERITAGE OF HUMANITY. The International Buddhist Ethics Committee has the duty to protect Spirituality and the entire humanity, establishing this Judgment as a mode of ethical teaching for the accused.

HONORABLE JURY OF INTERNATIONAL BUDDHIST ETHICS COMMITTEE (IBEC) & BUDDHIST TRIBUNAL ON HUMAN RIGHTS (BTHR)

After Legitimating and Validating Evidences and Charges by Master Maitreya, President and Spiritual Judge of IBEC-BTHR, it is addressed the case against the accused party “Yoga Beer”. This investigation was initiated by the World Association of Buddhism.

The Charges by which the International Buddhist Ethics Committee is accusing Yoga Beerare enumerated below:

  • SPIRITUAL FRAUD
  • INTERNATIONAL CRIMES AGAINST CULTURAL HERITAGE OF HUMANITY

Therefore, it is detailed a series of EVIDENCES that support the Charges referred so that the Jury members decide about the possible “Responsibility”, “Innocence” or “Insanity” of the accused. Such evidence come from graphic and audiovisual media that have been gathered, sorted and confirmed in their order and context as Means of Proof in order to know, establish, dictate and determine the Responsibility of the Accused for committing the aforementioned Charges.

The procedure established in the Statute of INTERNATIONAL BUDDHIST ETHICS  COMMITTEE & BUDDHIST TRIBUNAL ON HUMAN RIGHTS provides both bodies the ostentation to enjoy independence and liberty from state and national regulation and control, besides having the legality and acting as a Buddhist People in order to assert its customs, traditions, practices, procedures, judgments and rights as well as acting in pursuit of the development of Spirituality, of Buddhist Ethics, and of the defense of International Human Rights. This procedure has the particularity, singularity and distinction of having “Special Jurisdiction of the Tribal Law” and “Universal Jurisdiction of the International Law”, thus having the Character, Juridical validity, Legal Powers, infrastructure, Training and Capability necessary to be Actor, Administrator and Executor of Justice in this realm and exercise, by judging of the Accused by means of an Ethical Judgment whose Purpose is Truth, Reconciliation and Learning.-

 

 

DETAILS OF EVIDENCES

Evidence 1: VIOLATION OF SPIRITUAL ETHICAL PRECEPTS

Ven. S. Dhammika (´Good question, good answer´): “The Five Precepts are the basis of Buddhist morality. The first precept is to avoid killing or harming living beings. The second is to avoid stealing, the third is to avoid sexual misconduct, the fourth is to avoid lying and the fifth is to avoid alcohol and other intoxicating drugs. (…) People don’t drink for the taste. When they drink alone it is in order to seek release from tension and when they drink socially, it is usually to conform. Even a small amount of alcohol distorts consciousness and disrupts self-awareness. Taken in large quantities, its effect can be devastating.”

 

Evidence 2: FALSE YOGA

For beer lovers who like yoga. For yogis who like beer. For everybody else who is curious and over 16”[1]

Beth Cosi: “I was teaching yoga classes at a popular local studio and working part-time at a pizza and craft beer place in Park Circle (EVO). I have a long personal history of working in food & beverage. (…) It started as classes for my friends and Holy City Brewery employees. After class we’d have a tasting of what the brewery was offering and talk about the postures we did, our families, the beer. (…) I asked Chris if we could open it up to the public and include a beer tasting in the price. I called it Bendy Brewski: Yoga for Beer Lovers.  The brewery is a perfect place for yoga! It’s open, its design is industrial and clean, but with a natural warmth about it (something to do with the smell of hops, I’m sure!), and they have beer! (…) I get a lot of men in the room. (…) The floors are concrete, they’re usually a bit dirty, it can be loud from the glycol chiller. It’s garage-band yoga. Our teachers are well trained and enthusiastic, typically funny and free-spirited! (…) As Bendy Brewski has grown in student size and number of breweries, the yoga has adapted and will continue to change. (…) Craft Beer and Yoga; they are both art forms that have been around for centuries. They both are an ancient practice, involving trial-and-error and precision, patience, practice, pureness and hard work. Both are very sensory and come from honored traditions that link families and cultures and nations. I have found that bringing Craft Beer Lovers and Yoga Lovers together is like linking tribes. Good beer enjoyed after a satisfying yoga class amongst like-minded people is a delightful and rewarding experience for everyone. It just feels and tastes good!”[2]

Association for Yoga and Meditation India:Beer or alcohol both are not accepted in yoga world as alcohol will not let the person work on developing consciousness and brain. And yoga is about expanding one’s  consciousness which is impossible while drinking beer or wine.

 

Evidence 3: DAMAGES TO PHYSICAL HEALTH

Dr. Ingo Froboese (Escuela Sporting alemana de Colonia): “El alcohol nubla la percepción, dificulta el control muscular, afecta el equilibrio y restringe la resistencia” (También añadió que el alcohol podría restringir la fase de recuperación de las personas, y que deberían atenerse al agua potable durante varias horas luego de una sesión de ejercicio)[3]

New Health Guide: “Side Effects of Beer. 1. Fill You with Empty Calories (…) 2. Low Blood Sugar Leads to Weight Gain (…) 3. Loss of Fluid Causes Dehydration (…) 4. Affect Those with Celiac Disease (…) 5. Lead to Accidents (…) Increase Blood Pressure and Acid Reflux (…) 7. Create False Strength (…) 8. Lead to Next Day Illness”[4]

TRACII HANES: “Athletic Performance. Like other tasks requiring coordination and cognitive precision, the ability to exercise or play sports may be negatively affected by alcohol. According to Sports Doctor, alcohol impairs reaction time, balance and hand-eye coordination, all of which you require for optimal athletic performance. In addition, alcohol acts as a diuretic by speeding the loss of fluids and electrolytes that your body needs for proper hydration. By increasing the production of lactic acid, alcohol can worsen fatigue when exercising. Other effects include dilation of blood vessels, increased sweating and dehydration. Weight Gain. Like soda, alcohol contains calories that can contribute to weight gain. Drinking more than two alcoholic beverages per day may lead to increased belly fat. While the condition is often referred to as a beer belly, any alcoholic beverage can cause weight gain if you consume them in excess. (…) Reduced Muscle Growth. Protein synthesis is vital for muscle development and maintenance. Because alcohol impairs this process, drinking can interfere with your ability to grow and maintain muscle. Binge drinking also causes a drop in testosterone levels while increasing cortisol, a hormone that destroys muscle. To prevent muscle loss, avoid drinking alcohol shortly before or after hitting the gym. Choose hydrating drinks like water or sports drinks instead of alcoholic beverages, and monitor your overall alcohol intake.”[5]

Kymberly Fergusson: “Heavy drinkers are at risk of developing a number of forms of cancer, especially liver and colorectal cancers.[6] In fact, various cancer bodies around the world have categorized alcohol as a known carcinogen. Excessive alcohol intake has been linked to the following illnesses: skin disorders including hives, psoriasis and rosácea; gout, leading to arthritis; stomach inflammation; osteoporosis; diabetes and pancreatitis (….) Even a small amount will slow down signal processing from the nervous system. Short term visual memory, depth perception and learning capabilities are all impaired with a few drinks.[7]  A moderate intake was shown to decrease verbal ability in elderly subjects.[8]  Adolescent drinkers can more easily damage their brain function and learning capabilities, because their brains are still developing. Alcohol upsets their hormonal balance, and stops the healthy development of organs, including their reproductive system.  Over time, drinking heavily damages short and long term memory functions. Drinkers are unable to recall their intentions and plans, and have trouble learning.  Heavy drinkers are also more likely to suffer from insomnia and depression. The risk of strokes is increased, and eventually, alcohol withdrawal seizures and tremors may develop.  Unfortunately, this damage is not reversible.”[9]

 

Evidence 4: DAMAGES TO MENTAL HEALTH

Drinkaware: “While alcohol can have a very temporary positive impact on our mood, in the long term it can cause big problems for our mental health. It’s linked to a range of issues from depression and memory loss to suicide. Alcohol alters your brain chemistry. Our brains rely on a delicate balance of chemicals and processes. Alcohol is a depressant, which means it can disrupt that balance, affecting our thoughts, feelings and actions – and sometimes our long-term mental health. This is partly down to ‘neurotransmitters’, chemicals that help to transmit signals from one nerve (or neuron) in the brain to another. The relaxed feeling you can get when you have that first drink is due to the chemical changes alcohol has caused in your brain. For many of us, a drink can help us feel more confident and less anxious. That’s because it’s starting to depress the part of the brain we associate with inhibition. But, as you drink more, more of the brain starts to be affected. It doesn’t matter what mood you’re in to start with, when high levels of alcohol are involved, instead of pleasurable effects increasing, it’s possible that a negative emotional response will take over. Alcohol can be linked to aggression you could become angry, aggressive, anxious or depressed. Alcohol can actually increase anxiety and stress rather than reduce it. Unfortunately reaching for a drink won’t always have the effect you’re after. While a glass of wine after a hard day might help you relax, in the long run it can contribute to feelings of depression and anxiety and make stress harder to deal with. This is because regular, heavy drinking interferes with neurotransmitters in our brains that are needed for good mental health. When we drink, we narrow our perception of a situation and don’t always respond to all the cues around us. If we’re prone to anxiety and notice something that could be interpreted as threatening in the environment, we’ll hone in on that and miss the other less threatening or neutral information.  For example, we might focus on our partner talking to someone we’re jealous of, rather than notice all the other people they’ve been chatting to that evening. Alcohol depression = a vicious cycle. If you drink heavily and regularly you’re likely to develop some symptoms of depression. It’s that good old brain chemistry at work again. Regular drinking lowers the levels of serotonin in your brain – a chemical that helps to regulate your mood. In Britain, people who experience anxiety or depression are twice as likely to be heavy or problem drinkers. For some people, the anxiety or depression came first and they’ve reached for alcohol to try to relieve it. For others, drinking came first, so it may be a root cause of their anxieties.  Drinking heavily can also affect your relationships with your partner, family and friends. It can impact on your performance at work. These issues can also contribute to depression. If you use drink to try and improve your mood or mask your depression, you may be starting a vicious cycle… Warning signs that alcohol is affecting your mood include: Poor sleep after drinking; Feeling tired because of a hangover; Low mood; Experiencing anxiety in situations where you would normally feel comfortable. Four ways to help prevent alcohol affecting your mood: Use exercise and relaxation to tackle stress instead of alcohol; Learn breathing techniques to try when you feel anxious; Talk to someone about your worries. Don’t try and mask them with alcohol; Always be aware of why you’re drinking. Don’t assume it will make a bad feeling go away, it’s more likely to exaggerate it. Alcohol is linked to suicide, self-harm and psychosis. Alcohol can make people lose their inhibitions and behave impulsively, so it can lead to actions they might not otherwise have taken – including self-harm and suicide. According to the NHS in Scotland, more than half of people who ended up in hospital because they’d deliberately injured themselves said they’ve drunk alcohol immediately before or while doing it.  27% of men and 19% of women gave alcohol as the reason for self-harming 4.  Did you know? Anxiety and depression are more common in heavy drinkers – heavy drinking is more common in those with anxiety and depression. Extreme levels of drinking (such as more than 30 units per day for several weeks) can occasionally cause ‘psychosis’. It’s a severe mental illness where hallucinations and delusions of persecution develop. Psychotic symptoms can also occur when very heavy drinkers suddenly stop drinking and develop a condition known as ‘delirium tremens’ – symptoms include body tremors and confusion. Alcohol can damage your memory. Soon after drinking alcohol, your brain processes slow down and your memory can be impaired. After large quantities of alcohol, the brain can stop recording into the ‘memory store’. That’s why you can wake up the next day with a ‘blank’ about what you said or did and even where you were. This short-term memory failure or ‘black out’ doesn’t mean that brain cells have been damaged, but frequent heavy sessions can damage the brain because of alcohol’s effect on brain chemistry and processes. Drinking heavily over a long period of time can also have long-term effects on memory. Even on days when you don’t drink any alcohol, recalling what you did yesterday, or even where you have been earlier that day, become difficult.”[10]

