REIKI JAEN ASSOCIATION
HONORABLE JURY OF THE INTERNATIONAL BUDDHIST ETHICS COMMITTEE (IBEC) & BUDDHIST TRIBUNAL ON HUMAN RIGHTS (BTHR)
P R E S E N T . –
In the presence of the President and Spiritual Guide of IBEC-BTHR Buddhist Master Maitreya and the Prosecutor IBEC-BTHR Master Yan Maitri-Shi, it is addressed the case denounced by the World Association of Buddhism (WBA) against the REIKI JAEN ASSOCIATION for the following 7 Charges: 1. SLANDER AND LIBEL, 2. THREATS AND DISCRIMINATION, 3. VIOLATION ON THE HUMAN RIGHT TO EDUCATION, 4. VIOLATION OF HUMAN RIGHT TO RELIGIOUS FREEDOM, 5. FALSE SPIRITUALITY AND FALSE ZEN, 6. VIOLATION ON THE HUMAN RIGHT TO PEACE, and 7. INTOLERANCE.-
I, Sekkha Dhamma, as Prosecutor IBEC and BTHR, recognize the hard and organized work that was done for the wide collection of Evidence in this case; similarly, I appreciate the contribution of them for the analysis concerning the Party that I represent. That said, with all due respect I appear to expound:
Received the list of digital media that were collected, sorted and simultaneously confirmed in their order and context as Evidence by the Prosecutor of IBEC and BTHR Master Yan Maitri-Shi, I give way to the Fourth Stage of the Procedure called “EVALUATION OF EVEDENCE” which stated in the Constitutive Act of IBEC and BTHR in order to know, establish, dictate and determine the Responsibility of the Accused for the commission of the above Charges. This Accusation was made by the WORLD ASSOCIATION OF BUDDHISM in the field of Buddhist Ethics, an act that follows below:
EVALUATION OF EVIDENCE
FIRST EVALUATION – Being the core of this procedure, it is necessary to point out the Means of Proof offered by the Prosecutor of IBEC and BTHR Master Yan Maitri-Shi, and formally present them to the Jury for their knowledge. The Means of Proof are composed of 7 Charges and 10 Evidences that validate the motivating Accusation of the current process. The above is denounced from the field of Buddhist Ethics. These evidences come from audiovisual means in the public domain (media) which are listed below:
EVIDENCES
Evidence 1: FALSE ACCUSATION AND ATACK ON ADVANCED SPIRITUAL EDUCATION
Reiki Jaen Association: “Master Mikao Usui is a master who in his Buddhist spiritual practices reached the enlightment. Reiki is his legacy. It is a direct transmission from master to apprentice. If the chain is broken, one does not have the strength of the master. Direct transmission is studied in Buddhism; I see you do not know about Buddhism. If you do not have a direct transmission from the Master, you have only theory and the little you get with your meditation. You cannot offer Reiki degrees without the spiritual connection to Mikao Usui. I see that you have no knowledge of Reiki. This is what is called a scam.” (November 25, 2015)
Evidence 2: INSULTS, THREATS AND ATTACKS ON BUDDHISM
International Buddhist Ethics Committee: Despite the fact that MBU never claims to teach in a state-official way, but openly claims it is a Spiritual School of non-governmental and transnational Education, the Reiki Jaen Association has committed attack because of its discriminative vision. It has also been attacked the right to teach Reiki of the MBU, even though its tutors in charge have trainings and certifications in this field. Despite the lack of knowledge about Buddhism, Reiki Jaen Association has attacked the legitimacy of the World Association of Buddhism.
Reiki Jaen Association: “You are the ones that should be careful. You offer “PhDs” of academic degrees endorsed by the university or by certain advanced technical schools, after performing and publicly defend the doctoral thesis or set of studies required to achieve this degree. You are not recognized by any official Buddhist institution. You are not recognized by any ministry of education in any country as “university”. Your emails have neither a language of a person skilled in Buddhism nor a language of a university administration. Your name “university” misleads and confuses. And that is termed as scam. You lead international organizations about Buddhism: Wanting to replace with a name very similar to a recognized organization to bring economic benefit is a scam. You use the name “World Association of Buddhism” which seems to supplant the name of the World Fellowship of Buddhists.
