CASE 37-2017: Ven. LAMA LOBZANG

HONORABLE JURY OF INTERNATIONAL BUDDHIST ETHICS COMMITTEE (IBEC) & BUDDHIST TRIBUNAL ON HUMAN RIGHTS (BTHR)

After Legitimating and Validating Evidences and Charges by Master Maitreya, President and Spiritual Judge of IBEC-BTHR, it is addressed the case against the accused party Ven. Lama Lobzang. This investigation was initiated from the “Case State Sangha Maha Nayaka Committee of Myanmar”.

The Charges by which the International Buddhist Ethics Committee is accusing Ven. Lama Lobzang are enumerated below:

  • VIOLATION OF BUDDHIST LAW

 

Therefore, it is detailed a series of EVIDENCES that support the Charges referred so that the Jury members decide about the possible “Responsibility”, “Innocence” or “Insanity” of the accused. Such evidence come from graphic and audiovisual media that have been gathered, sorted and confirmed in their order and context as Means of Proof in order to know, establish, dictate and determine the Responsibility of the Accused for committing the aforementioned Charges.

The procedure established in the Statute of INTERNATIONAL BUDDHIST ETHICS  COMMITTEE & BUDDHIST TRIBUNAL ON HUMAN RIGHTS provides both bodies the ostentation to enjoy independence and liberty from state and national regulation and control, besides having the legality and acting as a Buddhist People in order to assert its customs, traditions, practices, procedures, judgments and rights as well as acting in pursuit of the development of Spirituality, of Buddhist Ethics, and of the defense of International Human Rights. This procedure has the particularity, singularity and distinction of having “Special Jurisdiction of the Tribal Law” and “Universal Jurisdiction of the International Law”, thus having the Character, Juridical validity, Legal Powers, infrastructure, Training and Capability necessary to be Actor, Administrator and Executor of Justice in this realm and exercise, by judging of the Accused by means of an Ethical Judgment whose Purpose is Truth, Reconciliation and Learning.-

Evidence 1: NOTIFICATION TO International Buddhist Confederation (IBC)

Buddhist Tribunal on Human Rights:Case No. 18/2016: State Sangha Maha Nayaka Committee (SSMNC – Ma Ha Na). On July 29, 2017, the International Buddhist Ethics Committee & Buddhist Tribunal on Human Rights is communicating with Lama Lobzang Secretary General of the International Buddhist Confederation (IBC) following the news that Dr. Bhaddanta Kumarabhivamsa (Chairman of the State Sangha Maha Nayaka Committee of Myanmar) is an IBC “Patron” member, being recognized by the IBC with the rank of “His Holiness”.  In the face of this terrible news, the International Buddhist Ethics Committee and Buddhist Tribunal on Human Rights informed the IBC that on August 23, 2016 the State Sangha Maha Nayaka Committee of Myanmar was sentenced for the serious crimes of FALSE BUDDHISM And VIOLATION OF THE BUDDHIST LEGAL CODE (VINAYA), OPPRESSION AND ILLEGAL DETENTIONS AGAINST BUDDHIST SANGHA, COMPLICITY WITH DISCRIMINATION, VIOLATION OF THE RIGHTS OF WOMEN AND CHILDREN, VIOLATION OF FREEDOM OF EXPRESSION, VIOLATION OF THE RIGHTS OF INDIGENOUS AND TRIBAL PEOPLES, CRIMES AGAINST HUMANITY AND PEACE, COMPLICITY WITH GENOCIDE AND ETHNIC CLEANSING.  Faced with this situation, Dr. Bhaddanta Kumarabhivamsa clearly has no ethical legitimacy to become a Patron Member of the IBC, which is why we officially request a response by Secretary General Lama Lobzang within the next 7 days to the Buddhist Tribunal and urgently initiate a Formal procedure in order to expel Dr. Bhaddanta Kumarabhivamsa, otherwise the IBC would be endorsing these crimes committed by the State Sangha Maha Nayaka Committee of Myanmar, which would be disastrous for the spiritual legitimacy of Buddhism at a global level. In case Secretary-General Lama Lobzang decides to ignore the Notification made by the Buddhist Tribunal on Human Rights, it will be considered an act of Complicity with the crimes committed by Dr. Bhaddanta Kumarabhivamsa, being a clear Violation of Buddhist Law. The International Buddhist Ethics Committee & Buddhist Tribunal on Human Rights requests the International Buddhist Confederation (IBC) all necessary support in this matter linked not only to violations of the Buddhist Ethics of the Sangha but also linked to violations of International Human Rights Law.”