Mental Health Foundation: “Drinking lowers inhibition. Typically, excessive alcohol consumption means fewer personal constraints are in place. Additionally, alcohol can disrupt our body’s ability to rest, resulting in our body needing to work harder to break down the alcohol in our system. This interference of alcohol with sleep patterns can lead to reduced energy levels. Alcohol also depresses the central nervous system, and this can make our moods fluctuate. It can also help ‘numb’ our emotions, so we can avoid difficult issues in our lives. Alcohol can also reveal or intensify our underlying feelings, such as evoking past memories of trauma or sparking any repressed feelings which are associated with painful events of the past. These memories can be so powerful that they create overwhelming anxiety, depression or shame. Re-living these memories and dark feelings whilst under the influence of alcohol can pose a threat to personal safety as well as the safety of others.”[11]

American Addiction Centers: “How Does Alcohol Impacts Cognitive Ability? Occasional and moderate drinkers: Memory impairment; Blackout; Recklessness; Impaired decision-making. Heavy and/or chronic drinkers:
Diminished brain size; Inability to think abstractly; Loss of visuospatial abilities; Wernicke-Korsakoff syndrome; Memory loss; Loss of attention span”[12]

Jesse Viner: “Alcoholism is common among people suffering from mental health conditions. People experiencing anxietydepression, impulsivity, or other diagnosable mental illnesses often turn to alcohol to find temporary solace. (…) Drinking represses the negative emotions that affect the mental well-being of those with diagnosed mental health concerns and those who simply feel emotionally flooded. While it may allow for a short-lived relief from anxiety, depression, or overwhelming feelings, drinking alcohol is not a smart choice in the grand scope of mental well-being. The popular misconception that drinking relieves stress deludes people into thinking that things will feel better after a few drinks. And they might, for an hour or two, as alcohol races through the body, creating a false sense of stimulation. However, as time goes on, and drinking becomes excessive, alcohol raids the central nervous system, shifting the normal processes within the body and brain. People need to be educated about how drinking negatively affects mental health. I’ve spent three decades clinically treating emerging adults with mental health concerns, many having a coexisting dependency on alcohol. I composed a guide, Ten Good Mental Health Reasons Not to Drink, as a way to expose the effects of alcohol on mental well-being. This valuable resource explains the social and emotional consequences of drinking. The first few points describe how alcohol disrupts brain and body functioning. Drinking revamps brain processes such as forming memories and learning new information. It can be difficult to recall the details of events when alcohol is involved. Drinking also agitates the body’s ability to rest. Instead of restoring vital organs and cells during the process of sleep, the body has to work harder than normal to break down alcohol in the system. When alcohol interferes with normal sleep patterns, energy levels sink. Moods fluctuate as a result of drinking, since alcohol directly depresses the central nervous system. Additionally, Ten Good Mental Health Reasons Not to Drink touches on how alcohol gets in the way of good decision-making. While under stress and feeling anxious, people drink to find temporary relief. However, drinking leads to a rebound in anxiety levels, often making matters worse than before. Drinking lowers inhibition. Excess alcohol consumption usually means fewer personal restrictions are set in place. Without self-reservations, people under the influence are more likely to engage in promiscuous behavior, use other substances, or conduct themselves aggressively. Poor decisions made while under the influence usually increase feelings of shame, guilt, or worry. (…) People who take prescribed medications, such as those being treated for anxiety or depression, should avoid alcohol completely. Drinking can be extremely dangerous, even fatal, when combined with prescription drug use.”[13]

U.S. Department of Health & Human Services: “ALCOHOL’S DAMAGING EFFECTS ON THE BRAIN.Difficulty walking, blurred vision, slurred speech, slowed reaction times, impaired memory: Clearly, alcohol affects the brain. Some of these impairments are detectable after only one or two drinks and quickly resolve when drinking stops. On the other hand, a person who drinks heavily over a long period of time may have brain deficits that persist well after he or she achieves sobriety. Exactly how alcohol affects the brain and the likelihood of reversing the impact of heavy drinking on the brain remain hot topics in alcohol research today. We do know that heavy drinking may have extensive and far–reaching effects on the brain, ranging from simple slips in memory to permanent and debilitating conditions that require lifetime custodial care. And even moderate drinking leads to short–term impairment, as shown by extensive research on the impact of drinking on driving. (…) This Alcohol Alert reviews some common disorders associated with alcohol–related brain damage and the people at greatest risk for impairment. (…) BLACKOUTS AND MEMORY LAPSES. Alcohol can produce detectable impairments in memory after only a few drinks and, as the amount of alcohol increases, so does the degree of impairment. Large quantities of alcohol, especially when consumed quickly and on an empty stomach, can produce a blackout, or an interval of time for which the intoxicated person cannot recall key details of events, or even entire events. Blackouts are much more common among social drinkers than previously assumed and should be viewed as a potential consequence of acute intoxication regardless of age or whether the drinker is clinically dependent on alcohol. (…) Women are more vulnerable than men to many of the medical consequences of alcohol use. For example, alcoholic women develop cirrhosis, alcohol–induced damage of the heart muscle (i.e., cardiomyopathy), and nerve damage (i.e., peripheral neuropathy) after fewer years of heavy drinking than do alcoholic men. (…) Studies also showed that both men and women have similar learning and memory problems as a result of heavy drinking. The difference is that alcoholic women reported that they had been drinking excessively for only about half as long as the alcoholic men in these studies. This indicates that women’s brains, like their other organs, are more vulnerable to alcohol–induced damage than men’s. (…) Up to 80 percent of alcoholics, however, have a deficiency in thiamine, and some of these people will go on to develop serious brain disorders such as Wernicke–Korsakoff syndrome (WKS). WKS is a disease that consists of two separate syndromes, a short–lived and severe condition called Wernicke’s encephalopathy and a long–lasting and debilitating condition known as Korsakoff’s psychosis.  The symptoms of Wernicke’s encephalopathy include mental confusion, paralysis of the nerves that move the eyes (i.e., oculomotor disturbances), and difficulty with muscle coordination. For example, patients with Wernicke’s encephalopathy may be too confused to find their way out of a room or may not even be able to walk. Many Wernicke’s encephalopathy patients, however, do not exhibit all three of these signs and symptoms, and clinicians working with alcoholics must be aware that this disorder may be present even if the patient shows only one or two of them. (…) Approximately 80 to 90 percent of alcoholics with Wernicke’s encephalopathy also develop Korsakoff’s psychosis, a chronic and debilitating syndrome characterized by persistent learning and memory problems. Patients with Korsakoff’s psychosis are forgetful and quickly frustrated and have difficulty with walking and coordination. Although these patients have problems remembering old information (i.e., retrograde amnesia), it is their difficulty in laying down new information (i.e., anterograde amnesia) that is the most striking. For example, these patients can discuss in detail an event in their lives, but an hour later might not remember ever having the conversation. (…) Most people realize that heavy, long–term drinking can damage the liver, the organ chiefly responsible for breaking down alcohol into harmless byproducts and clearing it from the body. But people may not be aware that prolonged liver dysfunction, such as liver cirrhosis resulting from excessive alcohol consumption, can harm the brain, leading to a serious and potentially fatal brain disorder known as hepatic encephalopathy. Hepatic encephalopathy can cause changes in sleep patterns, mood, and personality; psychiatric conditions such as anxiety and depression; severe cognitive effects such as shortened attention span; and problems with coordination such as a flapping or shaking of the hands (called asterixis). In the most serious cases, patients may slip into a coma (i.e., hepatic coma), which can be fatal. (…) These studies have confirmed that at least two toxic substances, ammonia and manganese, have a role in the development of hepatic encephalopathy. Alcohol–damaged liver cells allow excess amounts of these harmful byproducts to enter the brain, thus harming brain cells. ALCOHOL AND THE DEVELOPING BRAIN. Drinking during pregnancy can lead to a range of physical, learning, and behavioral effects in the developing brain, the most serious of which is a collection of symptoms known as fetal alcohol syndrome (FAS). Children with FAS may have distinct facial features. FAS infants also are markedly smaller than average. Their brains may have less volume (i.e., microencephaly). And they may have fewer numbers of brain cells (i.e., neurons) or fewer neurons that are able to function correctly, leading to long–term problems in learning and behavior.”[14]

 

Evidence 5: YOGA AS CULTURAL HERITAGE OF HUMANITY

UNESCO: “Yoga. Inscribed in 2016 on the Representative List of the Intangible Cultural Heritage of Humanity. The philosophy behind the ancient Indian practice of yoga has influenced various aspects of how society in India functions, whether it be in relation to areas such as health and medicine or education and the arts. Based on unifying the mind with the body and soul to allow for greater mental, spiritual and physical wellbeing, the values of yoga form a major part of the community’s ethos. Yoga consists of a series of poses, meditation, controlled breathing, word chanting and other techniques designed to help individuals build self-realization, ease any suffering they may be experiencing and allow for a state of liberation. It is practised by the young and old without discriminating against gender, class or religion and has also become popular in other parts of the world. Traditionally, yoga was transmitted using the Guru-Shishya model (master-pupil) with yoga gurus as the main custodians of associated knowledge and skills. Nowadays, yoga ashrams or hermitages provide enthusiasts with additional opportunities to learn about the traditional practice, as well as schools, universities, community centres and social media. Ancient manuscripts and scriptures are also used in the teaching and practice of yoga, and a vast range of modern literature on the subject available.”[15]

 