It’s not appropriate for a serious University to search students by email. Or fail to publicize their facilities with photos, hide their members under false names or not advertise the academic training of its senior managers and teaching staff. Regarding Reiki I don’t even want to speak. Because you lack all knowledge and lineage. And the only thing you have done is a hotchpotch of all kinds of things to catch four incautious and take their money away with a handful of old lecture notes of different styles of Buddhism, socialism, anarchism, etc. For me, honestly, you are a gang of interested and ignorant. And I don’t have ethics committee but I know about the cybercrimes unit of the Interpol that maybe needs to talk with you about your activities. If someone mentions me that you are trying to sell your unofficial online courses disguised as official titles “PhDs”. Or that you teach courses of Reiki without being initiated in the direct line of master Usui, I report you to the Interpol. The scam, intrusiveness and deception create bad karma, Buddhist brothers and are persecuted by law. And you can’t be vice-rector because associations have no such title, nor are you master (no one has given you a master level) nor your name is Yan Maitri-Shi. You are just a group of friends who have self-proclaimed teachers and university rectors. Perhaps you not even have finished your studies” (November 27, 2015)
Evidence 3: FALSE ZEN
USING OF BUDDHIST PRACTICES AND SYMBOLS IN ORDER TO BE SPIRITUALLY REVALIDATED
International Buddhist Ethics Committee: It has been detected the presence of members of the Association who acclaim to have “Zen” training albeit they do not meet the ethical conduct required by this ancient Buddhist tradition.
Evidence 4: ABSENCE OF REPENTANCE AND NEW ATACKS AGAINST THE INTERNATIONAL BUDDHIST ETHICS COMMITTEE
International Buddhist Ethics Committee: In February 2016 it has been given the opportunity to Reiki Jaen Association in order to reach a peaceful and reconciliatory resolution that includes eliminating its attacks, but performing also a publicly apology, given that the slanders were published for more than 2 months. The Reiki Jaen Association agreed to delete the slanders, but violently refused to publicly apologize, incurring insults and threats again, by attacking the right to education and the right to ethical institutions that Buddhism has.
Reiki Jaen Association: “I have deleted the article that talked about you that consisted in our emails and my personal opinion. You could be investigated at a police, journalistic and fiscal level, so do not disturb our partners with your threats. Because I already have forgotten you and I hope you do the same. (…) What tribunal? You are not recognized by anything official. I have a lot of work. Forget us and do not bother the other people of my association who have nothing to do. In me there is nothing of repentance of course and don’t continue with foolishness because the one who will sue you in a true court is gonna be me. Leave the harassment of our partners and stop beating us. You do not exist for me and I don’t want to know more about you.” (February 22, 2016)
Reiki Jaen Association: “You wrote to my email without solicit, I argue with you and I put our discussions on my website. (Already deleted) I have already given communication to my association that has nothing to do with it. I repeat again that this is my personal opinion and has nothing to do with Reiki Jaen Association. Do not ever bother Reiki masters of our association who have nothing to do. It is the second time I tell you. Prove to me that you are an official university, show me that you can issue official university degrees supported by a ministry of education, prove to me that you are qualified to teach in both Reiki theory, initiation, and in practice. And I’ll think to excuse myself. Tell me, what Universities and Tribunals use public email addresses? Stop kidding me. Several members who are already talking to lawyers are nervous because of you. I’m responsible for all this and it is only with me that you have to talk or threatening. I’ll tell you again: Forget that we exist. Go your way and I’ll go mine. (…) I think you are missing something. This is just between you and me. Stop disturbing others that have nothing to do Mexican, you don’t even show up with your real name. But not for that you are less responsible in all this. (…) You don’t want forget, so I will take legal action. Now you’re going too far with the joke and harassment. (…) I ask the name of your organization, where it is legally registered, data and numbers, and real names of its board members together with their identification number of your country. I can’t denounce people hidden in false names.” (February 23, 2016)
Reiki Jaen Association: “It has been requested to all our members to configure their mail so that your emails be forwarded to their spam folders. Not all of them belong to the association and there is no reason to disturb them. You should remit the norm by which a person who does not answer is guilty of something. You must also demonstrate that it has been read your mail. Emails received to this email will be sent directly to our lawyers. On our part there will be no more communication. Our lawyers will maintain contact with the Argentine authorities in case there is evidence of a crime by your side.” (February 24, 2016)
Evidence 5: INDIFFERENCE FROM MEMBERS OF REIKI JAEN ASSOCIATION
International Buddhist Ethics Committee: In February 2016 the International Buddhist Ethics Committee communicated with all members of the Reiki Jaen Association. None of them apologized for the attacks of their Association, showing indifference and silent complicity.

Luis Quirós Delgado: “I have nothing to do with this issue” (February 22, 2016)
Mercedes Serrano Callejas: “Good day. I belong to the Reiki Jaen association but I am not responsible neither I take responsibility for the opinions of my fellows. I am a free spirit that to date of today have learned to be only responsible for what I say and what I do. I respect to everyone as far as possible and although I do not agree with certain doctrines, I know I can’t change the world. All this seems very strong to me, neither have I read it at that time nor will I read the declarations that my colleague did at that time. I find it incredible that I’m stuck in this controversy without having to do anything with it.” (February 23, 2016)
Evidence 6: CORROBORATION THAT THE ATTACKS WERE PERPETRATED BY THE REIKI JAEN ASSOCIATION
International Buddhist Ethics Committee: Although it seems paradoxical having to do it, faced with the testimonial Declaration that the Association is not responsible for the attacks and that they were made in a personal capacity, below it can be found a list of evidences that demonstrates that the attacks were indisputably performed by the Association.
