LEGAL ACT ON Wan Ko Yee and Bhaddanta Kumarabhivamsa

On August 25, 2017, an Act of International Approval was written in response of the warm and humble answer of Dr Han Min Su, co-founder of the WORLD PEACE PRIZE AWARDING COUNCIL (WPPAC), who responded to the Ethics Committee’s Judgment by expressing interest on the possibility that the International Buddhist Ethics Committee and Buddhist Tribunal on Human Rights operates as a supervisory and adviser Committee to provide guidance to the World Peace Prize Awarding Council (WPPAC) in order to prevent that possible peace prizes are incorrectly given in the future.

However, Dr Han Min Su and the members of WPPAC are again reminded that they are not appropriately responding concerning the annulment of the peace prize given to Bhaddanta Kumarabhivamsa, who is the chairman of the State Sangha Maha Nayaka Committee, an organization which was judged for crimes against humanity and complicity with genocide in Myanmar. On multiple occasions the International Buddhist Ethics Committee has declared the absolute nullity of the peace prize given to Bhaddanta Kumarabhivamsa, although the WPPAC has only decided to respond to a possible annulment of the award given to Wan Ko Yee (who uses the alias H.H. Dorje Chang Buddha III).

It is therefore confirmed that if the WPPAC annuls both illegitimate prizes given over to Wan Ko Yee and Bhaddanta Kumarabhivamsa, who respectively are responsible for fraud and crimes against peace, then the International Buddhist Ethics Committee may establish a link of ethical guide with WPPAC in future nominations. But the WPPAC must urgently understand the fact that these charges are very serious, since the criminal activities in which Bhaddanta Kumarabhivamsa has participated as President of the State Sangha Maha Nayaka Committee constitute a complete violation of International Law and the Human Right to Peace. There is something far more terrible than Evil: the fact that Evil is rewarded as if it were Goodness. Thus, WPPAC should attempt to remedy this error as urgently as possible. In case this injustice is resolved, it will prove to the whole world that the WPPAC does not agree with the crimes committed by Wan Ko Yee and Bhaddanta Kumarabhivamsa. Although, in case of maintaining and not canceling the prizes awarded to both criminals, then the WPPAC would be accepting to be an accomplice of crimes against peace.

If WPPAC is faithful to the ideals of World Peace and decides to annul the awards given to Wan Ko Yee and Bhaddanta Kumarabhivamsa, then the willingness of the International Buddhist Ethics Committee to provide spiritual guidance for future nominations is hereby recorded, also offering full scholarships for all WPPAC members so that they can access advanced compassionate wisdom. For instance, we can gladly offer completely free scholarships for the PhD in Peace Education to all WPPAC members.

We hope that the WPPAC is able to learn from its mistakes and that these diplomatic contacts are the beginning of a true friendship relationship.

Judgment on World Peace Prize Awarding Council

 

Case No. 29/2017: WORLD PEACE PRIZE AWARDING COUNCIL

 

ETHICAL JUDGMENT

Dear Prosecutor, Public Defender, Ambassador and Jury Members of the International Buddhist Ethics Committee (IBEC) and Buddhist Tribunal on Human Rights (BTHR), regarding the Case 29-2017 against the “WORLD PEACE PRIZE AWARDING COUNCIL”, on 21 August 2017, it is hereby recorded that the Ethics Committee’s trial has concluded in order to analyze the violation of Buddhist Ethics and Human Rights committed by the accused. This Case has been carried out as a result of the “Case State Sangha Maha Nayaka Committee”.

After analyzing the presentation of the Case and the validation of evidence, it has proceeded with the vote of 5 members of the Jury, confirming that there were 1 vote of “Insanity” and 4 votes sentencing “WORLD PEACE PRIZE AWARDING COUNCIL” as “Responsible” for the serious crimes of Complicity with Crimes against Peace and Complicity with Violations of Buddhist Cultural Heritage. Not only has the “WORLD PEACE PRIZE AWARDING COUNCIL” ignored the claims of the Buddhist Tribunal on Human Rights to override the Peace Prize awarded to the President of the “State Sangha Maha Nayaka Committee”, but it has also awarded a Peace Prize to a scammer who illegitimately usurps the Buddhist Cultural Heritage, deceiving lots of people with an alleged possession of spiritual status in order to sell paintings at huge cost. In this way, both Peace Prizes are spurious and illegal, because while one of the prizes provides an ethical endorsement on Bhaddanta Kumarabhivamsa, who has participated in international crimes against peace, on the other hand, Wan Ko Yee, who is a scammer using the alias of “H.H. Dorje Chang Buddha III”, has also been awarded with another ethical endorsement. Thus, the International Buddhist Ethics Committee has implemented the jurisprudence used in the “Case UNESCO Association of Malaga”, the “Case Yoga Beer”, the “Case Norwegian Nobel Committee” and the “Case UNESCO”, considering that both prizes are complicit in crimes against Peace and complicit of violation to the Buddhist Cultural Heritage.

These acts demonstrate that the members of the “WORLD PEACE PRIZE AWARDING COUNCIL” are not practicing the Right and Adequate Peace (Samma-Santi). Although evidently they have given prizes to people who deserve this recognition in the past, the evidence is very clear regarding the illegality of the Peace Prizes given to Bhaddanta Kumarabhivamsa and Wan Ko Yee (“H.H. Dorje Chang Buddha III”). Both are disastrous awards, because they endorse criminal acts such as Genocide and Scam, and both situations being violations of International Law and also of Buddhist Law. Thus, the members of the “WORLD PEACE PRIZE AWARDING COUNCIL” have forgotten their supreme duty for the defense of peace, ethically endorsing criminals who use this recognition to continue perpetrating crimes.

Therefore, the Maitriyana Community offers this Ethical Judgment for the “PEACE PRIZE AWARDING COUNCIL” as a way of teaching on the Righteous and Adequate Peace (Samma-Santi), so that this international organization quickly abandons its immoral behavior. If the “WORLD PEACE PRIZE AWARDING COUNCIL” is able to learn quickly from this Ethical Judgment and cancels the Peace Prizes given to Bhaddanta Kumarabhivamsa and Wan Ko Yee (“H.H. Dorje Chang Buddha III”), then the International Buddhist Ethics Committee will consider that a post-sentence reconciliation agreement has been reached, and then the charges will be annulled after having fulfilled the Purpose of Buddhist Law: the learning of good and rectification of bad behavior. Even, if this possible rectification or purification could occur in the future, the International Buddhist Ethics Committee could also offer unconditional ethical guidance for the election of future receivers of Peace Prizes. Because in 2003 the “WORLD PEACE PRIZE AWARDING COUNCIL” recognized Gandhi with a Peace Prize, something that even the Norwegian Nobel Committee failed to do, the International Buddhist Ethics Committee hopes that in the future this Vision about Adequate Peace (Samma-Santi) will be recovered, always recalling that it is better to honor the guides of the past than to honor the criminals of the present.

Although Gandhi had ethical flaws in his personal life and in his vision of social justice in India, the Maitriyana acknowledges him as a great follower and practitioner of the Path of Peace (Santi-marga) created by Gautama, teaching that only the Power of ethical purification, Truth and Spiritual Love can triumph in the inner and outer world in the face of the conflicts of life. For this reason, the Free and Enlightened Beings (Arhats-Bodhisattvas) have the ability to self-sacrifice for the good of all beings.

The Buddhist Law has the idea of creating a global community based on the essential values of world peace, social justice, advanced education and environmental health. This Way of life helps to safeguard what is most important in the history of humanity. However, it is required the commitment to act in accordance with the teachings of the great spiritual masters and social activists, such as Gautama and Gandhi, who have clearly defined the question of peace in order that it be never distorted. Although the capitalist civilization and the United Nations have certainly failed in the mission of creating an international community of peace, the Maitriyana confirms that real and efficient ethical leadership will never come from governments but rather will come from original cultural traditions such as Tribal Peoples and Spiritual Communities, who have contributed to a peaceful, just, wise and compassionate world for thousands of years. These Peoples and Communities mostly continue to exist independently of the authority in power, so they tend to be less corrupted. In effect, when Tribal Peoples and Spiritual Communities do not make an ethical critique of political powers, then the probabilities of corruption and benefit to a few are strengthened. Since the political leaders cannot meet the requirements of ethical leadership for humanity, then this vacant task must be filled by those who are empowered by Truth and Liberty, calling upon all nations to unite in a higher project of life that obliges to solve the problems of the world in the present time and simultaneously to have clear the goal of evolution in the horizon. Therefore, the Buddhist Law defends the idea of the human right to peace, but above all defends the supreme human right to evolution, whose historical driving force has been liberty, equality and fraternity.

In conclusion, the International Buddhist Ethics Committee has the Purpose (Dharma) to guide the international community by means of True Peace, which implies a direct criticism of organizations that support a distorted vision of Peace. Therefore, it is established that the “WORLD PEACE PRIZE AWARDING COUNCIL” is violating the human right to peace by ethically endorsing or awarding individuals who commit crimes, especially by rewarding individuals who violate the Buddhist Law. Undoubtedly, the Peace Prizes should be aimed at individuals and organizations deserving such honor, and should never be aimed at those who commit crimes and attack Peace. World Peace is a Supreme Purpose (Dharma) that should never be associated with criminals; otherwise humanity would lose faith in a better world. Only by practicing the Path of True Peace, as practiced by many social activists in history, the organizations will be able to properly recognize those who are worthy of Peace Prizes. In this way, the Case on the “WORLD PEACE PRIZE AWARDING COUNCIL” is a great teaching for solidarity and truth to prevail, instead of injustice and deception that oppress the intrinsic dignity of human being.