Evidence 6: VIOLATION OF HUMAN RIGHTS

Karima Bennoune (United Nations Special Rapporteur in the field of cultural rights): (The destruction of cultural heritage is a violation of human rights) “It is impossible to separate a people’s cultural heritage from the people itself and their Rights (…). Clearly, we must now understand that when cultural heritage is under attack, it is also the people and their fundamental human rights that are under attack (…)  In particular we must protect cultural heritage professionals on the frontlines of the struggle against destruction and ensure their safety and security, provide them with the conditions necessary to complete their Work (…). Moreover, we must also pay tribute to ordinary people who step forward to defend cultural heritage, like those in Northern Mali who reportedly hid manuscripts beneath the floorboards of their homes to protect them or those in Libya who tried to peacefully protest destruction of Sufi sites”[16]   “Cultural heritage is significant in the present, both as a message from the past and as a pathway to the future. Viewed from a human rights perspective, it is important not only in itself, but also in relation to its human dimensión (…) The right of access to and enjoyment of cultural heritage is a human right guaranteed by international law, and it must be taken seriously. As stressed by the Human Rights Council in its recent Resolution 33/20(2016) on cultural rights and the protection of cultural heritage, the destruction of or damage to cultural heritage may have a detrimental and irreversible impact on the enjoyment of cultural rights.  In addition, cultural heritage is a fundamental resource for other human rights, including the rights to freedom of expression, freedom of thought, conscience and religion, as well as the economic rights of the many people who earn a living through tourism related to such heritage. It is crucial to understand that tangible and intangible heritage are closely interlinked and that attacks on one are usually accompanied by assaults on the other. In addition, while specific aspects of heritage may have particular connections to particular human groups, all of humanity has a link to such objects, which represent the cultural heritage of all humankind, in all its diversity. This is reflected in UNESCO’s Culture Conventions and standard setting instruments aimed at protecting cultural diversity and heritage. In the UNESCO Declaration concerning the Intentional Destruction of Cultural Heritage adopted in 2003, the international community reaffirms its commitment to fight against the intentional destruction of cultural heritage in any form so that it may be transmitted to the succeeding generations. Intentional destruction is defined as an act intended to destroy in whole or in part cultural heritage, thus compromising its integrity, in a manner which constitutes a violation of international law or an unjustifiable offence to the principles of humanity and dictates of public conscience. (…) Importantly, individual criminal responsibility arises from serious offences against cultural heritage. I welcomed the decision of the Office of the Prosecutor of the International Criminal Court to charge the destruction of cultural and religious sites as a stand-alone war crime for the first time in the case of Ahmad Al Faqi Al Mahdi, which has recently resulted in a guilty verdict. (…) As stressed in the preamble of the 2003 UNESCO Declaration cultural heritage is an important component of cultural identity and of social cohesion, so that its intentional destruction may have adverse consequences on human dignity and human rights. Acts of deliberate destruction are often accompanied by other grave assaults on human dignity and human rights. They have to be addressed in the context of holistic strategies for the promotion of human rights and peacebuilding. (…) We must care about the destruction of heritage in conjunction with our grave concern for the destruction of the lives of populations.  Acts of intentional destruction harm all, and often disproportionately affect persons belonging to minorities. They contribute to intolerance, and deprive all humanity of the rich diversity of cultural heritage. (…) I recall the grievous history of destruction of diverse forms of indigenous cultural heritage in many parts of the world as a systematic part of, inter alia, colonialism or nationalist policies in post-colonial States, and I note that the totality of these acts have had long-lasting effects on the human rights of many indigenous peoples in diverse geographical contexts. (…)When cultural heritage is destroyed, this bears important consequences for a wide range of human rights for current generations and those to come. Cultural heritage is a record of the genius of human beings, that which we leave behind for the next generations to mark our path through this world, and quite simply irreplaceable even in a digital era. Let us come together with urgency and thoughtfulness to protect it.”[17]

UNESCO Declaration concerning the Intentional Destruction of Cultural Heritage: “Recalling  the tragic destruction of the Buddhas of Bamiyan that affected the international community as a whole, (…) Referring to Article I(2)(c) of the Constitution of UNESCO that entrusts UNESCO with the task of maintaining, increasing and diffusing knowledge by assuring the conservation and protection of the world’s inheritance of books, works of art and monuments of history and science, and recommending to the nations concerned the necessary international conventions, (…)Mindful that cultural heritage is an important component of the cultural identity of communities, groups and individuals, and of social cohesion, so that its intentional destruction may have adverse consequences on human dignity and human rights, Reiterating one of the fundamental principles of the Preamble of the 1954 Hague Convention for the Protection of Cultural Property in the Event of Armed Conflict providing that damage to cultural property belonging to any people whatsoever means damage to the cultural heritage of all mankind, since each people makes its contribution to the culture of the world, (…) Mindful of the development of rules of customary international law as also affirmed by the relevant case-law, related to the protection of cultural heritage in peacetime as well as in the event of armed conflict; Also recalling Articles 8(2)(b)(ix) and 8(2)(e)(iv) of the Rome Statute of the International Criminal Court, and, as appropriate, Article 3(d) of the Statute of the International Criminal Tribunal for the former Yugoslavia, related to the intentional destruction of cultural heritage, (…) The international community recognizes the importance of the protection of cultural heritage and reaffirms its commitment to fight against its intentional destruction in any form so that such cultural heritage may be transmitted to the succeeding generations. (…) intentional destruction means an act intended to destroy in whole or in part cultural heritage, thus compromising its integrity, in a manner which constitutes a violation of international law or an unjustifiable offence to the principles of humanity and dictates of public conscience (…). States should take all appropriate measures to prevent, avoid, stop and suppress acts of intentional destruction of cultural heritage, wherever such heritage is located. (…)When conducting peacetime activities, States should take all appropriate measures to conduct them in such a manner as to protect cultural heritage (…) States should take all appropriate measures, in accordance with international law, to establish jurisdiction over, and provide effective criminal sanctions against, those persons who commit, or order to be committed, acts of intentional destruction of cultural heritage of great importance for humanity, whether or not it is inscribed on a list maintained by UNESCO or another international organization.”[18]

UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage: “Recognizing  that the processes of globalization and social transformation, alongside the conditions they create for renewed dialogue among communities, also give rise, as does the phenomenon of intolerance, to grave threats of deterioration, disappearance and destruction of the intangible cultural heritage, in particular owing to a lack of resources for safeguarding such heritage; (…) Considering the invaluable role of the intangible cultural heritage as a factor in bringing human beings closer together and ensuring exchange and understanding among them, (…) The intangible cultural heritage means the practices, representations, expressions, knowledge, skills – as well as the instruments, objects, artefacts and cultural spaces associated therewith – that communities, groups and, in some cases, individuals recognize as part of their cultural heritage. This intangible cultural heritage, transmitted from generation to generation, is constantly recreated by communities and groups in response to their environment, their interaction with nature and their history, and provides them with a sense of identity and continuity, thus promoting respect for cultural diversity and human creativity. For the purposes of this Convention, consideration will be given solely to such intangible cultural heritage as is compatible with existing international human rights instruments, as well as with the requirements of mutual respect among communities, groups and individuals, and of sustainable development. (…) Safeguarding means measures aimed at ensuring the viability of the intangible cultural heritage, including the identification, documentation, research, preservation, protection, promotion, enhancement, transmission, particularly through formal and non-formal education, as well as the revitalization of the various aspects of such heritage. (…) Each State Party shall endeavour, by all appropriate means, to: ensure recognition of, respect for, and enhancement of the intangible cultural heritage in society, in particular through: (…) non-formal means of transmitting knowledge; (…) Within the framework of its safeguarding activities of the intangible cultural heritage, each State Party shall endeavour to ensure the widest possible participation of communities, groups and, where appropriate, individuals that create, maintain and transmit such heritage, and to involve them actively in its management.”[19]

UNESCO Convention on the Protection and Promotion of the Diversity of Cultural Expressions:Recognizing the importance of traditional knowledge as a source of intangible and material wealth, and in particular the knowledge systems of indigenous peoples, and its positive contribution to sustainable development, as well as the need for its adequate protection and promotion, (…) Taking into account the importance of the vitality of cultures, including for persons belonging to minorities and indigenous peoples, as manifested in their freedom to create, disseminate and distribute their traditional cultural expressions and to have access thereto, so as to benefit them for their own development, (…) Recognizing the importance of intellectual property rights in sustaining those involved in cultural creativity; Being convinced that cultural activities, goods and services have both an economic and a cultural nature, because they convey identities, values and meanings, and must therefore not be treated as solely having commercial value”[20]

UNESCO Universal Declaration on Cultural Diversity: “Cultural heritage in all its forms must be preserved, enhanced and handed on to future generations as a record of human experience and aspirations, so as to foster creativity in all its diversity and to inspire genuine dialogue among cultures (…) In the face of present-day economic and technological change, opening up vast prospects for creation and innovation, particular attention must be paid to the diversity of the supply of creative work, to due recognition of the rights of authors and artists and to the specificity of cultural goods and services which, as vectors of identity, values and meaning, must not be treated as mere commodities or consumer goods. (…) Respecting and protecting traditional knowledge, in particular that of indigenous peoples; recognizing the contribution of traditional knowledge (…) Ensuring protection of copyright and related rights in the interest of the development of contemporary creativity and fair remuneration for creative work”

UNESCO Recommendation on the Safeguarding of Traditional Culture and Folklore: “Preservation is concerned with protection of folk traditions and those who are the transmitters, having regard to the fact that each people has a right to its own culture and that its adherence to that culture is often eroded by the impact of the industrialized culture purveyed by the mass media. (…) It is essential for the items that make up this cultural heritage to be widely disseminated so that the value of folklore and the need to preserve it can be recognized. However, distortion during dissemination should be avoided so that the integrity of the traditions can be safeguarded. (…) In so far as folklore constitues manifestations of intellectual creativity whether it be individual or collective, it deserves to be protected in a manner inspired by the protection provided for intellectual productions. Such protection of folklore has become indispensable as a means of promoting further development, maintenance and dissemination of those expressions,- both within and outside the country, without prejudice to related legitimate interests.”

UNESCO Recommendation concerning the Preservation of Cultural Property Endangered by Public or Private works: “Considering that contemporary civilization and its future evolution rest upon, among other elements, the cultural traditions of the peoples of the world, their creative force and their social and economic development; Considering that cultural property is the product and witness of the different traditions and of the spiritual achievements of the past and thus is an essential element in the personality of the peoples of the world;Considering that it is indispensable to preserve it as much as possible, according to its historical and artistic importance, so that the significance and message of cultural property become a part of the spirit of peoples who thereby may gain consciousness of their own dignity;  Considering that preserving cultural property and rendering it accessible constitute, in the spirit of the Declaration of the Principles of International Cultural Cooperation adopted on 4 November 1966 in the course of its fourteenth session, means of encouraging mutual understanding among peoples and thereby serve the cause of peace; Considering also that the well-being of all peoples depends, inter alia, upon the existence of a favourable and stimulating environment and that the preservation of cultural property of all periods of history contributes directly to such an Environment; (…) Considering, however, that the prehistoric, protohistoric and historic monuments and remains, as well as numerous recent structures having artistic, historic or scientific importance are increasingly threatened by public and private works resulting from industrial development and urbanization; (…) Considering equally that adequate preservation and accessibility of cultural property constitute a major contribution to the social and economic development of countries and regions which possess such treasures of mankind by means of promoting national and international tourism; (…) Member States should take steps to ensure that offences, through intent or negligence, against the preservation or salvage of cultural property endangered by public or private works are severely punished by their Penal Code, which should provide for fines or imprisonment or both. (…) Member States should encourage individuals, associations and municipalities to take part in programmes for the preservation or salvage of cultural property endangered by public or private works. (…) Educational institutions, historical and cultural associations, public bodies concerned with the tourist industry and associations for popular education should have programmes to publicize the dangers to cultural property arising from short-sighted public or private works, and to underline the fact that projects to preserve cultural property contribute to international understanding.”