 

Evidence 2: Legal Requirement to Spiritual Patrons of the International Buddhist Confederation (IBC)

Buddhist Tribunal on Human Rights:Case No. 18/2016: State Sangha Maha Nayaka Committee (SSMNC – Ma Ha Na). August 5th, 2017. Dear His Holiness the Dalai Lama Tenzin Gyatso, His Holiness Thich Pho Tue, His Holiness Master Jinje & His Holiness Sanghanayaka Sudhananda Mahathero, As a result of the lack of response by Lama Lobzang, Secretary General of the International Buddhist Confederation (IBC), to a formal Notification dated July 29, 2017 where he is requested to initiate a process of expulsion of the IBC Patron named “Dr. Bhaddanta Kumarabhivamsa” (Chairman of the State Sangha Maha Nayaka Committee of Myanmar), we inform Their Holinesses the terrible situation of violation of Buddhist Law that is being committed by the International Buddhist Confederation (IBC). The International Buddhist Ethics Committee & Buddhist Tribunal on Human Rights requests the immediate suspension and expulsion of the Patron “Dr. Bhaddanta Kumarabhivamsa” because this individual has been involved in genocidal activities and Crimes against Humanity in Myanmar, which constitutes not only a violation of Buddhist Law but also the worst violation of International Human Rights Law. Indeed, the State Sangha Maha Nayaka Committee of Myanmar was previously sentenced in 2016 as Responsible for the serious crimes of FALSE BUDDHISM and VIOLATION OF THE BUDDHIST LEGAL CODE (VINAYA), OPPRESSION and ILLEGAL DETENTIONS AGAINST BUDDHIST SANGHA, COMPLICITY WITH DISCRIMINATION, VIOLATION OF THE RIGHTS OF WOMEN AND CHILDREN, VIOLATION OF FREEDOM OF EXPRESSION, VIOLATION OF THE RIGHTS OF INDIGENOUS AND TRIBAL PEOPLES, CRIMES AGAINST HUMANITY AND PEACE, COMPLICITY WITH GENOCIDE AND ETHNIC CLEANSING.  Maintaining criminals within the Buddhist Community (Sangha) is an attack on the sacredness of the Spirituality founded by Siddhartha Gautama Buddha 2600 years ago. Therefore, the International Buddhist Ethics Committee & Buddhist Tribunal on Human Rights requests Their Holinesses to require Lama Lobzang to urgently initiate the suspension and subsequent expulsion of the Patron named “Dr. Bhaddanta Kumarabhivamsa “(Chairman of the State Sangha Maha Nayaka Committee of Myanmar), since this individual does not deserve to be a member nor a Patron of the International Buddhist Confederation (IBC). In case the Lama Lobzang continues to fail in his functions to maintain ethical and moral purity of the Great Buddhist Commune (Maha-Sangha), then we will be obliged to be faithful to Truth and Justice by ruling the Complicity of Lama Lobzang with violations of Buddhist Law and Human Dignity. Since you are Patrons of the International Buddhist Confederation (IBC), we urge Their Holinesses to advise Lama Lobzang to behave properly, following the most appropriate and correct standards of Buddhist Spirituality, which should never be involved in genocidal acts and international crimes violating Human Rights.”

 

Evidence 3: Resolution on Lama Lobzang – Secretary General of the International Buddhist Confederation (IBC)