Following the Path of Master Gautama, who developed a Righteous and Adequate Path of Peace (Samma-santi-marga) at a global level, the International Buddhist Ethics Committee supervises national and international organizations to be righteous, just and ethical, never betraying the Commitment to World Peace, reason by which it has judged the “WORLD PEACE PRIZE AWARDING COUNCIL” as “Responsible” for Complicity with Crimes against Peace and Complicity with Violations of Buddhist Cultural Heritage.

HONORABLE JURY OF INTERNATIONAL BUDDHIST ETHICS COMMITTEE (IBEC) & BUDDHIST TRIBUNAL ON HUMAN RIGHTS (BTHR)

After Legitimating and Validating Evidences and Charges by Master Maitreya, President and Spiritual Judge of IBEC-BTHR, it is addressed the case against the accused party, WORLD PEACE PRIZE AWARDING COUNCIL. This investigation was initiated from the Case State Sangha Maha Nayaka Committee.

The Charges by which the International Buddhist Ethics Committee is accusing WORLD PEACE PRIZE AWARDING COUNCIL are enumerated below:

  • Complicity with Crimes against Peace
  • Complicity with Violations on Buddhist Cultural Heritage

Therefore, it is detailed a series of EVIDENCES that support the Charges referred so that the Jury members decide about the possible “Responsibility”, “Innocence” or “Insanity” of the accused. Such evidence come from graphic and audiovisual media that have been gathered, sorted and confirmed in their order and context as Means of Proof in order to know, establish, dictate and determine the Responsibility of the Accused for committing the aforementioned Charges.

The procedure established in the Statute of INTERNATIONAL BUDDHIST ETHICS  COMMITTEE & BUDDHIST TRIBUNAL ON HUMAN RIGHTS provides both bodies the ostentation to enjoy independence and liberty from state and national regulation and control, besides having the legality and acting as a Buddhist People in order to assert its customs, traditions, practices, procedures, judgments and rights as well as acting in pursuit of the development of Spirituality, of Buddhist Ethics, and of the defense of International Human Rights. This procedure has the particularity, singularity and distinction of having “Special Jurisdiction of the Tribal Law” and “Universal Jurisdiction of the International Law”, thus having the Character, Juridical validity, Legal Powers, infrastructure, Training and Capability necessary to be Actor, Administrator and Executor of Justice in this realm and exercise, by judging of the Accused by means of an Ethical Judgment whose Purpose is Truth, Reconciliation and Learning.-

 

 

EVIDENCES

 

Evidence 1: Illegal delivery of Peace Prize to international criminal

World Peace Prize Awarding Procedures: “Article 2 – The Top Honor Prize is awarded to a person or organization who has contributed to the peace Justices and Mercy causes for mankind by a settlement of conflicts or a prevention of war; who has, through a significant invention, promoted peace, stability and welfare of communities; who has given major sacrifice for the preservation and promotion of human rights and environments.”

INTERNATIONAL BUDDHIST ETHICS COMMITTEE: On July 29, 2017, an Act to the WORLD PEACE PRIZE AWARDING COUNCIL was issued to perform an International Repudiation of the World Peace Prize given to Dr. Bhaddanta Kumarabhivamsa, who is Chairman of the State Sangha Maha Nayaka Committee of Myanmar. This organization was sentenced for the serious crimes of FALSE BUDDHISM and VIOLATION OF THE BUDDHIST LEGAL CODE (VINAYA), OPPRESSION AND ILLEGAL DETENTIONS AGAINST BUDDHIST SANGHA, COMPLICITY WITH DISCRIMINATION, VIOLATION OF THE RIGHTS OF WOMEN AND CHILDREN, VIOLATION OF FREEDOM OF EXPRESSION, VIOLATION OF THE RIGHTS OF INDIGENOUS AND TRIBAL PEOPLES, CRIMES AGAINST HUMANITY AND PEACE, COMPLICITY WITH GENOCIDE AND ETHNIC CLEANSING. Therefore, Dr. Rev. Han Min Su of the WORLD PEACE PRIZE AWARDING COUNCIL was asked to cancel the Peace Prize given to Dr. Bhaddanta Kumarabhivamsa, who is responsible for high crimes against peace. As the WORLD PEACE PRIZE AWARDING COUNCIL ignored this Act, there is evidently an act of Complicity with the crimes against peace committed by Dr. Bhaddanta Kumarabhivamsa.

The Republic of the Union of Myanmar – Ministry of Information: “A Buddhist monk and a layperson won the World Peace Award, selected by the World Peace Awarding Council, at a ceremony held at Karaweik Palace Hotel in Yangon on 1 November. Joint-founder of the council and leader of the assessment committee Dr Han Min Su and Abbot Dr Moktak of the Republic of Korea made speeches at the ceremony. The Korean Sayadaw offered the World Peace Award to Bhamo Sayadaw Abhidhaja Maharattha Guru Abhidhaja Aggamaha Saddhammajotika Bhaddanta Kumarabhivamsa, Chairman of State Sangha Maha Nayaka Committee, while Dr Han Min Su presented the award to Agga Maha Thirithudhamma Manijotadhara Wunna Kyawhtin Dr Khin Shwe, the chairman of the Rescue and Helping Committee in the Myanmar parliament.
Four persons from Myanmar, South Korea and Japan won World Peace Awards in 2015. The World Peace Awarding Council was established by US president John F. Kennedy in 1961.

Evidence 2: Illegally Awarding Peace Prize to Scammer and False Buddhist

INTERNATIONAL BUDDHIST ETHICS COMMITTEE: In 2011 the WORLD PEACE PRIZE AWARDING COUNCIL gave a Peace Prize to a millionaire scammer who claims to be the “third incarnation of Buddha.” In awarding the prize, it was deceitfully alleged that this individual has carried out multiple humanitarian activities and it was also published a false biographical list of spiritual merits by Wan Ko Yee, who calls himself “H.H. Dorje Chang Buddha III” in order to defraud hundreds of people by selling million-dollar paintings. The biography of this individual is as false as the biography invented in the Case Ronald Lloyd Spencer.

Dorje Chang Buddha III has received numerous awards, including the United States Presidential Gold Award, which the Chairman of the  President’s Advisory Commission on Asian Americans and Pacific Islanders presented on behalf of President George W. Bush to H.H. Dorje Chang Buddha III for the outstanding contributions of H.H. Dorje Chang Buddha III to the arts, medicine, ethics, Buddhism, spiritual leadership, and United States society; and Whereas in 2010, the World Peace Prize Awarding Council also recognized the Honorable Benjamin A. Gilman for being a life-long champion of human rights who has fought world hunger, narcotics abuse, and narcotics trafficking: Now, therefore, be it Resolved, That the Senate– (1) commends the World Peace Corps Mission for advancing peace, justice, and inter-religious collaborations; and (2) celebrates the World Peace Award and the recipients of the World Peace Award.”[4]