Council of Europe Framework Convention on the Value of Cultural Heritage for Society: “Emphasising the value and potential of cultural heritage wisely used as a resource for sustainable development and quality of life in a constantly evolving society; Recognising that every person has a right to engage with the cultural heritage of their choice, while respecting the rights and freedoms of others, (…) The Parties to this Convention agree to (…) recognise individual and collective responsibility towards cultural heritage; (…) cultural heritage is a group of resources inherited from the past which people identify, independently of ownership, as a reflection and expression of their constantly evolving values, beliefs, knowledge and traditions. It includes all aspects of the environment resulting from the interaction between people and places through time; a heritage community consists of people who value specific aspects of cultural heritage which they wish, within the framework of public action, to sustain and transmit to future generations. (…) everyone, alone or collectively, has the responsibility to respect the cultural heritage of others as much as their own heritage, (…) Exercise of the right to cultural heritage may be subject only to those restrictions which are necessary in a democratic society for the protection of the public interest and the rights and freedoms of others. (…) enhance the value of the cultural heritage through its identification, study, interpretation, protection, conservation and presentation; (…) promote cultural heritage protection as a central factor in the mutually supporting objectives of sustainable development, cultural diversity and contemporary creativity; (…) encourage reflection on the ethics and methods of presentation of the cultural heritage, as well as respect for diversity of interpretations; establish processes for conciliation to deal equitably with situations where contradictory values are placed on the same cultural heritage by different communities; develop knowledge of cultural heritage as a resource to facilitate peaceful co-existence by promoting trust and mutual understanding with a view to resolution and prevention of conflicts; (…) To sustain the cultural heritage, the Parties undertake to: a promote respect for the integrity of the cultural heritage by ensuring that decisions about change include an understanding of the cultural values involved; (…) ensure that these policies respect the integrity of the cultural heritage without compromising its inherent values. (…) encourage non-governmental organisations concerned with heritage conservation to act in the public interest. (…) encourage everyone to participate in: – the process of identification, study, interpretation, protection, conservation and presentation of the cultural heritage; – public reflection and debate on the opportunities and challenges which the cultural heritage represents; (…) seeking to resolve obstacles to access to information relating to cultural heritage, particularly for educational purposes, whilst protecting intellectual property rights; recognising that the creation of digital contents related to the heritage should not prejudice the conservation of the existing heritage.”

Judgment on Captain Kenny Strauss

Case n° 21/2016: Captain Kenny Strauss Quiñones of the Bolivarian Army of Venezuela

 

ETHICAL JUDGEMENT

 

Dear Prosecutor, Public Defender, Ambassador and Jury Members of the International Buddhist Ethics Committee (IBEC) and Buddhist Tribunal on Human Rights (BTHR), regarding the case 21-2016 “Captain Kenny Strauss Quiñones of the Bolivarian Army of Venezuela”, by means of the present, on 15 November 2016, it is recorded that the trial of the Ethics Committee has been concluded to analyze the violation of Buddhist Spirituality carried out by the accused after voting of 6 members of the Jury , one of them issuing the verdict of “Insanity” and 5 of them issuing the verdict of “Responsible” with regards of the accused for the crimes of VIOLATION OF BUDDHIST ETHICAL PRECEPTS and COMPLICITY WITH HUMAN RIGHTS VIOLATIONS.

The actions of the accused “Captain Kenny Strauss Quiñones of the Bolivarian Army of Venezuela” have breached the Buddhist ethical precepts and the essential guidelines of every spiritual movement. In addition, it is recorded that during the present ethical judgment the accused has made threats and insults against the Ethics Committee, even after the accused was warned that his actions could be interpreted as an attack by the Venezuelan government against the Buddhist Community. This has shown that Mr. Strauss does not actually violate ethical precepts because he is accomplice in human rights violations, but rather he commits human rights violations because he violates Buddhist ethical precepts. Instead of sincerely differentiating himself from all human rights violations, Mr. Strauss has decided to systematically attack the Ethics Committee, ignoring the possibility of rehabilitation, transformation and Cure provided by the Buddhist Path.

This case presents a peculiarity because it is the first time a student of Maitreya Buddhist University and a member of the World Association of Buddhism is brought to ethical judgment, which is a very sad and regrettable fact, since these organizations are a beacon of light in the world. In view of this situation, the Committee has decided to reject Mr. Strauss’s resignation to his membership, opting instead for his expulsion as a member. This clearly demonstrates that the International Buddhist Ethics Committee does not discriminate when carrying out its mission to purify humanity. Although the condition of being a member of the army may be considered in itself as a violation of Buddhist Ethics, it is the opinion of the Presidency of the Committee that every individual deserves an opportunity to learn and to be liberated through the Buddhist Path, so that it must be provided spiritual education even to soldiers and governors, except in cases where they violate human rights and do not regret of doing so. In this way, the maximum crime against Buddhist Ethics does not constitute in itself the act of violation of human rights, since it is rather constituted by its repetition (karma). When an individual feels no repentance in the face of his or her bad behavior and also attacks the Buddhist Ethics, then he or she follows the Path of perversion and nullifies his-her dharmic nature of learning and Awakening (Bodhi). In this sense, even if there are childish traits in the accused, especially at the time of sarcasm, insults and threats against the Ethics Committee, they should not be interpreted as a trait of Insanity, but rather as a trait of Perversion. Therefore, the accused is fully “Responsible” of his acts. This kind of perverse psychic structure is similar to previous cases of the Committee, such as the cases of Ocampo and Spencer.

On the other hand, the violation of the Buddhist ethical precepts has not been the only charge against Mr. Strauss, since the accused has also been conferred with Responsibility for the charge of Complicity with Human Rights Violations in Venezuela. Indeed, in Venezuela, a series of perverse governmental acts that violate the supreme human right to peace of the Venezuelan people are happening, violating the democratic system and instituting a climate of war, poverty and injustice against the dignity of the population. Although the accused clearly follows orders and, in fact, he does not make oppressive decisions against the Venezuelan people, jurisprudence in International Law shows that even officers of minor positions are also Responsible for human rights violations ordered by their superior officers. Whenever a soldier or government official is aware, he will always have the possibility of abandoning his post, by refusing to participate in violations against the dignity of the human being.

This bad ethical behavior of Mr. Strauss is part of an international context in which  human rights violations committed by the Venezuelan government have the silent complicity of international organizations such as the UN, the OAS and even the Vatican. However, because it is an organization devoted to ethical and humanitarian teaching, the International Buddhist Ethics Committee offers Mr. Strauss the possibility of accessing free spiritual education under the condition that he rectifies his misbehavior by publicly denouncing human rights violations of Venezuela and apologizing to the Committee for his insults and threats. In case this misconduct continues, given that Mr. Strauss is an officer of the Venezuelan army, this fact will be considered as a governmental aggression by Venezuela against the International Buddhist Community.

Following the Path of Master Siddharta Gautama, who has led armies towards the Path of Peace and Reconciliation through simple and direct ethical teachings, it is established that the accused “Captain Kenny Strauss Quiñones of the Bolivarian Army of Venezuela” has violated the Buddhist Spirituality, having been ruled its “Responsibility” for the charges of VIOLATION OF ETHICAL BUDDHIST PRECEPTS and COMPLICITY WITH HUMAN RIGHTS VIOLATIONS.

The International Buddhist Ethics Committee has a duty to protect Spirituality and the entire humanity, establishing the present Judgment as a form of ethical teaching for the accused and the organization he belongs.

After Legitimating and Validating Proofs, Evidences and Charges by Buddhist Master Maitreya, President and Spiritual Guide of IBEC-BTHR, it is addressed the case against the accused, Captain Kenny Strauss of the Bolivarian Army of Venezuela. This investigation was initiated by the International Buddhist Ethics Committee from the allegation made by the World Association of Buddhism.

Below, the Charges by which the International Buddhist Ethics Committee is accusing Captain Kenny Strauss of the Bolivarian Army of Venezuela:

Therefore, it is detailed a series of EVIDENCES that support the Charges referred so that the Jury members decide about the possible “Responsibility”, “Innocence” or “Insanity” of the accused. Such evidences come from graphic and audiovisual media that have been gathered, sorted and confirmed in their order and context as Means of Proof in order to know, establish, dictate and determine the Responsibility of the Accused for committing the aforementioned Charges.

The procedure established in the Statute of INTERNATIONAL BUDDHIST ETHICS  COMMITTEE & BUDDHIST TRIBUNAL ON HUMAN RIGHTS  provides both bodies the ostentation to enjoy independence and liberty from state and national regulation and control, besides having the legality and acting as a Buddhist People in order to assert their customs, traditions, practices, procedures, judgments and rights as well as acting in pursuit of the development of Spirituality, of Buddhist Ethics, and of the defense of International Human Rights. This procedure has the particularity, singularity and distinction of having: “Special Jurisdiction of the Tribal Law” and “Universal Jurisdiction of the International Law”, thus having the Character, Juridical validity, Legal Powers, Infrastructure, Training and Capability necessary to be Actor, Administrator and Executor of Justice in this realm and exercise, by determining the “Responsibility” of the Accused by means of an Ethical Judgment whose Purpose is Truth, Reconciliation and Learning.-

DETAIL OF EVIDENCES

Evidence 1: VIOLATION OF BUDDHIST PRECEPTS

International Buddhist Ethics Committee: The accused affiliated with the World Association of Buddhism in 2014, and also enrolled as a student at Maitreya Buddhist University. Both institutions have the International Buddhist Ethics Committee as a common mechanism to solve problems. These are institutions that respect human rights and the highest standards of Ethics and Spirituality. Mr. Strauss always felt comfortable with the organization. The problem arises from a message of Mr. Strauss in October 2016, when showing interest in re-initiating studies at Maitreya Buddhist University, and then he signed his email as Captain of the Bolivarian Army of Venezuela. During those same days, the International Buddhist Ethics Committee and the Buddhist Tribunal on Human Rights became fully aware of serious violations of human rights in Venezuela, such as the violation of the democratic system and detentions for political reasons. When Mr. Strauss was asked about his position on these violations, which would be in absolute contradiction with Buddhist ethics and international law, he stated he was against all violations of human rights in Venezuela. The existence of political prisoners in Venezuela is of great concern to the International Buddhist Ethics Committee, not only because it is antidemocratic, but also because it intrinsically is an attack on peace. The World Association of Buddhism, of which the accused is an adherent member, must maintain its purity, so it is attentive to any violation against Buddhist ethics that may be committed by members. Therefore, the Prosecutor of the International Buddhist Ethics Committee asked the accused the following questions: Do you consider that the human rights violations that are happening in Venezuela are contrary to Buddhist ethics? Or do you consider there are no violations of human rights in Venezuela which are being carried out by the government and the army? In his response, Captain Strauss stated that he was “in complete disagreement with human rights violations in Venezuela and anywhere in the world … neither here nor in China, or in Argentina or anywhere.” However, immediately after stating that, Mr. Strauss said that his Buddhist condition has nothing to do with his profession, ignoring fundamental Buddhist ethical precepts that every follower must maintain in his private life, such as not hurting other living beings. Mr. Strauss also asked to withdraw from the Buddhist organization World Association of Buddhism, expressing concern by the fact that his position on human rights violations in Venezuela is widespread, by stating “no one guarantees me the right to confidentiality of my answer or that you spread my answer which will bring negative consequences both in my private professional and family life”. After this, Mr. Strauss dedicated his Statement to the Prosecutor to make a long list of comments in a sarcastic tone. The last part of Mr. Strauss’s statement was intended to compare the Buddhist Ethics Committee with the Nazis and the Islamic State.