- The emails with the attacks were sent from the official email of Reiki Jaen Association: info@reikijaen.es
- The emails with the attacks bear the signature: “Asociación Reiki Jaén REIKI – REGISTROS AKASHICOS – RECONEXIÓN – CONSTELACIONES FAMILIARES – YOGA – UN CURSO DE MILAGROS Jaén – Alcalá la Real – Andújar – Baeza – Bedmar – Los Villares – Mancha Real – Martos Córdoba – Priego de Córdoba Granada – Lanjarón – Motril reikijaen.es Tel: 657 584 872”
- The defamations were published on the oficial web of Reiki Jaen Association, including a Copyright seal of the same Association
- The enormous amount of emails they sent have no signature of any member or specific individual, but only the signature of Reiki Jaen Association
Evidence 7: INTOLERANCE
Declaration of Principles on Tolerance (UNESCO November 16, 1995): Article 1 Meaning of tolerance: 1.1 Tolerance is respect, acceptance and appreciation of the rich diversity of our world’s cultures, our forms of expression and ways of being human. It is fostered by knowledge, openness, communication, and freedom of thought, conscience and belief. Tolerance is harmony in difference. It is not only a moral duty, it is also a political and legal requirement. Tolerance, the virtue that makes peace possible, contributes to the replacement of the culture of war by a culture of peace. 1.2 Tolerance is not concession, condescension or indulgence. Tolerance is, above all, an active attitude prompted by recognition of the universal human rights and fundamental freedoms of others. In no circumstance can it be used to justify infringements of these fundamental values. Tolerance is to be exercised by individuals, groups and States. 1.3 Tolerance is the responsibility that upholds human rights, pluralism (including cultural pluralism), democracy and the rule of law. It involves the rejection of dogmatism and absolutism and affirms the standards set out in international human rights instruments. 1.4 Consistent with respect for human rights, the practice of tolerance does not mean toleration of social injustice or the abandonment or weakening of one’s convictions. It means that one is free to adhere to one’s own convictions and accepts that others adhere to theirs. It means accepting the fact that human beings, naturally diverse in their appearance, situation, speech, behavior and values, have the right to live in peace and to be as they are. It also means that one’s views are not to be imposed on others. (…)2.3. It is essential for international harmony that individuals, communities and nations accept and respect the multicultural character of the human family. Without tolerance there can be no peace, and without peace there can be no development or democracy. 2.4. Intolerance may take the form of marginalization of vulnerable groups and their exclusion from social and political participation, as well as violence and discrimination against them. As confirmed in the Declaration on Race and Racial Prejudice, ‘All individuals and groups have the right to be different’ (Article 1.2). (…) 3.2 Tolerance is necessary between individuals and at the family and community levels. Tolerance promotion and the shaping of attitudes of openness, mutual listening and solidarity should take place in schools and universities and through non-formal education, at home and in the workplace. The communication media are in a position to play a constructive role in facilitating free and open dialogue and discussion, disseminating the values of tolerance, and highlighting the dangers of indifference towards the rise in intolerant groups and ideologies. 3.3 As affirmed by the UNESCO Declaration on Race and Racial Prejudice, measures must be taken to ensure equality in dignity and rights for individuals and groups wherever necessary. In this respect, particular attention should be paid to vulnerable groups which are socially or economically disadvantaged so as to afford them the protection of the laws and social measures in force, in particular with regard to housing, employment and health, to respect the authenticity of their culture and values, and to facilitate their social and occupational advancement and integration, especially through education (…)Article 4 – Education 4.1 Education is the most effective means of preventing intolerance. The first step in tolerance education is to teach people what their shared rights and freedoms are, so that they may be respected, and to promote the will to protect those of others. 4.2 Education for tolerance should be considered an urgent imperative; that is why it is necessary to promote systematic and rational tolerance teaching methods that will address the cultural, social, economic, political and religious sources of intolerance – major roots of violence and exclusion. Education policies and programmers should contribute to development of understanding, solidarity and tolerance among individuals as well as among ethnic, social, cultural, religious and linguistic groups and nations. 4.3 Education for tolerance should aim at countering influences that lead to fear and exclusion of others, and should help young people to develop capacities for independent judgment, critical thinking and ethical reasoning. 4.4 We pledge to support and implement programmers of social science research and education for tolerance, human rights and non-violence. This means devoting special attention to improving teacher training, curricula, the content of textbooks and lessons, and other educational materials including new educational technologies, with a view to educating caring and responsible citizens open to other cultures, able to appreciate the value of freedom, respectful of human dignity and differences, and able to prevent conflicts or resolve them by non-violent means.”