World Peace Prize Awarding Council: “The World Peace Prize Awarding Council held a grand award ceremony on June 14, 2011 in the Gold Room at the U.S. Capitol to express our respect for the recipients of the 2010 World Peace Prize: H.H. Dorje Chang Buddha III, prominent leader of Buddhism in the world; Hon. Benjamin A. Gilman, former Chairman of the House Foreign Affairs Committee. The ceremony, chaired by Dr. Han Min Su, founder of the World Peace Prize Awarding Council, was graced by the presence of Senator Mark Kirk, member of the Senate Committee on Appropriations; former Senator Steve Symms; Congresswoman Illeana Ros-Lehtinen, Chairman of the House Foreign Affairs Committee of the United States Congress; Congressman Darrell Issa, Chairman of the House Oversight and Government Reform; Congressman Steve Chabot, member of the U.S. House Committee on Judiciary; and Congresswoman Sheila Jackson-Lee, member of the Committee on Homeland Security; Congresswoman Corrine Brown, Chairwoman of the Transportation Subcommittee on Railroads. They all commented on the great achievements of the awardees, who have contributed tremendously to peace and enlightenment for humanity. This event, awarded for the 2010 recognition to those deserving recipients, is part of a continuing program by the World Peace Corps Mission to recognize the outstanding work of individuals who make major contributions for the establishment and maintenance of peace. In view of some recent comments that the World Peace Prize Awarding Council has received from individuals and groups, expressing their misconceptions and misunderstanding. Our Council hereby issues this statement. (…)H.H. Dorje Chang Buddha III, recipient of the 2010 World Peace Prize Top Honor Prize recipient, was recognized by more than 50 eminent dharma kings, regent dharma kings, and great rinpoches from major Buddhist sects around the world: H.H. Dharma King Dumu Qujie, the Root Master of the 17th Karmapa; H.E. Goshir Gyaltsab, a regent dharma king and national master; H.E. Sharmapa, a regent dharma king; H.H. Dharma King Trulshik, H.H. Taklung Tsetrul, and H.E. Chogye Trichen, all three of whom are Masters of the Dalai Lama; H.H. Dharma King Dodrupchen Thupten Trinle Palzang, H.H. Dharma King Penor, H.H. Dharma King Achuk, H.H. Dharma King Jigme Dorje, amongst others. H.H. Dorje Chang Buddha III is the most widely recognized leader in the history of Buddhism. In the past decade, H.H. Dorje Chang Buddha has suffered greatly for withstanding long-term persecution for his religious activities. A member country of the Interpol has once requested the Interpol to issue a warrant for His arrest. The request was subsequently withdrawn voluntarily by this member country after some years. Upon thorough investigation, in October of 2008, the 72nd session of the Commission for the Control of Interpol’s Files withdrew the arrest warrant and the entire case against H.H. Dorje Chang Buddha III. Interpol also issued a document stating in definite terms that the arrest warrant against H.H. Dorje Chang Buddha III has been cancelled and all of its member countries have been notified of the cancellation. Although H.H. Dorje Chang Buddha III long ago received official notification of the withdrawal of the arrest warrant and the removal of the entire case, He has never shown such documents to prove His innocence. Regardless of the slander He has endured, H.H. Dorje Chang Buddha III did not disclose such ironclad evidence. When the World Peace Prize Awarding Council found out, and asked H.H. Dorje Chang Buddha III about this, He responded by saying that what He must do is bear all of the karmic offenses committed by living beings and give to living beings all of the good karma and merit that He has planted. He said that if He proved His innocence by showing those documents, then those who slandered Him would no longer be seen as innocent. Who, He asked, will bear their karmic offenses? His Holiness Dorje Chang Buddha III is more than deserving of the Top Honor Prize as He exemplifies the nobility of selflessness; a model of morality for all to emulate. He also demonstrated how peace is often attained by determination, humility and the perseverance to advance its cause in the face of adversity. The World Peace Prize Awarding Council operates according to the core spirit of advancing peace and justice and inter-religious collaborations. The Council is led by co-founder and executive judge Dr. Han Min Su with esteemed members including Chief Judge Hon. Lester Wolff, former Chairman of the United States Congress Asian Affairs Committee; Dr. Suzi P. Leggett, advisor to one of the former Speaker of the United States Congress; Hon Asher Naim, former Israeli Ambassador to the United Nations; Hon. Bhupatry M. Oza, former Ambassador of India; Hon. Peter Lewis, former Speaker of the South Australian House of Assembly; Dr. Kong Shiu-Loon, former advisor to the UNESCO; General Gennady P. Turmov, retired General of Russia. Preaching and promoting peace is an arduous and sometimes thankless task. Those in the vanguard continue to become targets of others who lurk in the darkness to attack the peacemaker and attempt to undermine their efforts. That is why we established the World Peace Prize, to encourage continuing efforts towards peace and to defend the Peacemaker against scurrilous diatribes that put into question the motivation of well meaning and dedicated individuals.”[5]

Jason Henry, and Steve Scauzillo (San Gabriel Valley Tribune): “A prosperous Pasadena artist wanted for allegedly stealing nearly $8 million in China has built an empire of devoted disciples in California based on the claim that he is the reincarnation of Buddha. Now known as His Holiness Dorje Chang Buddha III (Wan Ko Yee), the native of the Sichuan province leads an obscure sect of Buddhists with followers in San Francisco and the San Gabriel Valley who believe he can perform miracles and create masterpieces worth millions of dollars. Despite a following that some say spans the globe, most experts on Buddhism and in the art world did not know of him. One academic feared speaking publicly about him because of his “connections” in Hong Kong, Taiwan, Thailand and China, which include the heads of multimillion dollar corporations. “I don’t know how it even grew so big,” said the Southern California professor. “It is just weird, to be honest. Even for someone who studies Chinese religion for a living. He is still pretty well connected in China, despite everything that has happened.” The expert on Chinese Buddhism called the organization “suspicious” and questioned the money flowing to (Dorje Chang Buddha III). In March, the sale of one of his ink drawings for $16.5 million shocked the art world, with one dealer calling the sale extraordinary. (Dorje Chang Buddha III) has received accolades from dozens of local, state and federal legislators — including the late U.S. Rep. Tom Lantos, Los Angeles County supervisors Hilda Solis and Michael Antonovich and then-Assemblywoman Judy Chu of Monterey Park — for his religious and artistic prowess. The bulk of the praise came to Wan Ko Yee — Dorje Chang Buddha III’s name before he changed it — at a time when Interpol sought his arrest. His followers spent roughly $120,000 on lobbyists over the past 10 years to get recognition from Congress for him, his children and his wife, according to Congressional records. Rep. Chu has distanced herself from (Dorje Chang Buddha III) since being elected to Congress. “I am deeply disappointed that my certificate, given under a different name and different circumstances, is being used to mislead people,” she said. In 2011, Congressman Lester Wolff, D-New York, presented Dorje Chang Buddha III with a “World Peace Prize” for his accomplishments. The prize has not been given since, according to the award’s Chief Judge Father Sean McManus, who noted more than 10 Congress members in attendance at the ceremony in Washington, D.C. The award’s website also lists Np Seng, a Macau mogul, as a past recipient. Federal investigators in a 1996 Congressional hearing testified that Seng funneled foreign money to the Democratic National Committee through a Chinese-American restaurateur with ties to President Bill Clinton. Dorje Chang Buddha III’s followers deny any wrongdoing by their leader and say he is misunderstood and his good works are misrepresented by those who mean to discredit him. The Chinese government confirmed April 14 that Dorje Chang Buddha III, previously known as both Yi Yungao and Wan Ko Yee, is still wanted in his home country. “From 1984 onwards, Yi and his accomplices committed fraud by means of deception, causing losses of CNY 60.8 million (USD $7.32 million),” wrote Zhu Haiquan, a spokesman for the Chinese Embassy in Washington, D.C. Helou “Vincent” Huang, a representative of the Office of H.H. Dorje Chang Buddha III, a nonprofit based in Monterey Park, said the Chinese government falsified the charges. “The Chinese government slandered him,” Huang said during a telephone interview April 16, while accompanying Dorje Chang Buddha III on a speaking tour in Miami. He said Dorje Chang Buddha III, then Yungao, was involved in a land dispute in 2002 where two or more property owners said they were defrauded by him. The Master Yi Yungao International Cultural Institute showed up in Alhambra in the 1990s, was rebranded under Wan Ko Yee in 2004, then reopened in Covina as the H.H. Dorje Chang Buddha III Cultural and Art Museum last year, according to IRS filings. The grand opening of Dorje Chang Buddha III’s Covina museum drew elected officials including Sen. It is representative of an emerging genre of 1940s Chinese artists from Shanghai. “When you first look at the painting, it looks like a mess. But when you stand back, you can see order and discipline. Some say there is something that transpires you into a different world and gives you inner calm. “It has to do with religion, but not totally,” Lum said. The auction began at $10 million, the appraised value. Bidders from Paris, Thailand and California competed for the right to take home the painting, she said. Many of his earlier works hang on museum walls. But they are not for sale, Lum said. The highest spiritual leader in Buddhism alive today currently lives in the United States of America. His Holiness Dorje Chang Buddha III is not one who seeks publicity. Even when awarded the Presidential Gold Award, the Dr. Martin Luther King Legacy Award for International Service and Leadership, and many other prestigious prizes, He did not attend the award ceremonies to receive the prizes in person. He is well known for loving-kindness and compassion, and has made a vow of only helping others and never accepting any offerings from anyone.”