Statement of Captain K. Strauss: “Oh great deity, divinity, excellence, superiority, culmination, maturity, splendor, purity, goodness, your majesty, all goodness and all justice and that (the Prosecutor), who certainly I do not know who she is, I congratulate you and admire you for being so attached to Buddhism, justice, to respect for human dignity, with submission to karmatic consequences, greatness, I also congratulate you for giving me a great school of spirituality, purity, respect for due process, non-clandestinely, I see that you, as a spiritual prosecutor, handle in an attached manner to the customary laws of due process during a trial, just as you have done with me, I congratulate you also because you do not take justice into your own hands and I also congratulate you for your ability not to judge people, I also congratulate you for being a model Buddhist, I congratulate you because I see you have a great knowledge of the spiritual consequences that it brings when people is subjected to public derision, I also congratulate you because you don’t let be carried away by the ego, nor by low passions, because you make the right decisions, I see you know of karmas, the emails that were sent by you, I’m going to reply them to my Buddhist community in Venezuela so that they see how splendid you are, oh great teacher, most interesting of all is the fact that my mind is clean I have never committed or done anything bad against anyone, with your hand on the heart, are you acting well, great and exalted masters?, almost gods on earth. I am deeply disappointed of you, I wish you the best, I do not hold you a grudge. (…) Anyway, I am going to speak with my lawyer and will talk to the Buddhist authorities in Venezuela to see if you, exalted gods on earth, can violate due process and take justice as if you were Nazis and I am going to spread the emails you have sent me, great masters, it seems you don’t fear the karmas, besides, you act anonymously like an executioner of the Islamic state”

Evidence 2: COMPLICITY WITH VIOLATIONS OF THE HUMAN RIGHTS

International Buddhist Ethics Committee: There is evidence that the Venezuelan government led by President Maduro is carrying out serious violations of human rights, engaging in violent repression against the political opposition, as evidenced by the illegal detention of dozens of people who were part of a campaign calling for a recall referendum of President Maduro, which is a mechanism of the Venezuelan Constitution. This illegal detention has even been accompanied by many cases of torture against such political prisoners (as in the case of Mr. Carrasco), who reported having been physically, sexually and psychologically tortured at the hands of the Bolivarian Intelligence Service (Sebin).

José Miguel Vivanco (Human Rights Watch): “The detainees detailed brutal, cruel treatment and even torture by the State forces (…) There are such absurd charges as the possession of pamphlets calling for the release of political prisoners or convocations to join the recall referendum, campaigns that are absolutely legal in Venezuela”

International Buddhist Ethics Committee: There are evidences that the Venezuelan government is causing a terrible humanitarian crisis, responding with violent repression against all those who denounce this fact and request for a change. A clear example of how this humanitarian crisis, which is produced by the inadequate governmental response, is causing deaths is not only evident in child malnutrition and food shortages, but is also evidenced by the fact that hospitals in Venezuela are lacking analgesics, antibiotics, essential drugs, incubators, sterile gloves, gauze, alcohol for medical use and cleaning conditions in birthing rooms. The Venezuelan government has emphatically denied this crisis, even intimidating and punishing critics who denounce it, such as doctors and human rights defenders, by beating and illegally detaining those who participate in peaceful protests. Even some of the activists were tried in military courts, violating their civil right to adequate justice. The Venezuelan government must stop the psychological and physical attacks against its political critics.

José Miguel Vivanco (Human Rights Watch): “The Venezuelan government has done more to deny the fact that there is a humanitarian crisis than working to resolve it … Their inaction has contributed to the suffering of many Venezuelans, for whom it is very difficult to access basic health care and an appropriate nutrition (…) Without a strong international pressure, especially from the region, it is highly unlikely that Maduro’s government will take steps to address Venezuela’s humanitarian crisis, and in that case, its fatal consequences will only worsen”

Human Rights Watch: Regional governments should exert pressure on the government of President Nicolas Maduro in order to take immediate measures that adequately address the deep humanitarian crisis with which the country is faced[1]

Case 19/2016: Ronald Lloyd Spencer

LEGAL ACT ON DR AMBEDKAR INTERNATIONAL AWARD 2014

 

Dear Jeewak Welfare Society & Ashwaghosh Buddhists Foundation Nagpur (India),

By means of this act, on February 27, 2017, we are communicating in order to perform an International Repudiation to the award your organization has given to Ronald Lloyd Spencer, who has been sentenced in the International Buddhist Ethics Committee for the charges of SPIRITUAL FRAUD and FALSE BUDDHISM. This repudiation is not only due to the fact that Ronald Lloyd Spencer manipulates and deceives hundreds of people under the sacred name of Maitreya Buddha, but also this individual uses the Dr. Ambedkar International Award as a sort of spiritual revalidation, since he needs to create a Buddhist image surrounding him to be able to carry out his systematic and generalized scams. Obviously, this awarding was an error of judgment on the part of the organizations Jeewak Welfare Society & Ashwaghosh Buddhists Foundation Nagpur (India), which assumed the legitimacy of Spencer. However, it is crucial that these organizations immediately annul said award, by declaring its annulment and cancelling it for ethical and legal reasons. Failure to do this annulment of the award given to Ronald Lloyd Spencer, after being aware about his offences, then you will be complicit in scams and fraudulent activities.

The International Buddhist Ethics Committee establishes that, in case the award given incorrectly to Mr. Spencer would not be annulled, this would immediately constitute an invalidation of any spiritual award given by the Jeewak Welfare Society & Ashwaghosh Buddhists Foundation Nagpur (India), which means that the prizes awarded to individuals such as 17 Karmapa Trinley Thaye Dorje, Ven. Dhammananda Bhikkhuni and H.H. 37 Drikung Kyabgön Chetsang, among others, would be declared null.

In conclusion, when a Buddhist individual or institution makes an error of judgment, which is something absolutely normal, the Path of Righteousness points out that it should be repaired and never trying to justify and maintain the error, otherwise the error becomes a harmful pattern or repetition (karma). Buddhist Spirituality points out that even the Free and Enlightened Beings (Arhats-Bodhisattvas) make mistakes, due to the fact that everything is imperfect, impermanent and insubstantial; what differentiates a spiritual master from the rest of society is that he or she always learns from mistakes, turns them into compassionate wisdom (karuna-prajna), never trying to defend or repeat said mistakes.

By means of this Act of Repudiation it is declared the annulment of the Award given to Ronald Lloyd Spencer, who is a criminal in the eyes of Buddhism, since this award constitutes treason to the memory of Dr Ambedkar. It is also set as a warning that in case of non acceptance of this Legal Act, the International Buddhist Ethics Committee shall declare as illegal all the prizes awarded by the Jeewak Welfare Society & Ashwaghosh Buddhists Foundation Nagpur (India),  making the decision to remove the membership of the latter institution in the UNITED BUDDHIST NATIONS ORGANIZATION. Obviously, in case of complying with the decisions of the Legal Act, these institutions will have all the ethical, spiritual and educational support from the International Buddhist Ethics Committee, offering them absolute access to full scholarships in Advanced Buddhist Studies.

ETHICAL JUDGMENT

 

Dear Prosecutor, Public Defender, Ambassador and Jury Members of the International Buddhist Ethics Committee (IBEC) and Buddhist Tribunal on Human Rights (BTHR), regarding the case 19-2016 “Ronald Lloyd Spencer & “The Church of Shambhala Vajradhara Maitreya Sangha” through this, on November 4, 2016, it is evidenced that the case of the Ethics Committee regarding the violation of Buddhist Spirituality by the accused is concluded after voting of 9 Jury members, all of them issuing the verdict of “Responsible” for the crimes of SPIRITUAL FRAUD AND FALSE BUDDHISM.

The actions and teachings of the accused ones, “Ronald Lloyd Spencer & “The Church of Shambhala Vajradhara Maitreya Sangha”“, do not constitute any kind of Spirituality, using the disguise of Buddhism to perpetrate massive scams to ignorant individuals. This scam or robbery is based on the radical lie, which would be the alleged spiritual legitimacy of the accused, so this criminal framework constitutes an intrinsic violation of the Buddhist ethical precepts and also of the essential guidelines of Spirituality. In addition, this spiritual fraud is an attack on the cultural sovereignty of Buddhist Peoples and Spiritual Communities, which have the right to denounce and prosecute those who illegally usurp the cultural heritage transmitted by Siddharta Gautama. The accused ones could have taught some Buddhist knowledge and practices if they really had a minimum of good will, but the total absence of Buddhist Spirituality in their lives demonstrates that they are a fraud and a scam. Just as the case 17-2016 of Ricardo Javier Ocampo, Mr. Ronald Lloyd Spencer is really a scammer who disguises himself as spiritual master to commit crimes with impunity, hiding behind the prestige emanating from everything that surrounds Buddhism.

When examining the teachings of the accused, many of them linked mainly with geomancy and esoteric rituals, it is evident the fraudulent condition thereof, profiting monetarily with the ingenuity of his followers. Although some people might argue that Mr. Spencer suffers from psychosis and that this could be the cause of its Spiritual Fraud and False Buddhism, the fact of economic profit is what proves that the defendant is a perverse subject, demonstrating once again the darker nature of evil, that is to say, evil disguised as goodness. Therefore, the SPIRITUAL FRAUD AND FALSE BUDDHISM that the accused ones carried out is not only an attack on Buddhist Spirituality but also constitutes a massive scam to their own ingenuous disciples, who trusted in the alleged spiritual truthfulness of Mr. Spencer due to he himself claimed to possess divine powers, which is one of the most serious violations against Buddhist Law.