Buddhist Tribunal on Human Rights:Case No. 18/2016: State Sangha Maha Nayaka Committee (SSMNC – Ma Ha Na). Sunday 13 August 2017. The International Buddhist Ethics Committee & Buddhist Tribunal on Human Rights,  Recalling the principles of Buddhist Law, human rights and fundamental freedoms established by international instruments, such as the Buddhist Legal Code (Vinaya) adopted by the spiritual commune (Sangha), the Universal Declaration of Human Rights adopted by the UN, and Universal Declaration on the Rights of Buddhist Peoples and Spiritual Communities adopted by the United Buddhist Nations Organization (UBNO); Whereas such rights and freedoms include political, economic, cultural and environmental rights, among which religious liberty and the supreme human right to peace are found; Aware that the Buddhist Nation possesses a spiritual distinction with regard to the rest of the international community, and this is not due to racial issues but to the possession of a higher ethic and a mission of Liberation of all beings that it should never be violated; Reaffirming the Sentences of the International Buddhist Ethics Committee and Buddhist Tribunal on Human Rights in the Case Ashin Wirathu, the Case Myanmar and the Case of the State Sangha Maha Nayaka Committee;  Deeply concerned about the systematic and widespread situation of human rights violations occurring in Myanmar through military regimes and democratic governments that persecute the Rohingya People, subjecting hundreds of thousands of people to an oppressive situation of Genocide, Ethnic Cleansing and Crimes against humanity, as demonstrated in the jurisprudence of the International Buddhist Ethics Committee and Buddhist Tribunal on Human Rights; Deploring that this terrible situation of violation of human rights in Myanmar is supported by corrupt bhikkhus grouped in the State Sangha Maha Nayaka Committee (SSMNC – Ma Ha Na), who have been sentenced for the serious crimes of FALSE BUDDHISM and VIOLATION OF BUDDHIST CODE (VINAYA), OPPRESSION AND ILLEGAL DETENTIONS AGAINST BUDDHIST SANGHA, COMPLICITY WITH DISCRIMINATION, VIOLATION OF THE RIGHTS OF WOMEN AND CHILDREN, VIOLATION OF FREEDOM OF EXPRESSION, VIOLATION OF THE RIGHTS OF INDIGENOUS AND TRIBAL PEOPLES, CRIMES AGAINST HUMANITY AND PEACE, COMPLICITY WITH GENOCIDE AND ETHNIC CLEANSING; Taking into consideration that the International Buddhist Confederation (IBC) has Dr. Bhaddanta Kumarabhivamsa (Chairman of the State Sangha Maha Nayaka Committee of Myanmar) as its Spiritual Patron, and that the IBC has not responded to the legal requirements and notifications produced by the Buddhist Tribunal on Human Rights where it is urgently requested the expulsion of Bhaddanta Kumarabhivamsa; Examining that the intent of Lama Lobzang Secretary General of the IBC to ignore this serious violation of human rights, as IBC Spiritual Patrons were previously advised, constitutes an act of Complicity with violations of Buddhist Law, since the State Sangha Maha Nayaka Committee of Myanmar has participated in the worst crimes that can be committed in Buddhist Law: murder (manussaviggaha), which is a reason for immediate expulsion within the Buddhist Commune (Sangha); Bearing in mind that the International Buddhist Ethics Committee and Buddhist Tribunal on Human Rights initiated a legal case against the WORLD PEACE PRIZE AWARDING COUNCIL, since this institution gave a Peace Prize to Dr. Bhaddanta Kumarabhivamsa, which would constitute a possible Act of Complicity with Crimes against Peace; Expressing concern at the fact that this criminal False Buddhism propagated in Myanmar, Sri Lanka and Thailand, which conveys fascist visions and contrary to the pacifist principles taught by Gautama, is being supported by one of the most important organizations of Buddhism around the world, as is the IBC, which constitutes a Violation of Buddhist Law by Lama Lobzang; States that the Buddhist Spirituality is the first movement in the history of humanity that regulated the practice and theory of the human rights as a defense of the intrinsic dignity or dharmic nature of beings. Recommends that IBC not to depend on government funds, since it corrupts the independence of the spiritual commune (sangha) and links it to corrupt political interests. Calls on the IBC to immediately cancel the condition of Spiritual Patron held by Dr. Bhaddanta Kumarabhivamsa (Chairman of the State Sangha Maha Nayaka Committee of Myanmar), also requesting that it ceases to be called with the rank of “His Holiness” to someone who has participated in the most terrible crimes of International Law. Solemnly stipulates that any kind of violence in the realm of thought, word or acts is completely contrary to Buddhist Law, so that both criminals who commit these acts as well as those who are accomplices and endorse these immoral and illegal behaviors will be punished. Expresses that any spiritual recognition to whatsoever Peace Prize delivered to Dr Bhaddanta Kumarabhivamsa is illegal and immoral. Declares that the State Sangha Maha Nayaka Committee of Myanmar must be immediately closed for having participated directly or indirectly in Genocide, Crimes against Humanity and Crimes against Peace, having the duty to create a new organization that is not an accomplice of the human rights violations committed by the government of Myanmar, thus providing justice and purity to both people and the governors. Calls upon all the members of the Buddhist International Community (Maha-Sangha) not to abandon the Path of Righteousness, Detachment and Compassionate Wisdom developed by Gautama two thousand six hundred years ago.”