A pile of recycled copper is still copper no matter how much flattery is applied. This truth is not decided by human actions. Rather, it is determined by its inherent nature and structure. In the entire history of Buddhism, H.H. Dorje Chang Buddha III created countless first-places: First, H.H. Dorje Chang Buddha III truly manifested the accomplishment of “perfect expertise in both exoteric and esoteric Buddhism and perfect and wondrous mastery of the Five Vidyas” that is the highest standard of Buddhism. The concept of the Five Vidyas is known to almost everyone in Buddhism. Many who are masters also claimed to possess the Five Vidyas. However, the fact is that no one ever manifested the true and perfect Five Vidyas. They can only talk about the Five Vidyas. Only H.H. Dorje Chang Buddha III perfectly applied all conditional dharmas and unconditional dharmas to truly manifest the accomplishments of the Five Vidyas one by one before living beings for them to see in reality. Just look at the thirty big categories of accomplishments published in the treasure book H.H. Dorje Chang Buddha III. It is quite evident that throughout history no holy one has ever reached such a height. Next, as the supreme great Buddha, H.H. Dorje Chang Buddha III made the vow “I will bear all negative karmas and sins of living beings, I will give all my good karmas and merit to you.” This is the grandest, the deepest and broadest, and the most compassionate power of vow in the entire dharma realm. His Holiness the Buddha is the highest and the most revered primordial Buddha in the dharma realm and always manifests unselfishness and great compassion to dedicate all His accomplishments from the supreme, non-differentiating, and perfect enlightenment to others. As another example, for the first time, H.H. Dorje Chang Buddha III brought to people in this earthly world the The Supreme and Unsurpassable Mahamudra of LiberationExpounding the Absolute Truth Through the Heart Sutra, and other core dharma. In a non-sectarian way, H.H. Dorje Chang Buddha III has revealed the pure and correctBuddha-dharma of Buddhism and transmitted the holiest dharma of liberation. The blessing and merit power of such dharma is unimaginably high. Whether the disciple practices the Mud-Pill Path-Fruit dharma, which is the highest distinct Path-Fruit dharma applicable to a certain group; or one practices the Corpse Pose Tummo (Inner-Heat) Samadhi, which is the highest of the Tummo dharmas; or one practices the Vajra Substitute Body Meditation; or one practices the Xianliang Great Perfection, which within a two-hour period beginning from the time the disciple receives the initiation and related dharma to the time he practices it and becomes accomplished, the disciple can directly see holy states, realize holiness, and even instantly see the rainbow-body state. Those persons of holy virtue sitting here today on the platform with their certificate of holy virtue hanging in front of them have personally experienced this. Only the direct transmission by a Buddha of the highest Buddha-dharma, the State Practice Initiation, enables all cultivators to attain instant realization and become liberated in this very lifetime through cultivation in accord with the dharma.   Moreover, H.H. Dorje Chang Buddha III is the first extremely great holy one in history who does not accept any offerings and only serves living beings free of charge. At any time and any moment, H.H. Dorje Chang Buddha III is always teaching His disciples to consider living beings’ interests, care for living beings at anytime and anywhere, and regard living beings as one’s own parents and family members. His Holiness the Buddha is aware of living beings’ hardship in life, does not wish to see them feel any pressure, and made the vow of only serving living beings without accepting any offerings. His Holiness the Buddha not only made this vow, but also carried it out in this manner. In this world, there has been no great virtuous one or holy one who has done so. Throughout history and until now, no one has ever done so. His Holiness the Buddha always said that He is a servant to living beings and worked hard every day for living beings without being compensated. His Holiness the Buddha not only does not accept money or properties from living beings, but also used the money from selling His paintings to support monastics’ living, contribute to disaster relief efforts, and assist people in poverty. Let’s look at those dharma kings and rinpoches in the world. Without expecting them not to accept money, it will be nice if they do not lie. [not sure why this is here]H.H. Dorje Chang Buddha III is just like Sakyamuni Buddha and only has the conduct of benefiting others and facilitating their enlightenment. Additionally, H.H. Dorje Chang Buddha III received the largest number of and the highest recognitions and corroborating recognitions in the history of Buddhism. In 2006, the International Buddhism Sangha Association (IBSA) sent the book A Treasury of True Buddha-Dharma printed with a lotus on the cover to the dharma kings and regent dharma kings of all major sects of Buddhism in today’s world. They were so moved by reading this treasure book that they engaged in definitive confirmation. They recognized that H.H. Dorje Chang Buddha III is the reincarnation of Dorje Chang Buddha who is the master of all Buddhas and is the ancient primordial Buddha’s coming to this world for the third time. The more than one hundred recognitions, congratulations, and corroborating recognitions received were never surpassed by anyone in history. Actually, His Holiness the Buddha is always a Buddha and does not need any recognition. Moreover, how could holy and virtuous ones who are lower than the Buddha have the qualification to write recognitions for the Buddha? As an analogy, Sakyamuni Buddha expounded the Tripitaka by relying on the enlightenment and accomplishment of the Buddha and is a Buddha without requiring recognition from anyone. A recognition written for the Buddha would be a sheet of worthless paper to the Buddha, because the person writing the recognition is too much lower than the Buddha in terms of accomplishment and enlightenment. It would be like the Sixteen Venerable Ones coming forward to recognize the Buddha. The effect of such a document of recognition would be nothing other than insulting the Buddha. H.H. Dorje Chang Buddha III does not need recognition by anyone either. However, it is a remorseful fact that there are even people who are false rinpoches and have no virtue not admitting the fact that they wrote recognitions. For instance, there is a dharma king. Because he only had recognition by a rinpoche, he felt somewhat embarrassed comparing to the numerous recognitions and corroborating recognitions that H.H. Dorje Chang Buddha III received. In particular, he always claimed the perfect proficiency in both exoteric and esoteric Buddhism and full command of the Five Vidyas. However, he has no thorough understanding in any dharma of exoteric or esoteric Buddhism. All he could do is carelessly and erroneously teach the sutras and use confusing logics to express the dharma. He does not have any uncommon accomplishment in the Five Vidyas to speak of. Dalai Lama is in the same category of virtue and conduct and even went so far as to instruct this person not to admit having written a document of recognition, out of his hatred against H.H. Dorje Chang Buddha III being a Buddha. Needless to say how small the status of a dharma king of a sect is in comparison to a Buddha. The apparent inferiority of his status is obviously very humiliating and motivated him to lie. Actually, you all are very clear about what they are. Just by telling lies, they are not even as good as a common good person! Their mentality and conduct have already broken away from Buddhism and no longer belong to the morality and cultivation that a dharma king should have. A person who has no realization even defames H.H. Dorje Chang Buddha III. Where is his morality? Therefore, this dharma assembly reminds Buddhist disciples to greatly heighten your attention. In the future, whenever you find virtue-less figures of a similar kind who slander the Buddha and slander Buddha-dharma and whenever you witness people who slander H.H. Dorje Chang Buddha III, slander Expounding the Absolute Truth Through the Heart Sutra, or slander the dharma expounded by H.H. Dorje Chang Buddha III, we as Buddhist disciples should stand up as a cultivator to guard the dharma and to protect living beings’ interests. We should apply the bodhicitta of great compassion to help those who slander the Buddha and do damage to the true Buddha-dharma due to their evil views stop committing faults. We may even need to criticize them to cause them to turn away from the evil and return to the correct path. This is to prevent them from descending into the three lower realms or even the hell of uninterrupted suffering. This is the vow of bodhicitta that Buddhist disciples should make. On this extremely magnificent day, in addition to inform you all that our supreme and highest H.H. Dorje Chang Buddha III is a one-hundred-percent true Buddha in the universe, the scripture Expounding the Absolute Truth Through the Heart Sutra that was personally expounded by His Holiness the Buddha will also be made public to you all today. Expounding the Absolute Truth Through the Heart Sutra contains the densely extracted precious essence from the treasury of Buddha-dharma. During the period of 49 years when the supreme leader of Buddhism in this earthly or Saha world, Sakyamuni Buddha, expounded the dharma, 84,000 dharma gates were taught. However, 22 of these 49 years were spent on expounding prajna, the absolute truth of attaining liberation. You can imagine how important the absolute truth of prajna is! The Mahaprajnaparamita Sutra has 600 chapters and embodies boundless merit. However, the text of the sutra is very long and not easy for all of you to understand . Now, we finally have waited until H.H. Dorje Chang Buddha III collectively and harmonically condensed the precious essence of the absolute truth of prajna and the principles of the Tripitaka and cultivation into this book of more than 400,000 Chinese characters. Expounding the Absolute Truth Through the Heart Sutra is the utmost treasure of precepts, cultivation, and dharma practice for attaining holiness, and is this world’s unprecedented supreme sutra leading to accomplishment and liberation. Additionally, the Dharma Voice Publishing, L.L.C. also respectfully invited holy and virtuous ones and eminent monks to confer empowerment as a group. As a result, the first-publishing copies of this Buddhist scripture have been stamped with a first-publishing seal that brings the special magnificent empowerment of beseeching auspiciousness and good fortune. We witnessed Buddhas and heavenly dragons respectfully congratulating the sutra Expounding the Absolute Truth Through the Heart Sutra. Therefore, we hereby make the best wish to you all. After respectfully beseeching and receiving this sutra, you shall respectfully and earnestly read it. This is not a matter of reading through once or twice. You should read repeatedly and over and over again to understand the meaning of this sutra and learn the dharma well. By cultivating in accord with the dharma and following the precepts, one will naturally realize and become enlightened by the absolute truth of human life and the universe. Today, we took a special initiative and invited the holy dharma bowl used to receive Buddha-bestowed nectars to the venue of this dharma assembly. After a while, this holy bowl will be rung loudly to empower and beseech good fortune for you all. In addition, the United International World Buddhism Association Headquarters (UIWBAH) also responded to a special request from the Dharma Voice Publishing, L.L.C. to invite the contrasting photos of Namo [again, not sure what this means. Isn’t “Namo” used to express “homage to” or something like that? Can it also be used as a form of address?) H.H. Dorje Chang Buddha III to the venue of this grand dharma assembly taken in October 2012 when His Holiness the Buddha reversed an aged appearance to that of a youth. Due to seeing living beings’ miserable situations caused by the harms brought to them by evil masters, Namo H.H. Dorje Chang Buddha III was in tears of great compassion and bodhicitta. His Holiness the Buddha then practiced the dharma of Mightily and Fiercely Bearing Karmas to transfer living beings’ dark karmas to Himself. Because the dark karmas accumulated within H.H. Dorje Chang Buddha III’s body, after only three months, His Holiness the Buddha suddenly turned into an elderly person of over 80 years old. After practicing the dharma of reversing an aged appearance to that of a youth to release the dark karmas from the Buddha’s body, only a little over ten minutes later, the Buddha had skins peeling off from His face and a transformation of His bone frame. His Holiness the Buddha changed to an appearance of a teen or a young man in His 20s. The most amazing fact is that His appearance is not only extremely majestic but also far more handsome than when He was at the age of about 20 years old. There is no way to describe the youthfulness and majestic appearance in words. I can only use these two mundane sentences to express the real situation: It was like a god coming from the capital of heaven in delighted steps. Anyone looking at the extremely handsome appearance would know He is a Buddha! The change was really dramatic like astounding the heaven and shaking the earth. His appearance is completely different from the past. You all will view and pay tribute to four photos of H.H. Dorje Chang Buddha III. The first one is a photo of H.H. Dorje Chang Buddha III taken in 1994, which is 20 years ago. The second one is an image of an elderly person taken in October 2012 when bearing living beings’ dark karmas. The third photo shows His appearance after returning from an old age and restoring His youth in about 10 minutes and was taken on the next day from the previous one. After restoring His youth, the bone frame of His face greatly changed and became that of a different person. The fourth photo was taken during the last month. However, we at the IBSA never imagined that His Holiness the Buddha would even state that He is an ordinary person, that He does not know the dharma of reversing an aged appearance to that of a youth, and that the change was a result of treatment by the methods of medicine and was a phenomenon of medically removing speckles, wrinkles, and aged skin. His Holiness the Buddha said that this is simply meaningless, all things are temporary and impermanent, and only cultivating with the bodhicitta of great compassion to benefit living beings can be eternal. Although this is what His Holiness the Buddha said, how could we who had witnessed the fact in person on the spot believe? What high-tech method of medicine can turn an old age to a very young age within a time interval of a little over ten minutes? Moreover, not only the muscles and skins changed completely, even the bone frame of the face was totally transformed and greatly altered! From His Holiness the Buddha’s describing His supremely great dharma and unsurpassable holy realization as His being the same as an ordinary person, we can thoroughly see the great, selfless, and unselfish holy purity of H.H. Dorje Chang Buddha III. Today, the four photos of His Holiness the Buddha spanning 20 years are respectfully displayed in the specifically created Holy Object Chamber, for you all to view and pay homage to and to witness the true Buddha-dharma in reality. All attendees of the assembly, after you beseech and receive the sutra Expounding the Absolute Truth Through the Heart Sutra, please be guided by the volunteers and follow the queue to enter the Holy Object Chamber to view and pay tribute to the exhibited holy objects. Here we must give you a special reminder. Photographing is absolutely prohibited. H.H. Dorje Chang Buddha III stated seriously, “The photos captured the situation of medical treatment and must not be used as propaganda. Therefore, if anyone tries to take pictures in hiding, that would be insulting all Buddhas and Bodhisattvas in the ten directions. I will not transmit the dharma to anyone who takes pictures.” We at the IBSA once again remind you all. We can only respect Buddhas and Bodhisattvas, and must not insult the Buddha. His Holiness the Buddha does not wish to publicize the photos showing the reversing of His aged appearance to that of a youth for self-publicity. The fact that we can see the photos today is already very magnificent. How can we not respect His Holiness the Buddha’s wish? One who does not respect the wish of His Holiness the Buddha is unlikely to attain accomplishment even if he or she learned the dharma. Later, when you enter the Holy Object Chamber to pay homage to the holy objects, due to the limitation of time and space, please do not prostrate. You should walk slowly but please do not stop. Please have the mentality of benefiting others so every attendee of the dharma assembly today will be able to view respectfully the visage of H.H. Dorje Chang Buddha III. Now, in advance, we wish the dharma assembly a perfect success. We wish that you all have an auspicious and magnificent experience, beseech and bring back the supreme treasure scripture, acquire perfect good fortune and wisdom, and attain enlightenment early!”[7]