Obviously, there is certain Responsibility on the part of Mr. Spencer’s disciples, who are called The Church of Shambhala Vajradhara Maitreya Sangha, given that every Buddhist Community (sangha) should never worship their spiritual leader or master. Indeed, it may be well established the ethical rule that every time a spiritual master claims to possess paranormal powers one is faced with a case of SPIRITUAL FRAUD AND FALSE BUDDHISM. What is truly miraculous or divine on the part of an Awakened One (Buddha) comes from his or her level of compassionate wisdom (karuna-prajna), that is to say, it lies in the ability to help others to achieve inner and outer Liberation by means of contemplation (zen) and ethics (sila). Thus, when these spiritual features are absent in a Buddhist master then one is in the presence of a fraud and a scam that is completely threatening the purity of Buddhism in its mission to save the world. The abominable deception of those who disguise themselves as spiritual masters in order to take advantage of ingenuous and ignorant persons should not be taken lightly, especially in the context of a contemporary civilization that is obsessed with what is superficial and illusory, where it seems that everything that is insignificant and banal is the only news. Those who deceive and financially profit with Spirituality, not transmitting teachings but transmitting greed and lies, must be prosecuted by the International Buddhist Ethics Committee, whose Purpose (Dharma) in life is to show that the Awakening, the Truth and the Spiritual Righteousness are not what these phony and criminal individuals transmit. Therefore, it is recommended to provide spiritual teaching free of any charge to anyone who has been deceived by the accused, as long as they show openness and humility.

Following in the Way of Master Siddhartha Gautama, who always fought against the evil of deceit with the Good of Truth, it is established that the accused Ronald Lloyd Spencer & “The Church of Shambhala Vajradhara Maitreya Sangha” have breached Spirituality and Buddhist Ethics, so it has been ruled their “Responsibility” on charges of SPIRITUAL FRAUD AND FALSE BUDDHISM. Ultimately, the International Buddhist Ethics Committee has the duty to protect and defend the Spiritual Purpose (Dharma), establishing the present ethical and juridical Judgment as a teaching for the accused, for his victims and for the whole humanity.

DETAIL OF EVIDENCES

International Buddhist Ethics Committee: In the United States there are thousands of sects. One of them is led by Ronald Lloyd Spencer, who claims to be the reincarnation of Siddhartha Gautama and Jesus of Nazareth. He has created a religious sect that is allegedly Buddhist, albeit absolutely none of his teachings is Buddhist. In fact, actually, Ronald Lloyd Spencer teaches esotericism and sells product of geomancy and parapsychological healing, thus using the image of Buddhism in a fraudulent and illegitimate way. Through this SPIRITUAL FRAUD Ronald Lloyd Spencer has raised hundreds of thousands of dollars, claiming falsely that this money will be used for the reconstruction of temples in Tibet and other countries, so he takes advantage of ignorant people lacking of understanding about Buddhist Spirituality both in the United States and Asia. These people have been scammed systematically by him when using the name of “Buddha Maitreya the Christ,” which constitutes a huge damage and insult to the ancient culture of Buddhism.

 

Evidence 1: People disguised as Buddhist Monks create a temple of Esotericism, claiming false Buddhist antecedents

GLENDA ANDERSON (THE PRESS DEMOCRAT): “The Church of Shambhala Vajradhara Maitreya Sangha Monastery sits atop a mountain overlooking Clear Lake like a mirage hinting of exotic mythical temples. (…) Each structure includes underground levels that are connected by passage ways, a rabbit warren structure that helps conserve energy. Spiral stairways link the above- and below-ground levels. The design of the monastery near Kelseyville is intended to enhance spirituality and the environment, said Lama Daniel, a former London lawyer who gave up his worldly ways to become an American Buddhist monk.  The monastery incorporates green living and building technologies with sacred geometric patterns that stimulate healing of the soul, he said. (…) The monastery is on 160 acres purchased in 2006 for about $375,000, according to Lake County documents. The finished product is expected to cost $1.5 million to $2 million. Construction began in 2008 and has yet to be completed but the complex already is home to a small population of nuns and monks as well a handful of yaks and llamas. Upon completion, it will be open to the public for spiritual healings and retreats. The monastery is the brainchild of an American-born (…) Ronald Lloyd Spencer (…) in a written statement said Tibetan masters came to his home when he was 9 years old to tell him he was Buddha Maitreya, the reincarnation of Buddha. He said his parents rejected the Tibetan masters’ news and he did not pursue his calling until he turned 30. According to the organization, (Mr Spencer) founded the Buddhist Association of North America, built several monasteries, including in Tibet, and meditation centers in India, Nepal, China, London, Sedona, Arizona, Napa and Santa Rosa. The meditation centers focus on Soul Therapy,  a trademarked system using sacred design and geomancy. They utilize crystals, magnets and wire in geometric designs to assist in the soul healing. Healing tools are suspended over beds in private meditation rooms in the domes and in the pyramid building, where (…) etheric weavers hang in a chapel-like room with speakers emitting the calming voice of (Mr Spencer). (…)  A variety of etheric weavers and pendants in geometric shapes can be purchased online. The money from the devices, which start at about $80 (…) has given more than $3.7 million to support the renewal and restoration of Tibetan Buddhist monasteries and sacred sites in Nepal, India and Tibet, said.” [1]

 

Evidence 2: Deceit

Rick Ross: “A former truck driver who now runs a cult in California (…) announced on radio that he and the Dalai Lama of Tibet are working together. Ronald Lloyd Spencer (…) says that he and the Dalai Lama will soon be sitting on throne seats next to each other. Spencer runs therapy and retreat centers in Mt. Shasta, California and Omaha, Nebraska. He made these and other bizarre claims on his radio shows, which are broadcast in the Bay area of San Francisco on 1450 KFST FM, KNRY 1240 AM in Santa Cruz and in Omaha on KKAR Talk. (…)Mr. Spencer is a liar. A former secretary who served His Holiness the Dalai Lama and is now at Stanford University (…) Secretary Tenzin Geyche Tehton added that what Spencer says concerning the Dalai Lama is totally nonsense and simply rubbish. (…)  It seems Mr. Spencer collects donations for lifesaving assistance, which may explain how he managed to arrange various photo ops to show supporters and to post at his website. (…) his sordid past includes theft, sexual abuse, fraud and brainwashing. One of his victims referred to him as little more than a con man. Spencer may say that donations help in the restoration of [Tibetan] monasteries, but you won’t find a detailed and independently audited financial statement on his website, to demonstrate dollar-for-dollar how the money is spent. One former Spencer confidant observed, I pity the poor monasteries that cannot possibly have the slightest hint about how he is using them. Spencer also sells an array of pricey metaphysical contraptions and amulets, some supposedly designed for etheric healing. He claims, all profit from sales is donated to Tibetan monastery renovations and sponsorship of exiled Tibetans. Ron Spencer staffs his Soul Therapy and Shambhala Retreat Centers, largely with Americans he calls monks. These devotees manufacture the contraptions he hawks, but often receive little more than room and board. (…) an eclectic mix of New Age beliefs that includes everything from the Archangel Michael to the Lost Continent of Atlantis. Spencer even promotes theories about UFOs. However, these are certainly not doctrines His Holiness the Dalai Lama would recognize. (…) (Spencer) has been divorced, remarried and has children. (…) also has a history of recreational drug use and is a hemp enthusiast. Well, it’s a free country and as they say (…). But it seems Spencer’s sailing shouldn’t be subsidized by trading on the respected name of the Dalai Lama of Tibet.”[2]

Ratna Henry Chia: “(Ronald Lloyd Spencer), an American man born in 1951, declares that he is (…) the reappearance of Christ, the Buddha. (…) And his name and title are changed time to time: Archangel Michael, Tulku Karma Sonam Phuntsok Rinpoche, Babaji, Tulku Je Tsong Khapa Gyalwa Rinpoche, Lama Dorje Buddha Maitreya Jesus Archangel Michael and last but not the least the American Buddha. (…) An official email from the Office of His Holiness the Dalai Lama regarding (Spencer): Dear Ratna Henry Chia, Thank you for your email. I am to inform you that the person you mentioned in your email as being a tulku has never been endorsed or recognised by His Holiness the Dalai Lama. We had received quite a number of letters and emails recently and in the past regarding this. With best wishes, Tenzin Wangden Andrugtsang. (…) [3]

CultNews.com (November 09, 2002): “Spencer claimed on his radio show, “that [the Dalai Lama of Tibet] will retire next July and in recognition of Buddha Maitreya…crown him…and hand over all…ashrams…as well as [his] spiritual seat to Spencer. This announcement was made on Spencer’s Shambhala Hour program, which is broadcast in the Bay area, Santa Cruz and Omaha, Nebraska.”[4]

 

Evidence 3: Mistreatment  of  Buddhist Monks

CultNews: “(Spencer) got mad when some monks he hosted from Tibet wouldn’t recognize that preposterous title. Ronald Lloyd Spencer’s Church of Shambala, which has been called a cult, sponsored seven monks to make the journey to America. However, it seems when the monks refused to recognize Spencer as the reincarnation of Buddha the church abruptly withdrew its support, their religious visas were revoked and a dozen immigration officers in riot gear showed up to arrest them… After the negative fallout from this it seems a legal settlement was struck between the would-be Buddha and the mistreated monks. According to a document dated March 9th and recently forwarded to CultNews that settlement not surprisingly includes what is commonly called a gag order.  It states, In the interest of settlement of all differences, legal disputes, claims and causes of action, the parties, including their legal representatives, agree not to have any further contact with the media, which includes newspaper, television, radio and internet websites, or any other media form for the purpose of discussing any issue of the Monks and the Church of Shambala and the dispute regarding the visa revocation…  (…) The Church of Shambala and the Monks recognize that there are differing accounts of the events leading up to the arrest of the Monks and thereafter but wish no further reporting on this matter…  Well, it looks like the monks got a good lawyer and Ron Spencer wants everyone kept quiet. Daniel Honeywell, Spencer’s disciple and representative, said that the document he forwarded via email to CultNews was supposedly self-explanatory (…). Hopefully, what flows from all this is that the monks were well provided for and traveled back to their native land peacefully and in comfort. Though the matter might have been concluded better if Spencer and his church offered them a public apology. But despite the settlement, which essentially silences the monks on the matter, this self-proclaimed Buddha has been busted as an egotist and certainly less than hospitable host to say the least. CultNews thinks it will require virtually endless reincarnations according to Buddhism before someone like Ron Spencer ever reaches spiritual maturity.”[5]

 