 

Evidence 4: Proclamation on Dhamma Vansanurakhitta Association – Buddha Dhamma Charity Foundation

Buddhist Tribunal on Human Rights:CASE 01-2015: Ashin Wirathu. November 13, 2017. The International Buddhist Ethics Committee and Buddhist Tribunal on Human Rights, Considering that in Case 01-2015 the International Buddhist Ethics Committee sentenced Ashin Wirathu and the 969 Movement for the crimes of Discrimination, Social Segregation, Apology of Violence and False Buddhism; Recalling that due to international pressure the State Sangha Maha Nayaka Committee superficially sanctioned the 969 Movement, only generating that this Islamophobic group changed its name to Ma Ba Tha (Organization for the Protection of Nationalism and Religion); Aware that Ma Ba Tha and the State Sangha Maha Nayaka Committee have actively assisted and collaborated with the Myanmar military regime led by former de facto President Thein Sein, actively supporting the Genocide, Ethnic Cleansing and Crimes against humanity against the Rohingya People; Deeply concerned because Myanmar’s new civil-military government led by de facto president Aung San Suu Kyi is worsening and continuing the genocidal policies against the Rohingya people in the eyes of the entire world, carrying out High Crimes against Peace; Deploring the fact that de facto president Aung San Suu Kyi carries out acts of Negationism, not only affirming that there is no kind of genocide, but also accusing the Rohingya people of terrorism; Analyzing that even the UN, through the Office of the High Commissioner for Human Rights (OHCHR), has denounced terrible human rights violations committed by the government of Myanmar against the defenseless civilian population, such as torture, mass sexual abuses, forced disappearances and extrajudicial executions of children and babies, all of which is considered by Aung San Suu Kyi as fake news; Taking into consideration that the State Sangha Maha Nayaka Committee presided over by Bhaddanta Kumarabhivamsa was sentenced for False Buddhism and Violation of the Buddhist Legal Code, Oppression and Illegal Detentions against the Buddhist Sangha, Complicity with Discrimination, Violation of the rights of women and children, Violation of freedom of expression, Violation of the rights of indigenous and tribal peoples, Crimes against Humanity and Peace, and Complicity with Genocide and Ethnic Cleansing; Examining that Bhaddanta Kumarabhivamsa of the State Sangha Maha Nayaka Committee has received a Peace Prize from the criminal organization called WORLD PEACE PRIZE AWARDING COUNCIL (WPPAC), reason why the institution has been sentenced for the charges of Complicity with Crimes against Peace, Complicity with Violations of Buddhist Cultural Heritage, Defamation, Discrimination and Ethnocentrism, Threats and Violation of Human Rights, Corruption, Fraud and Organized Crime and Complicity with Genocide and Islamophobia; Bearing in mind that Lama Lobzang of the International Buddhist Confederation (IBC) has been asked to remove the status of Patron to Bhaddanta Kumarabhivamsa and to expel this individual for his international crimes, something that has been disobeyed by Lama Lobzang despite the warning that this would imply a violation of Buddhist Law; Expressing consternation at the fact that the extermination plan against the Rohingya People is still happening, with thousands of children and women killed, while the international community has not yet demanded Aung San Suu Kyi to stop her international crimes; Reaffirming the critique against the genocidal role of Buddhist Bhikkhus controlled by the government of Myanmar, among whom one can find Ashin Wirathu and the State Sangha Maha Nayaka Committee presided over by Bhaddanta Kumarabhivamsa, being preachers of hatred, apartheid and genocide; Confirming the fact that due to the Judgment of the Buddhist Tribunal, the State Sangha Maha Nayaka Committee has banned the Ma Ba Tha group, although it has not banned its Islamophobic ideology, which is why Ma Ba Tha continues to exist under the name of the Dhamma Vansanurakhitta Association or Buddha Dhamma Charity Foundation; It is expressed absolute solidarity with the millions of innocent lives of the Rohingya People that are being systematically and widespreadly annihilated by the illegal government of Myanmar, being persecuted, stigmatized, discriminated, dehumanized, violated, segregated, raped and exterminated in a way as evil as the Holocaust carried out by Nazi regime. It is stated that the Dhamma Vansanurakhitta Association or Buddha Dhamma Charity Foundation is responsible for Complicity with Genocide, Ethnic Cleansing and Crimes against Humanity, and Violation of the Buddhist Law and Human Rights. It is declared that Lama Lobzang will be judged for Violation of Buddhist Law. It is manifested that people like Ashin Wirathu, who exist in Myanmar, Sri Lanka and Thailand, are destroying Buddhism through character assassination, attacking the intrinsic dignity of Spirituality. This Ethical Proclamation is invoked as an act of justice in the face of violations of Buddhist Law and Human Rights carried out by Ashin Wirathu, the State of Myanmar and the State Sangha Maha Nayaka Committee. It is recalled once again that the Buddhist Path is the Salvation of humanity and of the world through spiritual love.”