MANIFESTO on Prison Torture

The Buddhist Tribunal on Human Rights, defender of the rights of global citizenship and of all beings of Mother Earth, exercising the cultural sovereignty that emanates from the Buddhist Peoples and Spiritual Communities, perfectly knows the situation of poverty and oppression in which there is a large part of the marginalized populations of the world, which totally or partially lose their political, economic, legal and environmental freedoms;

The Buddhist Tribunal on Human Rights has a universal ethical vocation, so it calls upon the entire humanity to become aware of the terrible situation suffered by the populations of prisoners in jails;

The Buddhist Tribunal on Human Rights addresses the Inter-American Commission on Human Rights (IACHR), to which it has previously sentenced as Responsible for the charges of VIOLATION OF THE RIGHTS OF BUDDHIST PEOPLES AND SPIRITUAL COMMUNITIES, and VIOLATION OF THE HUMAN RIGHTS TO LIFE, PEACE AND INTEGRITY;

It is stated that the Inter-American Commission on Human Rights (IACHR) is complicit in the crimes of the Argentine Republic, since it has refused to investigate certain criminal acts committed by this State that deserve to be condemned, such as religious discrimination and the violation to access to justice;

It is stated that the Inter-American Commission on Human Rights (IACHR) decided not to respond or act in response to the actions of the Buddhist Tribunal, such as the Pronouncement on Judicial Lack of Protection of March 4, 2017, in which it was insisted on denouncing that the police and the prison system of Argentina commit crimes against humanity, because, systematically or widespreadly, there are cases of torture, abuse and prolonged arbitrary detention;

It is stated that the Inter-American Commission on Human Rights (IACHR) decided not to respond to or act upon the actions of the Buddhist Tribunal, such as the Proclamation on Institutional Violence of February 05, 2018, where it was alleged that the Argentine government of President Macri has criminalized the social protest through direct repression against demonstrators or through mass arbitrary detention of demonstrators and bystanders, violently repressing with toxic gas and bullets against civilians, opposition legislators and journalists, even making cruel and inhuman treatment against women, so that crimes against humanity would being committed;

It is stated that the Inter-American Commission on Human Rights (IACHR) decided not to respond to or act upon the actions of the Buddhist Tribunal, as when the Proclamation on Institutional Violence confirmed that the Argentine government will continue carrying out and endorsing episodes of institutional violence with impunity, such as torture, arbitrary arrests and unofficial executions, unless the Inter-American Commission on Human Rights (IACHR) decides to intervene urgently to stop this systematic and widespread plan of impunity and violation of human rights justice;

It is stated that the Inter-American Commission on Human Rights (IACHR) decided to ignore that the Argentine government would not be doing anything to stop the numerous cases of police abuses, such as aggressions and arbitrary detentions, and even extrajudicial executions or torture, which have been denounced by organizations such as the Coordinator Against Police and Institutional Repression (Correpi) and the Office of Procurator for Institutional Violence (Procuvin);

It is stated that the Inter-American Commission on Human Rights (IACHR) decided to ignore that the Buddhist Tribunal publicly condemned President Macri as a necessary participant in the systematic plan of institutional violence and human rights abuses in Argentina, especially by arbitrary detentions, torture and unofficial executions;

It is stated that according to the National Registry of Cases of Torture, prepared jointly by the National Penitentiary Procuracy, the Provincial Commission for the Memory and the Study Group on Criminal Justice and Human Rights, Argentina’s penal system uses torture as a structural, widespread and persistent element, because in 2017 the Argentine prisons have carried out more than 5300 cases of torture against more than 1400 victims, subjecting the prisoners to physical aggressions, inadequate health, individual isolation, poor material conditions, poor nutrition, threats, impediments of family visits and social ties, degrading personal requisition, robbery, and burdensome or constant relocations, all of this making the prisoners to cease feeling like human beings;

It is stated that Alcira Daroqui, director of the Department of Investigations of the Penitentiary Procuracy of the Nation and coordinator of the National Registry of Cases of Torture, affirmed that torture in the prison system is present systematically and in a widespread way, which fully demonstrates the righteousness of judgment of the Buddhist Tribunal on Human Rights against the Argentine State for crimes against humanity;

It is stated that torture in Argentine jails includes a regularity and systematic fist blows, kicks, hitting with sticks, pepper and tear gas, and stunning techniques, being a deliberately aggravated form of inhuman treatment and cruelly degrading penalty, trying to dominate the prisoners with the cost of generating higher degrees of prison violence;

It is stated that the National Penitentiary Procuracy has warned that isolation as a form of punishment constitutes a form of torture, which is evidenced by the fact that in confinement cells prisoners are held in degrading conditions for almost the entire day and without light or ventilation, by being surrounded by urine and fecal matter, without mattress to sleep, in the presence of rats and cockroaches, without food and without medical attention, even generating higher levels of torture from the guards when the prisoners report their inhuman living conditions;

It is stated that Alcira Daroqui, of the National Penitentiary Procuracy, affirmed that the low number of complaints does not correspond to the enormous number of acts of torture registered, which would be explained both by the impunity generated by the Argentine judicial field, and it would also be due to the prisoners’ fear to be killed in retaliation for their complaints;

It is stated that there are reports that account for a total of more than 1,900 deaths of detainees in prisons from the period 2010 to 2017, which is a number that has even alarmed the UN;

It is stated that on May 13, 2017, the UN Committee against Torture had already requested the Argentine government of President Macri to take urgent measures against the violence by the security forces, and should thoroughly investigate and unequivocally prohibit the practices of mistreatment, torture, suffocation and humiliation that are a recurrent practice of the corporate militarized structure of security forces and prison staff, whose patterns of violence and arbitrariness also extend to arrests of young people without a court order;