Evidence 4: Scam

Cult Education Institute (quoting an old friend of Ronald Lloyd Spencer): “My experience with Ron was actually quite a while ago, in Honolulu, Hawaii about 1983 to 1984. I lost all contact with him after that time period. I am writing this now because I just happened to run across one of his centers in Mt. Shasta, California, the Archangel Michael Soul Therapy Center. I met this very nice girl running the center who was totally ignorant of Ron’s past history. In those days in Hawaii, he had not yet developed his Buddhism angle, although the roots of that were evident. He was then totally into exploiting the New Age trends of the time. Crystals and pyramids were all the rage, and Ron knew how to play with them. In my first introduction to the small group that had formed around him, a good friend encouraged me to meet and then continue with Ron. After my first meeting I was told that if I was to be in with the group I should buy a cheap shiny pyramid necklace pendant for $150.00. This demonstrated to me right away what Ron was and still is mainly interested in, money. I was a student at that time and did not have that kind of money to spare. Ron found out I had credit card though and it turned out he had to have a $1,000.00 stereo system for his magic. He assured me that if I purchased the stereo for him he would pay me back shortly. Ron also required precious stones for his ceremonies. He saw my mother’s diamond engagement ring that I wore, and said he wanted to borrow it just for a certain ceremony and would give it right back. Weeks went by and I frequently asked him for the credit card payment and my mother’s ring back, but there was always some excuse or another, but a not to worry, I would get them back soon.  Meanwhile, Tai Situ Rinpoche, a truly distinguished Tibetan Buddhist teacher, was visiting Hawaii and gave several lectures at the University of Hawaii, which I was attending. Tai Situ Rinpoche made quite an impact in Hawaii at that time. Ron claimed that he was a very close friend of Tai Situ Rinpoche and announced this widely to promote himself. At that point I was beginning to suspect Ron’s behavior and motives, and was strongly suspicious of this claim. I made a private appointment with Tai Situ Rinpoche the next day. I asked him if he knew Ron Spencer. He did not recognize the name (…). He had absolutely no relationship or any other contact with Ron of any kind (…). I was losing hope of ever getting my ring or money back. Meanwhile, bad things were happening to the sister of my friend who first introduced me to Ron. My friend (a girl), her sister, Ron, and Ron’s wife and child were all sharing a house that my friend was paying for. My friend told me that her sister was having an emotional crisis. She did not know what was going on, but we found out later after Ron skipped town, that Ron was sneaking into her room after his wife went to bed and was having sex with her. He claimed that this was for her spiritual benefit and used crystals and other magic objects inserted into her body. One of the people in the small hardcore group that followed Ron around was an ex-prostitute. Although she had ended that life and moved on, Ron convinced her that her bad karma could only be healed if she gave him all her salary. This, the poor lady did with joy, informing us that only now were her sins being forgiven, by Ron. Others of this group also were supporting Ron financially. Perhaps he needed all he could get, because of the huge intake of drugs he seemed to require, mainly marijuana and LSD. I wonder if he still uses drugs to the extent he once did. I was emboldened by my interview with Tai Situ Rinpoche. I started to tell my friend of Ron’s lies and theft. From me and from observing her sister’s problems, my friend also became suspicious, even though she had been Ron’s main financial benefactor. Shortly thereafter Ron left Hawaii very suddenly, with, of course, my ring and the unpaid bill. That was the last I heard of this con man until my Mt. Shasta visit. It was interesting going through Ron’s Mt. Shasta center and looking at his website. I can readily identify the source and see the flow of all the nonsense he inflicts upon his poor victims. I personally love and learn from Buddhism and am especially outraged that Ron appears to be exploiting this profound wisdom now as his latest con. Even though his writings on the website are barely literate, there is some skill to all of his lies and distortions. It looks like he even has finally made it to the East to take photos with legitimate Tibetan Buddhists. I pity the poor monasteries that cannot possibly have the slightest hint about how he is using them and who he really is. Now he is supposedly the Buddha and Jesus.”[6]

Guruphiliac: “(Ronald Lloyd Spencer) runs the Tibetan Foundation/Church of Shambhala [bold italics ours], which apparently has little to do with Tibet and a lot to do with Ron’s appropriation of Tibetan Buddhism as a means toward his own economic benefit and ego-aggrandizement. (…) But before Ron was the second coming of Buddha and Christ, he was just another NewAge™ flimflam man living in Hawaii. (…) A money scammer (…) The real question is whether Ron is knowingly impersonating the Buddha or if he actually believes he is the Buddha. It’s a very important distinction. In the former he is an out-and-out con man and criminal, in the latter he’s merely another insane guru with enough ninnies around who believe in him to keep him going. (…) For the moment, we’re going with the former.”[7]

Cult Education Institute (quoting a former follower of Spencer): “I heard about a certain Buddhist group that used metatronic tools and based their understanding of the soul and individual personality upon rays of light. Each ray was supposedly associated with certain distinct personalities. This appeared at first to be mystical and very cerebral–fitting within my previous studies and understanding of Kaballah. I met a so-called Buddhist monk, ordered their books and signed up for a darshan (i.e. one-week intensive seminar) in the mountains of Mount Shasta, California. (…) Everybody was asked to dress completely in white and bring a tape player. I traveled light–thinking that this was the guru I had been searching for. (…) We quickly lost our sense of connection with the outside. (…) The monks worked 18 or more hours every day without complaints. Everyone was honored and grateful to be a part of the ashram or Sangha House as it was called–supervised by (Spencer). (…) Later, I would come to understand that everything he criticized, concerning incorrect behavior and thinking–were actually things he was doing. How he labeled it as wrong within others, but got away with it himself–was a piece of his brainwashing. He wanted to separate us from everything but himself [see Milieu Control]. If we gave our individuality up and followed him we could remember our pure soul [see Demand for Purity] and find the many awesome answers we had all been looking for. How easy it seemed. Why not? We would be eating such wonderful, blessed food (from the same menu) and be with the reincarnation of Buddha and Jesus too. (…) Our money was spent for the darshan, tools and books. Everything was blessed and there were very beautiful crystals in the metatronic designs. All of (Spencer) designs were supposed to be telepathically sent to his monks (…).  If something didn’t seem right, went unexplained or was questioned, never mind–it was somehow related to the fact that we were processing and/or awaking old soul material [see Doctrine Over Person]. (…) I seemed to have answers for everything. Everything had a simple answer, but the answers were not mine. Actually, everything was not mine–I had become part of someone else. Someone else was giving directions now and I didn’t have to worry. What a relief! My soul was being integrated. I kept in communication with the other participants and we planned our next darshan on (Spencer) birthday–we were invited, chosen and special. Now it was time for intense soul therapy. I bought a pyramid from the group, other tools and kept reading their books about the rays (Tapestry of the Gods) and played their music. Mind stilling, hypnotic, subliminally suggestive music with drumming, chanting and (Spencer)–continuously lecturing while the music played rhythmically in the background. He lectured about the rays and other beliefs. All the tapes and compact discs I purchased from the group were carefully put together by (Spencer). My friends and family were silent about what I had stepped into. If something had been said something to me–it probably would have fallen upon deaf ears. The people in my life listened politely. I told them about using the tools that seemed to posses some energy and the books that gave me the deeper understanding that I had always searched for. Of course (Spencer) was becoming ever more present in my consciousness. I began giving him more and more credit for the positive changes in around me. But why? After two more darshans that involved a close friend–we were invited to join the Sangha –an extended group that was closely aligned with a worldwide ashram. Our enlightenment and recapitulating then would occur at an even faster pace. The clothes were ordered, but before they arrived someone said, You might be part of a ‘cult.’ Whamo! Me in a cult? I tried to shake it off, but knew it was true and it blew my socks off. I had been betrayed, spiritually raped and I was mad. I had also brought a close friend into this. I now felt the embarrassment of sharing with friends and family the so-called tools and the pyramid at my office. Now I was apologizing for everything previously said. After making apologies I started to spread the news and contacted others involved. Looking back it is hard to believe that I entered such a trap under the influence of someone who now appears be a master con man. But before when people close to me said, You are acting strange–I just saw them as the lost ones [see Dispensing of Existence]. In the beginning I received so many calls from the ashram center either trying to sell me something, or arrange for another darshan. I should have known. The monks work long hours and risk injuring themselves and others by driving without sleep. I should have known. It should have been obvious too through the music (with Spencer droning voice offering his lessons), which played 24 hours a day–that we were being continuously programmed. We were not allowed to get away and there was no free time. (…) Doubts came and went, but the music always seemed to be pulling me back and I wanted to believe. I ignored all the warning signs because it was so comforting belonging to and being part of such a special group of like-minded seekers. I realize now that there was a widening gap of separation developing through my group experience, which was pulling me away from my personal roots and individual value system. This should have been my first clue. Anything that tends to pry you away from your family and values should at least be suspect. I had always been very trusting–especially regarding people who held positions of respect. Maybe this was naïve, but that was my early schooling. Sadly, it seems time for me move beyond those childhood ideals–gradually a balance is emerging.  Ron Spencer appears to have an ugly background. Ron seems to be a common con man who exploits others. He has had several wives and left behind children. He may have been wanted once by the English authorities and is being watched more carefully here in the states. There have also been allegations of sexual abuse and exploitation between Ron and at least one former female follower.  When I started looking into various allegations regarding Ronald Spencer he responded by claiming I had lost it was emotionally unfit and trying to manipulate others. He was playing his mind games again. Subsequently I was excommunicated and designated within his category of Dark Lodge [a negative term used by the group–see Loaded Language]. The supposed Dark Lodge can be a pretty lonely place, but it was heaven compared to where I was once headed for.  Since being excommunicated I began to read a highly recommended book, Captive Hearts, Captive Minds by Tobias. After the first three chapters it became clear to me that I had been with a real Psychopath –someone without feelings, only out for their own gain, exploiting and power tripping over others. A very sick man. It made me sick to think that I had taken the bait and was so close to being reeled in.   But that sickness was the first part of healing for me and I worked through it and probed that discomfort to better understand the experience and myself. Thankfully, there were others willing to help in that process. Many issues and relationships seem clearer to me now. Maybe it sometimes takes shaking things up a bit –to get the dust off and clarify things through a new perspective.  Finally though, I concluded that [Ron Spencer] had ironically given me an opportunity to grow and realize the importance of self-introspection. I find myself actually thanking him for that. And I would rather be thankful than resentful, which seems like a more positive attitude for my recovery and healing.  After all that I have experienced it seems to me–that when we feel lonely and isolated we should not go searching for something outside of ourselves. But look inside instead–for a deeper and more loving sense of who and what we are and hopefully a better understanding of our own individual self worth.”[9]

Dear ones,

Through the present Act, on day August 5, 2016, we communicate with you in order to make an International Repudiation to misbehavior that your Foundation develops, operating with complacency and complicit silence in the face of crimes of Mr. Ocampo (alias Master Love). Even though our ethical judgment was within the field of Buddhist Law, you have chosen to ignore these spiritual corrections and behave as accomplices of the violations committed by Mr. Ocampo, who besides being a criminal sentenced for child abuse he also teaches visions that are spiritually fraudulent from the ancient perspective of Customary Law of the Buddhist People. Although we have offered the disciples of Mr. Ocampo the opportunity to acquire a genuine spiritual formation at no cost, they have decided to respond with legal threats. This has happened as a result of letters from Rafael Indlekofer and Martina Corvalan threatening the International Buddhist Ethics Committee with initiating criminal and civil complaints of harassment, damages, ideological and discriminatory persecution. In that letter it is said that our procedures were false accusations, which were libelous, devoid of legal formality and intimations exceeding the frameworks of the law, so Committee should be refrained from making any kind of judgment or opinion about his institution. The International Buddhist Ethics Committee deplores that you resist to peacefully learn from mistakes and that do not have the basic knowledge to understand our traditional procedures. We confirm that the fact to have commitment to evaluation and criticism regarding all those who violate the Buddhist ethical precepts is not harassment but an intrinsic function of every Buddhist commune (sangha), being a legal resource that has over 2600 years old in order to keep Spirituality (Sasana) pure. We confirm that all analysis and accurate expression can only cause harm and injury to fraudulent and deceptive activities, because the expression of Truth is solidary, humanitarian and always aims at Salvation and learning of those who commit crimes and errors. Only those who are a fraud or an illusion may feel harassed, damaged and hurt by the Truth. We want to be clear that the Buddhist people have the right to investigate and denounce those who lie and use Buddhist aspects or images – like the term “Zen” – in order to deceive people. If you consider you are not acting like a spiritual fraud we invite you to call your leader, Mr. Ocampo, in order to perform his alleged paranormal feats before a qualified scientific committee. Yet even in face of the possibility that these are not mere magic tricks and they amazingly are genuine parapsychological powers, from the perspective of Buddhist Law this is one of the worst crimes a spiritual master may commit, since an Enlightened Being should never boast or arrogate any divinity or power. Obviously, this question is not competent to criminal or civil justice, but it is properly a matter of Buddhist justice, which is not recognized as valid on your part precisely because you are ignoring all kinds of jurisprudence on Spiritual Ethics and Buddhist Customary Law. In a world where materialism and metaphysics daily attack Spirituality, either through superficiality or fantasy, the Buddhist Law cannot fail to denounce those who are engaged in spiritually fraudulent activities, even in cases where there are threats toward the International Buddhist Ethics Committee. This ethical and ethnic positioning is not outside the framework of law, but it is supported by the Tribal Law and International Law of Human Rights. Indeed, requesting an institution of Buddhist ethics to refrain from making any kind of judgment or opinion violates Freedom of Expression. Finally, we confirm that what is outside the framework of law is complicity with those who commit sexual abuses.