EVIDENCE 8: VIOLATION ON THE HUMAN RIGHT TO PEACE (Rights of the victims)
Santiago Declaration on the Human Right to World Peace: “Article 11. Rights of all victims. (…) .- Every victim of a human rights violation has the right, in accordance with international human rights law, to the restoration of the violated rights; to obtain effective and complete redress, including the right to rehabilitation and compensation; measures of symbolic redress or reparation as well as guarantees that the violation will not be repeated. Such redress shall not preclude recourse to popular courts or tribunals of conscience and to institutions, methods, traditions or local customs of peaceful settlement of disputes, which may be acceptable to the victim as adequate reparation.” (December 2010)
EVIDENCE 9: VIOLATION ON THE HUMAN RIGHT TO PEACE (Freedom of thought, opinion, expression, conscience and religion)
Santiago Declaration on the Human Right to Peace: “Article 8. Freedom of thought, opinion, expression, conscience and religion. 1.- All peoples and individuals have the right to access and to receive information from diverse sources without censorship, in accordance with international human rights law, in order to be protected from manipulation in favor of warlike or aggressive objectives. 2.- All peoples and individuals have the right to denounce any event that threatens or
violates the human right to peace, and to freely participate in peaceful political, social and cultural activities or initiatives for the defence and promotion of the human right to peace, without interference by governments or by the private sector. 3.- All peoples and individuals have the right to be protected against any form of cultural violence. To this end, persons should fully enjoy their freedom of thought, conscience, expression and religion, in conformity with international human rights law.”(December 2010)
EVIDENCE 10: VIOLATION ON THE HUMAN RIGHT TO EDUCATION
Declaración de Naciones Unidas sobre los Derechos de los Pueblos Indígenas: “Article 14. 1. Indigenous peoples have the right to establish and control their educational systems and institutions providing education in their own languages, in a manner appropriate to their cultural methods of teaching and learning. 2. Indigenous individuals, particularly children, have the right to all levels and forms of education of the State without discrimination. 3. States shall, in conjunction with indigenous peoples, take effective measures, in order for indigenous individuals, particularly children, including those living outside their communities, to have access, when possible, to an education in their own culture and provided in their own language. Article 15. 1. Indigenous peoples have the right to the dignity and diversity of their cultures, traditions, histories and aspirations which shall be appropriately reflected in education and public information.
SECOND EVALUATION.- Of the evidence provided there is no doubt about their authenticity considering their origin, each compiled evidence comes from email conversations as well as publications and internet advertising forming the evidence. Regarding the proofs offered and that support the aforementioned Charges, there is no objection, disqualification or invalidation of digital content by the Party which I represent, by virtue of which they are digital media coming from reliable sources and also declared and published at that time of formally and openly, which are full, true and accurate proof.
The Procedure established in the Statutes of INTERNATIONAL BUDDHIST ETHICS COMMITTEE & BUDDHIST TRIBUNAL ON HUMAN RIGHTS in its Article 13 highlights the two Bodies to enjoy independence and liberty from state and national regulation and control, besides having the legality and acting as Buddhist People in order to assert their customs, traditions, practices, procedures, judgments and rights, as well as acting in pursue of the development of Spirituality, of Buddhist Ethics, as well as the defense of International Human rights. This procedure has the particularity, uniqueness and distinction of having “Special Jurisdiction of the Tribal Law” and “Universal Jurisdiction of the International Law”, thus having the Nature, Juridical Personality, Legal Powers, infrastructure, Skills and Training needed to be Actor, Administrator and Executor of Justice in this field and exercise, being determined the “Responsibility” of the Accused in Trial having as its purpose the Truth, Reconciliation and Learning.-
THIRD EVALUATION.- Due to what was expounded, published and declared and that is now presented as digital Proof for this Case by the Prosecutor of IBEC and BTHR Master Yan Maitri-Shi, these evidences are determined as LEGITIMATE and VALID by the Party that I represent as Prosecutor of IBEC and BTHR. These proofs support and confirm the Accusation presented by the World Association of Buddhism against REIKI JAEN ASSOCIATION for 7 Charges against it.-
In such a situation, it is begun the Fifth Stage of the Procedure called the “JUDGMENT”, in which it is given the term of 5 five days to Jury Members in order to decide whether the Accused is “Innocent” or “Responsible” for the Charges against him / her / it concerning the Evidence provided, accepted and evaluated in this writing.-