It is stated that 60% of the detainees in Argentina are prisoners without conviction, who often have preventative detention for periods of up to 5 years, which causes prison overpopulation and inhuman overcrowding conditions, as confirmed by the UN Rapporteur on Torture;

It is stated that in April 2018, the UN Rapporteur on Torture denounced the need to act right now against mistreatment, torture and abuse of weapons in Argentina’s prisons, affirming that these arbitrary practices of inhuman detention are part of the oppressive architecture of the military dictatorship of the past but it still survives within the prison and security systems of today, which adds to conditions of detention in total overcrowding, without hygiene, without water and without health care, often forcing detainees to live with rats and drink water from toilets that are used to urinate and defecate;

It is stated that Melzer, the UN Rapporteur on Torture, confirmed that if this type of violent, impunity and generalized practices of the security forces and prisons persist, then Argentina would be Responsible for a widespread and persistent violation of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, which fully validates the Judgment of the Buddhist Tribunal on Human Rights against the Argentine government for committing crimes against humanity;

It is stated that the UN Rapporteur on Torture even collected testimonies that demonstrate that the Argentine prison service uses techniques of torture of the CIA, such as waterboarding (submerging the person’s head in water) and dry submarine (introducing head in a plastic bag);

It is stated that the UN Rapporteur on Torture also checked out that people from marginal neighborhoods and indigenous communities often suffer enormous excesses from the Argentine police, arresting them when they carry out civil protests, and forcing them to confess crimes or denounce other people;

A thorough investigation of the tortures carried out by the police and prison staff of Argentina is required.

The immediate adoption of measures that bring justice to the thousands of people who have been tortured by the security forces of Argentina is demanded.

The urgent implementation of humanitarian assistance for the entire prison population of Argentina is demanded, putting an end to the regime of human rights violations.

The Inter-American Commission on Human Rights (IACHR) is required to investigate and prosecute the crimes against humanity committed by the Argentine government of President Macri, for otherwise the IACHR would be committing an act of Complicity with crimes against humanity.

The Inter-American Commission on Human Rights (IACHR) is held responsible for ignoring the systematic and widespread pattern of mistreatment, illegal detentions and torture carried out by the Argentine security forces, all of which confirms that the inaction of the IACHR is a Violation of International Law.

On September 20, 2018 the present Manifesto on Prison Torture is expressed as a way to contribute to a more peaceful, just, cultured and healthier world.

PRONOUNCEMENT on Violation of the Human Right to Life

 

June 21, 2018

In the first place, the International Buddhist Ethics Committee denounces the terrible demagogy of the Argentine government of President Macri, which has decided to create the legislation to decriminalize abortion in order to generate a public debate that diverts the attention of the media regarding the chronic economic crisis that Argentina is suffering.

Secondly, the International Buddhist Ethics Committee denounces the Inter-American Commission on Human Rights (IACHR) for continuing to show an attitude of violation of human rights to life, peace and integrity, after having declared that the human embryo is not a person.

Third, the International Buddhist Ethics Committee dictates that women’s rights are not above the rights of the unborn child, recalling the fact that there is no valid reason to abort as long as there is the right to give the child for adoption, since if the child is the product of rape or if there are possibilities of being born with an illness, the mother is always free to deliver the child to the care of others instead of simply deciding to murder the baby and cut his/her life project.

Fourth, the International Buddhist Ethics Committee supports the approach of the argentine economist Javier Milei, who in the name of the liberal tradition spoke out against abortion for violating the main of three principles that are defended by Liberalism: the right to life, to freedom and to property.

Fifth, the International Buddhist Ethics Committee denounces the Inter-American Commission on Human Rights (IACHR) for declaring that it is inadmissible to grant the condition of person to the embryo, this being a violation of international treaties that the IACHR allegedly seeks to defend, such as the American Convention on Human Rights that affirms that every person has the right to have his life respected and this right shall be protected by law and, in general, from the moment of conception.

Sixth, the International Buddhist Ethics Committee denounces the Inter-American Court of Human Rights for misinterpreting the letter of the Convention, stating that the human embryo would not be a person, which provides one of the worst legal precedents that there can be, since it would enable then not only abortion but also the experimentation with human embryos, because if they are not people then they would not have human rights and fundamental freedoms.

Seventh, the International Buddhist Ethics Committee confirms the absolute non-existence of the right to abortion, which is an invention of corrupt politicians and the media that despise the intrinsic dignity of human life, its Buddhic-nature or its natural rights, confirming that effectively every woman has the right to reproductive autonomy and to access reproductive health services as long as this does not imply the homicide of the child, since freely and responsibly deciding the number of her children and the size of her family can be solved adequately through the compassionate resource of adoption instead of resorting to the inhuman resource of abortion.

Eighth, the International Buddhist Ethics Committee agrees with Pope Francis I that abortion is a method very similar to the eugenics used by Nazism.

All these eight points demonstrate that the Inter-American Commission on Human Rights violates human rights to life, peace and integrity, violating both the Argentine Constitution that considers the embryo as a person, but also violating the very American Convention on Human Rights that protects life from the moment of conception.

The International Buddhist Ethics Committee is formally requiring the Inter-American Commission on Human Rights (IACHR) to support all legal presentations that have been made to the International Criminal Court (ICC) against the civil-military dictatorship of Maduro in Venezuela for crimes against humanity, especially considering the ruling of the Buddhist Tribunal on Human Rights.

This requirement implies that the Inter-American Commission on Human Rights (IACHR) should demand the International Criminal Court (ICC) to fully investigate Venezuela for violations of human rights, which is a conclusion consistent with the reports of the Inter-American Commission on Human Rights (IACHR), where it is confirmed that the situation in Venezuela is alarming, very serious and catastrophic, given the continuous cases of political prisoners, torture, censorship, lack of supplies and lack of medicines that lead to the weakening of democracy and human rights. As shown by the Inter-American Commission on Human Rights (IACHR), Venezuela is suffering from cancer of high levels of corruption, the existence of a pattern of reprisals against political opponents, severe restrictions on freedom of expression, increased violence and criminality, widespread lack of food and medicine, and child malnutrition. This has led to the worst refugee crisis in the history of the entire American continent, since millions of Venezuelans are fleeing to the neighboring country of Colombia.

The International Buddhist Ethics Committee confirms that it is totally superficial and ineffective for the Inter-American Commission on Human Rights (IACHR) to request the intervention of the Organization of American States (OAS), especially taking into account the fact that Venezuela has announced its formal withdrawal as a member. Therefore, the Inter-American Commission on Human Rights (IACHR) is required to act at an international scale, especially before the International Criminal Court (ICC), taking advantage of the fact that Venezuela is a signatory of the Rome Statute, so it could be perfectly investigated and judged before the ICC for crimes against humanity.

The International Buddhist Ethics Committee confirms that the Inter-American Commission on Human Rights (IACHR), because it has millions of economic, political and legal resources, cannot and should not limit itself to merely presenting detailed reports on the Venezuelan crisis, since such function is characteristic of non-governmental organizations. As an intergovernmental organization, the Inter-American Commission on Human Rights (IACHR) has too much power at its disposal in order to confront and try to resolve the Venezuelan crisis with courage and with Sense of Purpose. To urgently resolve the crisis in Venezuela through peace, democracy and international justice, all that is needed is the Inter-American Commission on Human Rights (IACHR) to act Mindfully, with Compassionate Wisdom and Humanitarian Ethics.

The International Buddhist Ethics Committee, on February 15, 2018, decides to reaffirm once again that the inter-American system of justice should work better and be purified from certain elements and officials that do not comply with fundamental ethical principles, as in the case of Judge Zaffaroni.

The International Buddhist Ethics Committee impeaches Judge Zaffaroni of the Inter-American Court of Human Rights for both his background and his performance. Beyond the fact of not sharing his guaranteeism ideology, some of the reasons for the legal challenge are as follows:

  1. Judge Zaffaroni would have been an official during the last military dictatorship, which committed genocide and crimes against humanity in Argentina, from 1976-1983.
  2. Judge Zaffaroni would have rejected 127 writs of habeas corpus during the military dictatorship, despite the fact that the habeas corpus was the main resource of family members in order that the persons are released from their illegal detentions and are not unofficially executed.
  3. Judge Zaffaroni would have issued some aberrant sentences, such as the judgment where he considers that the sexual violation of a minor with the lights off reduces the weight of the crime.
  4. Judge Zaffaroni would have rented his apartments for using them as brothels.
  5. Judge Zaffaroni has stated on multiple occasions that people do not violate human rights, but only States are those that commit this kind of international crimes, which demonstrates his complete ignorance as an inter-American human rights judge.
  6. Judge Zaffaroni would have been sanctioned with the suspension of his professional license for violating regulations of the Bar Association.
  7. Judge Zaffaroni has been a strong defender of the corrupt and criminal government of former president Cristina Fernández de Kirchner, even coming to legally advice her while being the judge of the Inter-American Court on Human Rights.