JUDGMENT AND ETHICAL CONCLUSION

 

Dear Prosecutors, Executive Secretaries and Jury Members of the International Buddhist Ethics Committee (IBEC) and Buddhist Tribunal on Human Rights (BTHR), regarding the case 17-2016 “Ricardo Javier Ocampo, Meditazen Community & Bienaventuranza Foundation & Dharma Prema Association” through the present, on July 19, 2016, I confirm that the case 17 of the Ethics Committee is conclude in order  to analyze the violation of Buddhist Spirituality by the accused, after voting of 6 members of the Jury, 2 of them issuing a vote of “Insanity” and 4 of them issuing the verdict that the accused is “Responsible” for the crimes of SPIRITUAL FRAUD AND FALSE ZEN.

The actions and teachings of the accused “Ricardo Javier Ocampo, Meditazen Community & Bienaventuranza Foundation & Dharma Prema Association” has breached the Buddhist ethical precepts and essential guidelines of all spiritual movement, demonstrating that Mr. Ocampo is not a fraud because he commits violations but rather he commits violations because he is a fraud. While every individual has the possibility of rehabilitating and transforming himself, by reaching the Cure (Nirvana) from his past, this case is not about someone who was abuser and then became a spiritual master after ceasing his criminal way of life. This case is about a scammer who has disguised himself as spiritual master in order to be able to commit crimes, which constitutes the essence of the charge of SPIRITUAL FRAUD AND FALSE ZEN. But the offense of sexual abuse is not the ultimate proof of his fraudulent condition but rather his own teachings are, because they closely resemble the ones of the delusional Discourse of psychotic people. This was the reason why some members of the Jury of the International Buddhist Ethics Committee have voted for the “Insanity” of the accused ones. However, the prosecutor did not oriented the investigation towards this path precisely because the actions of Mr. Ocampo show that do not come from a psychotic individual but rather a perverse individual, being fully “Responsible” for his actions. This kind of psychic structure that is Perversion is the basis of those who tend to be psychopaths, which is evidenced by the fact that Mr. Ocampo has been charged with multiple sexual abuses. Thus SPIRITUAL FRAUD AND FALSE ZEN carried out by the accused persons is not only an attack on Buddhist Spirituality but also constitutes a massive Scam to the whole community of disciples who naively trusted in the alleged Spirituality of the accused ones. While the teachings of the accused ones clearly fit into the psychotic Discourse, the actions of Mr. Ocampo are closer to perverse Discourse. Obviously, there is certain Responsibility on the part of the disciples of Mr. Ocampo due to the fact to ignore that the mystical Discourse of an Awakened One involves not having divine or parapsychological powers, but rather involves developing contemplation (Zen), compassionate wisdom (karuna-prajña) and ethics (sila). When these three pillars are absent in an alleged spiritual master, there is evidently deceit and religious manipulation. All this shows that the accused ones transmit a False Spirituality, which constitutes a threat to the purity of the Buddhist Path, but also a threat to the hope for Awakening (Bodhi) that humanity has.

This bad ethical behavior of Mr. Ocampo is part of an international context in which the spiritual disciplines are reduced to superficialisation and banality through the culture of mass media. In this sense, there are people in the world who take economical advantage of Spirituality, such as the accused did, since they have large financial resources to carry out their fraudulent activities which lack proper supervision by spiritual masters. Therefore, the International Buddhist Ethics Committee, as an organization dedicated to the ethical and humanitarian education, offers the community of disciples of Mr. Ocampo full scholarships for its members to study Zen at no cost, as long as such association publicly apologizes to the victims of Mr. Ocampo for the sexual abuses performed, by committing to live a life based on righteousness. We hope that this ethical teaching help the accused people and their disciples to redirect their mind and body toward Truth and Justice.

Following in the footsteps of the Master Siddhartha Gautama, who has led the Path of Curing the suffering of the victims, it is established that the accused ones “Ricardo Javier Ocampo, Meditazen Community & Bienaventuranza Foundation & Dharma Prema Association” have violated the Buddhist ethics and Spirituality, having been dictated their “Responsibility” on charges of SPIRITUAL FRAUD AND FALSE ZEN.

The International Buddhist Ethics Committee has the duty to protect Spirituality, establishing the present Judgment as a means of ethical teaching for the accused, his disciples and his victims.

After Legitimating and Validating Proofs, Evidences and Charges by Buddhist Master Maitreya, President and Spiritual Guide of IBEC-BTHR, it is addressed the case against the accused party consisting of Mr. Ricardo Javier Ocampo, also known publicly as Master Love, Meditazen Community, Bienaventuranza Foundation and the Dharma Prema Association. This investigation was initiated by the International Buddhist Ethics Committee from the public sentence for Sexual Abuse that was conducted by the Argentine Justice.

The Charges by which the International Buddhist Ethics Committee is accusing Ricardo Javier Ocampo, Meditazen Community, Bienaventuranza Foundation & Dharma Prema Association are enumerated below: SPIRITUAL FRAUD and FALSE ZEN

Therefore, it is detailed a series of EVIDENCES that support the Charges referred so that the Jury members decide about the possible “Responsibility”, “Innocence” or “Insanity” of the accused. Such evidence come from graphic and audiovisual media that have been gathered, sorted and confirmed in their order and context as Means of Proof in order to know, establish, dictate and determine the Responsibility of the Accused for committing the aforementioned Charges.

The procedure established in the Statute of INTERNATIONAL BUDDHIST ETHICS  COMMITTEE & BUDDHIST TRIBUNAL ON HUMAN RIGHTS in its Article 13 ° provides both bodies the ostentation to enjoy independence and liberty from state and national regulation and control, besides having the legality and acting as a Buddhist People in order to assert their customs, traditions, practices, procedures, judgments and rights as well as acting in pursuit of the development of Spirituality, of Buddhist Ethics, and of the defense of International Human Rights. This procedure has the particularity, singularity and distinction of having: “Special Jurisdiction of the Tribal Law” and “Universal Jurisdiction of the International Law”, thus having the Character, Juridical validity, Legal Powers, infrastructure, Training and Capability necessary to be Actor, Administrator and Executor of Justice in this realm and exercise, by determining the “Responsibility” of the Accused by means of an Ethical Judgment whose Purpose is Truth, Reconciliation and Learning.-

EVIDENCE 1: SPIRITUAL FRAUD FOR DENOUNCES OF SEXUAL ABUSES OF MINORS

“Ocampo was arrested in the province of Catamarca and was imprisoned for almost four months. It began in April this year with a complaint by a 21 year old young man who lived in the Meditazen community for five years along with his mother. The young man said that when he was 14, in 2002, he had his first sexual relations with the accused. After that, he indicates that until his 20 years old he would have weekly sexual contacts with Ocampo. The cause was classified as rape, but the defense of Ocampo argued that by not having had opposition by the boy, it should be framed by the Article 120 of the Argentinean Criminal Code which speaks of “taking advantage of sexual immaturity,” which carries a maximum penalty of 6 years imprisonment. Because of such modification, Ricardo Ocampo was released from jail. A few months later, Federico (25 years old) accused him in the courts of La Rioja for an alleged abuse occurred when he was 11. Speaking to Clarin newspaper, Federico said that when he was 14, in 1998, “Ricardo gave us kung fu classes to me and other kids at my house. My parents were his followers and that is why he frequented us a lot. My companions were a girl of 16 and a boy of 15. The first two classes were about martial arts, but then things changed. He described alleged abuses to other young people and then toward him. Federico said that in the fifth class he “agreed in performing oral sex to him. After that, he did it to me”. Meditazen is located 22 km from Catamarca and 130 from La Rioja. Ricardo Javier Ocampo: “When being calm and sit to breathe serenely, doing pranayamas, suddenly, the illusion is set aside (…) In the hermitages, the mind slows down and there comes a time when it goes so slowly, that in that calm the observer appears. And this observer finally warns deception of mind. (…) When we experience in hermitages, the administration arises and then you discard unnecessary thoughts, and, when going down, there will be a reflection of that waste. You’ll begin to remove unnecessary things: we have things at home that once cost money and today are not useful at all, they are bothering, accumulated. They are not just objects; they symbolize internal circumstances from your emotions, therefore, from your fears. If there are accumulated objects, there are accumulated emotions which are no longer useful, you are afraid not to want to be detached of all of that. If you want to travel lightly, you have to learn how to eradicate the bag of emotions from the psyche, and recognize that you are the creation and that there is Someone who have created you (…) then we have to train the five senses to concentrate them into God. We will change their direction: before, we served ourselves, now we will serve God. Stop serving that ego which had a beginning and will have an end at death. Our soul is eternal: it was before, is and it will be forever. Stop working for the ego that is so small, indistinctly from the intellectual capacity to achieve anything in life. (…) When we open the book, we realize that science has avoided many chapters in reading about the creation but, as devotees, we must read before the existence of the Creator. For what? To love the Creator. To love him, we must know him and to know him we must be good students. By understanding more what God is, more we understand God. God is no longer the bearded figure, that icon to which we cannot reach and begin to realize what God is. And so God exists everywhere, not because we have read about him, now, we have experienced him, we feel him in the depth of soul. Now we know why I should not hurt you, why I should not think badly of you, it is no longer something they have told us morally but we have realized spiritually.”

First, to remind you that you have to join God. The second, to give thank your Master, who offers his thoughts, his Word and his good intentions to your souls. And third, to express your love in the form of Devotion to your Master … Do your spiritual practices without any rest … Move forward, release your arms from the tree of ego and flow into the waters of the Ocean of Sweetness of your Lord.