The International Buddhist Ethics Committee rules that there are elements to impeach Judge Zaffaroni for the crime of Prevarication, for having ruled arbitrary resolutions and contrary to the law in his role as Argentine judge. In addition, for having systematically rejected habeas corpus during the genocidal dictatorship in Argentina, Judge Zaffaroni could become Responsible for Complicity with Crimes against Humanity, since he would have assisted the military dictatorship in the perpetration of kidnappings and extrajudicial executions. The refusal to provide writs of habeas corpus is perfectly demonstrated in the case of Alicia Lisso, as well as the case of Pablo Fernández Meijide, son of Graciela Fernández Meijide former member of the National Commission on the Disappearance of Persons (Conadep). This shows that the complaint of the lawyer Santiago Dupuy De Lome against Judge Zaffaroni for the crimes of aggravated noncompliance and noncompliance of the duties of a public official is a trifle in comparison with the criminal typology that would really correspond, which is Complicity with Crimes against Humanity, according to the legal vision of the International Buddhist Ethics Committee. For this reason, the International Buddhist Ethics Committee requests the Inter-American Court of Human Rights to immediately initiate a process to remove Judge Zaffaroni as an inter-American judge.

However, the International Buddhist Ethics Committee does not share with the Argentine government that the reason for that removal would be that Judge Zaffaroni is undemocratic because he wants the Argentine government to be replaced. The International Buddhist Ethics Committee considers the public expressions of Judge Zaffaroni, stating that he wishes the fall of the Argentine government of President Macri as soon as possible in order that they do less harm, although it would be a breach of ethics and of impartiality in the function of an inter-American judge, however, it does not constitute any type of crime, being only a political and civil expression. In this sense, the International Buddhist Ethics Committee declares as illegal the police raid on the radio where Judge Zaffaroni expressed his political opinions; also Argentina’s judicial investigation of Judge Lijo against Judge Zaffaroni is declared illegal where he is being investigated for apology of crime; is declared illegal the Argentine government statements saying that Judge Zaffaroni‘s expressions are coup-like and antidemocratic. The International Buddhist Ethics Committee considers that the words of Judge Zaffaroni about his wish for the end of President Macri’s term are totally legal, constitutional and protected by international human rights treaties. Democracy is not simply an electoral process, but it is really the expression and political participation of all citizens in the decision-making. The International Buddhist Ethics Committee believes that the Inter-American Commission on Human Rights (IACHR) should intervene in this matter in order to protect freedom of opinion, conscience and thought which is being systematically attacked by the government of President Macri.

Proclamation on Institutional Violence

February 5th, 2018

The International Buddhist Ethics Committee and Buddhist Tribunal on Human Rights,

Considering that in December of 2017 the Argentine government violently repressed political demonstrators protesting against a reduction in the salary of retirees, being a salary reduction that would be unconstitutional according to important Argentine constitutionalists;

Recalling that the Inter-American Commission on Human Rights (IACHR) publicly expressed its concern about the inadequate and disproportionate violence of the Argentine security forces led by the government of President Macri, affirming that the criminalization of social protest is incompatible with the democratic society where any individual has the right to express his or her opinions peacefully, so that an investigation and subsequent sanctions should be promptly and thoroughly carried out concerning police conduct during those demonstrations;

Aware that the Argentine government of President Macri has criminalized social protest through direct repression against demonstrators or through the arbitrary detention of demonstrators and bystanders, ignoring the fact that even if some people use violence in a demonstration this does not necessarily turns the whole protest into a violent demonstration nor does it legitimize the security forces to dissolve the protest through violence or mass arrests;

Greatly concerned by the fact that on December 14, 2017, hundreds of demonstrators and bystanders were violently repressed with toxic gases and rubber bullets fired by the Argentine security forces, wounding civilians, opposition legislators and journalists, all of which demonstrates the use of disproportionate violence by the Argentine government instead of fostering the right to freedom of expression and democratic dialogue;

Deploring the criminal and violent behavior of the Argentine security forces, which are not only engaged in confronting the demonstrators instead of dedicating themselves to protect life and peace, but they have also systematically attacked journalists covering the demonstrations, by attacking them with batons and tear gas, thus leaving a balance of 36 journalists wounded, arbitrarily detaining them and even firing bullets at 18 journalists for filming or photographing the abuses, in addition to destroying televisual and media artifacts, being the worst violent attack against journalists in the last 35 years of democratic governments in Argentina;

Expressing absolute rejection of President Macri’s affirmation in which he perversely congratulated his officials for showing Gandhian mysticism and rationality at the time of the repression, which demonstrates the total contempt for peace on the part of the Argentine government as well as dishonoring the memory of the great pacifists in the history of humankind;

Analyzing the fact that deputies Horacio Pietragalla and Mayra Mendoza were attacked with impunity by the Argentine security forces, receiving pepper spray in their faces even though they were not carrying out any kind of violent act, which was a police action rated by the Argentine government as perfect, ignoring that this fact could be regarded as a violation against the rights of women, and even a violation against the right to parliamentary immunity;

Examining  the fact that Mayra Mendoza belongs to a political orientation criticized by the Buddhist Tribunal on Human Rights, it does not imply that she is not offered absolute solidarity facing the terrible attack that she has suffered as a woman and as a parliamentarian that protested peacefully;

Bearing in mind that the deputy Leonardo Grosso denounced having been attacked with police batons, and that the deputy Victoria Donda also reported being beaten by kicks of the Argentine police forces led by President Macri, and having to be treated by doctors just like the other deputies attacked, which shows an evident institutional violence, especially because the government publicly mocked the deputies injured;

Taking into consideration the fact that femicide and gender violence have become a plague within Argentine society, there being about 1 (one) femicide per day, that is an alarming amount according to the UN and its Committee against Torture, all of which are fed for the institutional violence promulgated by the Argentine government of President Macri that every day has less respect for the right to life and the right to the fundamental freedoms of people, as has been perceived in gender violence carried out with impunity against defenseless women deputies;

Affirming the agreement with the UN Committee against Torture about the fact that violence against women, especially in the context of police detention, is framed within the category of torture, cruel, inhuman and degrading treatment, so that according to the Buddhist Tribunal on Human Rights a government that systematically encourages this treatment toward women is committing crimes against humanity;

Expressing dismay at the fact that women, retirees and native peoples of Argentina often receive violations of their rights and fundamental freedoms by the government, which usually ignores or treat everything that is not transmitted by the mass media and social networks as nonexistent, creating a difficult context of respect for minorities, including Buddhist Peoples and Spiritual Communities, which have suffered violent attacks with total impunity;

Reaffirming that the hunting and shot in the back that killed the Mapuche Rafael Nahuel, together with the subsequent defense of this extrajudicial execution by the government of President Macri, confirms that the Argentine State has entered a new era of institutional violence led by the highest spheres, as happened with the murder of prosecutor Nisman during the government of Cristina Fernández de Kirchner, mistakenly believing that if a government is legitimized at the ballot boxes it has the right to do anything it wants;

Declaring that the Argentine government will continue to carry out and endorse episodes of institutional violence, unless the Inter-American Commission on Human Rights (IACHR) decides to intervene to curb this systematic and widespread plan of impunity and violation of justice;

Confirming that according to the Coordinator Against Police and Institutional Repression (Correpi, in its Spanish acronym), Argentina is suffering the highest point of violent repression in the last 35 years of democratic history, reaching the point of more than 1 (one) death per day of President Macri’s government, that is a product of extrajudicial executions or torture that happen because there are no restrictions from the institutions of the Argentine government but quite the contrary;

Disapproving that the gendarme Emmanuel Echazú, participant in the death of Santiago Maldonado, member of the Mapuche tribal community, has been promoted by the government of President Macri;

Denouncing that President Macri has received and congratulated a policeman as a hero and a national pride for having shot in the back an alleged delinquent who ran unarmed, not only validating a crime and unofficial execution but also violating the independence of the Judiciary by providing full support and requesting the judge to stop investigating and prosecuting the homicidal police officer;

Criticizing the Argentine government for being composed of some officials who publicly vindicate the genocidal military dictatorship that 35 years ago produced a minimum of 8,000 forced disappearances in Argentina, in addition to developing a systematic plan of torture and illegal executions that have been condemned as crimes against humanity and genocide;

  • It is stated that, from the point of view of constitutionalism, the human right to protest is totally legitimate and valid, even necessary and crucial for the functioning of democracy, especially in a context of poverty and unemployment, or when a government establishes a system in favor of the richest that ignores the welfare of the general population;
  • The IBEC & BTHR affirms its agreement with the Inter-American Commission on Human Rights (IACHR) in requesting the Argentine State to guarantee the freedom of journalists when carrying out their informative work within the framework of political demonstrations, and should not be detained, threatened, assaulted or limited in the exercise of their profession, otherwise a systematic plan of violations of the human right to freedom of expression would be perpetuated;
  • The detailed report presented before Judge Torres by the Procurator’s Office for Institutional Violence (Procuvin, in its Spanish acronym) is invoked, which details numerous cases of police abuse, such as aggressions and arbitrary detentions;
  • It is confirmed that the arbitrary detention of journalists in full activity of filming and photographing political demonstrations had previously occurred during the march in favor of the return of Santiago Maldonado alive, which demonstrates the systematic nature of the illegal measures of the Argentine government;
  • President Macri is condemned as a necessary participant in the systematic plan of institutional violence and human rights abuses in Argentina, especially for arbitrary detentions, unofficial executions, and also for the apartheid against Indigenous and Aboriginal Peoples, who are systematically discriminated and they are denied the access to their territories, food and health in a widespread way, persecuting them with false criminal processes and treating them as the last category of civil society, as claimed by tribal chief Félix Díaz;
  • It is established that President Macri breached commitments signed with Indigenous and Aboriginal Peoples, in addition to continuing to breach constitutional regulations and international treaties signed by Argentina that oblige the country to respect the rights of tribal peoples and indigenous communities, such as the ILO Convention 169;
  • It is recalled that President Macri has publicly expressed on several occasions, as in the World Economic Forum in Davos 2018, that “in South America, we’re all descendants of Europeans,” which constitutes an explicit denial of the existence of indigenous communities and native peoples of Argentina and the rest of Latin America;
  • It is expressed that institutional violence, torture, arbitrary arrests and unofficial executions will continue to exist with impunity in Argentina, even against Buddhist Peoples and Spiritual Communities, unless the Inter-American Commission on Human Rights (IACHR) decides to urgently intervene in order to protect the sacredness of human life, not maintaining complicit silence in the face of human rights violations.

RESOLUTION on Mapuche Community

 

The Buddhist Tribunal on Human Rights,

Confirms that Santiago Maldonado, a member of the Mapuche RAM group, died in the context of a violent repression in the hands of Argentine governmental bodies against tribal peoples who are defending their lands reclamation;

Confirms that the order to violently repress this Mapuche group originated from the highest spheres of the Argentine State, such as the Ministry of Security and the Presidency of the Nation;

Confirms that the Argentine State is in total breach of Convention No. 169 of the International Labor Organization (ILO) on Indigenous and Tribal Peoples and the United Nations Declaration on the Rights of Indigenous Peoples;

Confirms that the Argentine State violates the individual and collective human rights of the Tribal Peoples, denying them the right to their lands, health, justice and education, beginning to increasingly violently exclude and persecute these oppressed communities that have been historically subjected to genocide, ethnic cleansing and crimes against humanity with impunity in Argentina;

Confirms it is in accordance with the sociologist Maristella Svampa in the fact that the Argentine government does not recognize the human rights of the aboriginal peoples, making an illegal and disproportionate use of the security forces;

Confirms the fact that during the burial ceremony of Santiago Maldonado, by means of a quasi mafia-like message, the Argentine State entered the Mapuche territory of the Winkul Mapu Community with the order to, once again, attack with violence the members of this community, resulting in several seriously wounded people and even killing the young Rafael Nahuel from behind, while the Mapuche community was performing vital ceremonies of spiritual initiation that are protected by the Argentine National Constitution;

Confirms that following the analysis of the public statements made by Minister Patricia Bullrich and President Mauricio Macri, it is evident that the murder of the young Mapuche Rafael Nahuel was an extrajudicial execution ordered by the highest spheres of the Argentine State in the framework of a military operation described by witnesses as a human butchery;

Confirms it agrees with Diego Morales, director of the Litigation and Legal Defense Area of the CELS (Centre for Legal and Social Studies) organization, in repudiating the Argentine government’s attitude of militarizing the south of the country, which is rich in natural resources, in addition to the fact that it would be creating a false image of the Mapuche community as an armed terrorist group;

Confirms that although in Argentina the death penalty is prohibited, the main exponents of the Argentine government, such as its security minister, its vice president and its president, have publicly stated that the murder of Rafael Nahuel in Mapuche sacred land was a legal and legitimate action fully framed in the law, even stating that what the security forces do has not need to be proved;

Confirms that, incredibly, according to the Argentine government, its repressive and homicidal actions were a good way to act because in the polls most of the people would consider that the government acted well, ignoring the fact that looking surveys is the most illegal way to administer justice and life of society, developing a right-wing neo-fascist populism that to the aboriginal and tribal peoples is what the US government is to immigrants and refugees;

Confirms that the Argentine government is stigmatizing the Mapuche community, calling them “the violent” and even calling it a terrorist group, which would resemble the repressive policy of the Chilean government;

Confirms it agrees with the writer Pedro Cayuqueo in the fact that the governments of Argentina and Chile are negligent for failing to peacefully resolve the conflicts they have with the Mapuche communities, resorting to the violent way instead of using the diplomatic or political way;

Confirms that agrees with the National Aboriginal Pastoral Team (Endepa, in its Spanish acronym) of the Catholic Church in urgently calling on the Argentine State to stop its irrational use of the repressive system against aboriginal communities, which constitutes a violation of the fundamental rights of tribal peoples that have been established in the legal norms of human rights instruments at the local and international level;

Confirms its support to the statement of the Mapuche Confederation of Neuquén where not only the Argentine security forces’ repressive actions that murdered Rafael Nahuel are repudiated, but also the statements of the Argentine government are considered as Hate Speech and racial violence that do not call for coexistence and intercultural respect;

Confirms that in the context of Argentine history the homicidal way of actionning by the government constitutes a regression to the political violence and extrajudicial executions carried out by the last military dictatorship that killed around 10,000 people in the context of an alleged fight against terrorist groups;

Confirms that according to the Argentine government the alleged weapons of the violent group of the Mapuche community would be spears and firearms that were never found, showing that there is an attempt to demonize an oppressed minority that would lack any kind of weapons;

Confirms that although the Argentine government considers that the Mapuche community is incurring political violence, so far the only two dead people of the conflict have been members of the Mapuche community when suffering the armed repression in the hands of the Argentine government;

Confirms that due to the governmental consideration of the murder of Rafael Nahuel as a legitimate action, this aggravated homicide would also be an extrajudicial execution that would have the intellectual authorship of the Security Minister Patricia Bullrich and the President Mauricio Macri;

It confirms that most of Argentine presidents use to feel that they own the country and feel they have impunity to do what they want, even though this violates national and international law;

Confirms that from the extrajudicial execution of Prosecutor Nisman a limit has been crossed and the Argentine State has returned to carry out illegal murders with total impunity, which is a sad fact that is totally demonstrated with the murder of Rafael Nahuel;

Confirms that after the extrajudicial execution of Rafael Nahuel, after learning that federal judge Gustavo Villanueva was negotiating with the Mapuche community, the Argentine government declared with impunity that it would not accept any illegal or anti-juridical order issued by the judge, who was seeking that the security forces enter the Mapuche territory without firearms;

Confirms that the murder of Rafael Nahuel was not a mere case of disproportionate use of force in the repression of protests and land evictions, but rather that this homicide is part of a systematic criminal plan of the Argentine State to attack the integrity and self-determination of tribal peoples, even guaranteeing impunity for the members of security forces to commit extrajudicial executions, to which President Mauricio Macri considers a legal and legitimate act, thus perpetuating the former Argentine antidemocratic regime of genocide and ethnic cleansing against the Aboriginal communities by drip;

Confirms the fact that the Argentine government considers the Mapuche communities as violent groups that do not recognize the Argentine law, the State and the Constitution, when actually the very Argentine government would be that which does not recognize the International Human Rights Treaties incorporated into its own National Constitution;

Confirms that it is in agreement with the National Round Table for Peace and Intercultural Dialogue regarding the existence of a historical dispossession of all the tribal peoples of Argentina, to whom their pre-existence is ignored and are considered as mere minority groups;

It confirms that the physician Ramón Chiocconi has not only been a direct witness of the wounded Mapuches and of the fact that the Mapuche community is suffering social segregation for centuries, but also being witness of the important spiritual value that for the Mapuche people their territories represent, confirming that according to the Argentine government the Mapuche community is an illegal group just because of wanting to recover their ancestral territories, even though the Argentine law allows the community to be able to recover them;

Confirms that the Mapuche community denounces the fact that the Argentine government is trying to privatize some national parks, so that the intention of the tribal communities would be to safeguard those sacred spaces harmonically;

Confirms that the way how the Argentine government acts is violating the most fundamental human rights, such as the right to life, the right to culture and the right to peace, so that it deserves the strongest repudiation on the part of the international community;

Confirms that in 2015 the Buddhist Tribunal on Human Rights has already sentenced the Argentine State for violations of the human rights of the Tribal Peoples, which should be validated by international organizations such as the Inter-American Commission on Human Rights;

Confirms that the Mapuche Ancestral Resistance (RAM, in its Spanish acronym) group is not a terrorist organization but a community that fights for the rights of the Mapuche people through direct action techniques, whose use of this resource is due to the desperation and impunity suffered by this oppressed community, whose rights are systematically violated;

Confirms that the Buddhist Community condemns all types of violence, resorting to the powerful weapons of humanitarian ethics, compassionate wisdom and active contemplation to cope with injustice;

Confirms that Tribal Peoples are not the original owners of the lands, but rather are in fact the genuine guardians of Mother Earth, existing as an integral part of the lands instead of existing predatorily like most of the States of the world;

Confirms that the Inter-American Commission on Human Rights, which has ignored violations of the human rights suffered by the Buddhist Community, is required to act urgently and with all the instruments of law to stop the violent and criminal conduct of the Argentine government, safeguarding the right to life and the right to peace of all the tribal peoples of Argentina.
